If your selected giveaway winner hasn’t responded, return to the rules you published before the drawing. Follow the stated claim deadline and contact method, keep a dated record of your attempts, and take only the next step those rules and applicable law permit. There is no universal waiting period for private stream giveaways.
What happens if a giveaway winner doesn’t claim the prize?
The outcome depends on the original giveaway terms, the promotion’s circumstances, and any applicable legal or platform requirements. First check whether the rules say what happens after a claim deadline—for example, whether you may contact an alternate winner. If they do, apply that process as written and consistently.
If the rules say nothing about an unclaimed prize, or the wording is unclear, don’t assume that silence lets you keep the prize, draw another winner, or redirect it. Pause and seek advice specific to the organizer’s jurisdiction and promotion before deciding.
How long should you wait for a giveaway winner to respond?
Use the claim period stated in the rules published before entries opened. The available guidance does not establish a default number of hours or days for private stream giveaways. Don’t substitute a familiar-sounding 24-hour, 48-hour, or seven-day window, or change the announced deadline arbitrarily.

If no deadline was disclosed, the sources cited here do not establish a universal replacement period. Preserve the original announcement and get jurisdiction-specific advice before treating the prize as forfeited or choosing a different recipient.
How to handle an unclaimed prize
- Locate the original terms. Review the announcement and rules as they appeared when entries opened. Identify the organizer, prize, eligibility conditions, claim method and deadline, and any stated alternate-winner or unclaimed-prize process.
- Check the notification route. Confirm that you contacted the selected winner through the channel or account specified in the rules. If the rules or your established procedure allows it, send a reasonable reminder. Don’t shorten or extend the deadline arbitrarily.
- Keep a dated record. Save the announcement and rules, the drawing result, timestamps and copies of winner notifications, replies, and the date the stated claim window expired. This is prudent administration, not a recordkeeping period or mandate established by the sources cited here.
- Protect the winner’s privacy. Don’t expose personal details or private messages while trying to reach the winner.
- Apply the disclosed next step. Once the claim period expires, follow the rules exactly. If they provide for an alternate winner, use that process consistently. If the next step is missing or unclear, pause and seek advice before disposing of the prize.
- Deliver safely if the winner responds. Ask only for information reasonably needed to deliver the prize. Don’t charge a fee to claim it or request unnecessary financial or sensitive information.
- Close the loop carefully. If useful, post a brief factual update without sharing private information. Don’t say the winner forfeited the prize unless the rules and applicable requirements support that statement.
Keep prize claims safe
The Federal Trade Commission warns: “If you have to pay to get your prize, it’s a scam.” A winner should not have to pay a claim, processing, or shipping fee as a condition of receiving a prize. Don’t ask for bank or credit-card details, or other sensitive information that isn’t needed to deliver it. The FTC also explains that real sweepstakes are free and by chance; its guidance is useful for safe communications, but it does not set a waiting period for livestream giveaways. Private stream giveaways are not automatically lotteries
Don’t assume a government lottery’s claim rules apply to a creator’s private promotion. North Carolina General Statute 18C-132 concerns lottery drawings and claims; it says lottery prizes unclaimed after the applicable claim period are not abandoned property and are handled under that chapter. That is a lottery-specific rule, not a universal rule for stream giveaways. See North Carolina General Statute 18C-132.
Federal law also contains requirements for mailed sweepstakes, including terms disclosures and restrictions on representing someone as a winner unless that person has won. The U.S. Code source available for this guidance was marked as under maintenance, so it should not be treated as a verified basis for a general rule about private stream giveaways. Consult the Title 39 preliminary code page and verify applicable law before relying on it.

Check the rules for your streaming platform
Platform policies may add requirements beyond your own giveaway terms. Check the current rules for the platform where you ran the promotion before announcing a replacement winner or changing the outcome. Don’t rely on an unverified summary of platform requirements.
