To use music in an independent film, first decide whether you need an existing song, a particular commercial recording, a new performance, commissioned music, or a production-library track. Then identify who can authorize each right your intended use requires, agree on the film’s uses and release scope in writing, and keep the signed licenses and a cue sheet with the production records. A song’s composition and its recording can have different owners, so permission for one does not necessarily clear the other.

The workflow below is broadly useful, but copyright and licensing rules differ by country. The U.S.-specific descriptions are identified as such; confirm the rules and permissions that apply in every territory where you will produce, distribute, or promote the film.

Start by choosing what kind of music you need

Music clearance is easier to manage before the edit is locked. A track that seems like a small editorial choice can involve multiple rightsholders, approvals, and uses beyond the scene itself. Begin by describing what the film actually needs: a particular song, a particular recording, a new performance of a composition, music written for the film, or a track from a production-music catalog.

These routes are not interchangeable. If the creative requirement is the identity of a song, a cover may preserve the composition but change the sound and performance. If the requirement is the sound of a specific released recording, you will generally need to identify the party authorized to license that recording as well as the composition’s rightsholder. If flexibility matters more than a familiar song, commissioned or library music may provide a clearer route, subject to the written agreement’s limits.

Music route What you are seeking Rights issue to resolve
Existing song and original recording The composition and the particular commercial recording Identify the composition’s publisher or other authorized rightsholder and the recording’s owner or authorized representative.
New performance or cover The composition performed and recorded anew Clear the composition for the film; confirm permissions for making and using the new recording with the relevant parties.
Commissioned music A score or song created for the production Set ownership and permitted uses for the composition and recording in the composer agreement.
Production-library music A track offered for audiovisual licensing Check the specific license against the film’s release, promotion, term, territories, and credit obligations.

None of these options is automatically cleared simply because music is available online, was purchased, or is described as suitable for video. Read the actual agreement and verify that it covers the film’s planned uses.

Understand the two separate rights in a song and recording

The composition

The composition is the underlying musical work: the song as written, including its music and, where applicable, lyrics. The U.S. Copyright Office explains that a song and a recording of that song can be separate protected works with different owners. A film that uses a composition ordinarily needs synchronization permission—permission to pair the composition with audiovisual images. BMI says that it does not issue synchronization licenses; the producer usually requests that license from the song’s publisher.

The sound recording

The sound recording is a particular recorded performance. If you want a specific released recording, identify its owner or authorized representative in addition to the composition’s publisher. The recording may have multiple interests, and the performing artist is not necessarily the only person able to authorize its use. Ask the proposed licensor to confirm what rights and shares it controls and whether additional approvals are needed.

What a performance license does—and does not do

A performing-rights organization’s general public-performance license is not a substitute for synchronization permission to put music in a film. BMI distinguishes its performance-rights licensing from sync licensing and points producers to the publisher for synchronization permission. A cue sheet can help document music for public-performance licensing when the film is distributed, but it is not itself a sync license or proof that the relevant rights were cleared.

Choose the clearance route that matches the production

Using an existing song and its original recording

Make a rights map for both the composition and the exact recording. Find the publisher or other composition rightsholder and the recording owner or authorized representative, then confirm that each can grant the permissions your film needs. Do not assume that a familiar artist, label credit, or a single contact represents every owner or share.

Starting early is particularly important when more than one party must approve the use. If one permission is granted and another is not, the film may still be unable to use the intended recording. Keep the working edit flexible until the necessary approvals are in place, especially if the track is central to a scene.

Recording a cover or new performance

A newly recorded performance may avoid licensing the original master recording, because the production is not using that particular recording. It does not remove the need to clear the composition for synchronization in the film. Confirm with the relevant parties what permission is needed for the new recording itself and for every planned release or promotional use. A cover is a different recording, not a shortcut around composition rights.

Commissioning an original score or song

Agree on rights before the composer begins work. The agreement should make clear who will control or own the composition and the recording, and what the production may do with each. Consider the film’s distribution and promotion plans when setting scope, rather than assuming that payment for a commission alone settles ownership and use rights.

WIPO’s guide notes that a producer may be the music publisher or producer in some commissioned-music situations. That does not make the contract unnecessary: write down the ownership arrangement, permitted uses, credit expectations, and details needed for the cue sheet. Plan any registrations or documentation the parties intend to make, and make sure the production has the information required to identify the music accurately.

Licensing production-library music

A production-music catalog can be a practical sourcing route when the film does not depend on a particular commercial song. Treat each track’s license as a contract to inspect, not as a blanket promise that every film use is covered. Compare its permitted media, territories, term, promotional rights, credits, and any separate soundtrack provisions with the production’s actual plan. Catalog availability and terms vary; no particular library or universal set of terms is established here.

Identify the rightsholders and verify their authority

Start with the information attached to the music, then follow up with organizations or representatives that can help identify the relevant parties. BMI’s repertoire search can help locate publisher information. WIPO notes that collective-management organizations often hold current rightsholder data, but many focus on public-performance rights and may not grant synchronization licenses themselves. Use a database or organization as a lead, then confirm who can authorize the exact film use.

When you contact a potential licensor, ask what rights it controls, what share it can license, and whether other owners must approve the use. If there are co-writers, publishers, recording owners, labels, performers, or other required parties, identify them before relying on a partial approval. A permission from one party should not be described as clearing interests outside that party’s authority.

  • For a song, record the title and known songwriter or publisher details.
  • For a specific recording, record the artist, release, and exact version you want to use.
  • Ask the contact to state whether it represents the composition, recording, or both.
  • Ask whether it can authorize all relevant shares or whether other approvals are required.
  • Keep the contact’s written answer with the eventual agreement and production records.

Define the actual use before asking for a license

A request is more useful when it describes the scene and release plan rather than simply asking for permission to use a song “in a film.” WIPO’s Rights Clearance: A Guide for Independent Filmmakers identifies factors such as the significance of the music, the authors and performers, duration, how the music appears, territories, distribution windows, and promotional use as relevant to licensing and fees.

Before approaching a rightsholder, make an inventory of the uses you expect to need. Include the film itself and any separate uses that will accompany its release. The scope should be accurate enough for the licensor to assess and quote; do not assume that a permission for one platform or use automatically covers another.

  • Where the music appears: opening or closing theme, character theme, live performance, background use, or another scene function.
  • How much is used: the excerpt’s duration and its prominence in the scene.
  • Where and when the film may be released: territories, license term, and planned distribution windows.
  • Which media are in scope: as applicable, festivals, theatrical exhibition, broadcast, streaming, educational use, and home video.
  • Whether the music appears outside the film in trailers, advertising, social promotion, or other marketing.
  • Whether a soundtrack or separate audio-streaming release is planned.
  • Any required credit wording and cue-sheet information.

These details are not paperwork for its own sake. They help prevent a mismatch between what the production pays for and what it later needs. If the release plan changes, check the executed license before assuming the new use is allowed.

Prepare a complete license request

Send a concise request to the publisher, recording owner or representative, composer, library, or other authorized party relevant to the route you selected. Include enough information to identify the production, the music, and the intended use. A clear request can reduce avoidable follow-up and helps the other party assess the scope.

  1. Identify the production. Give the film title, production company, contact person, and a short description of the project.
  2. Identify the music precisely. Name the composition and exact recording if applicable. State whether you need the recording, the composition only, lyrics, or a new performance.
  3. Describe the scene. Explain the scene’s context and use type, such as a theme, live performance, or background music.
  4. Specify the excerpt. State the expected duration and how prominently the music will be heard or presented.
  5. List distribution plans. Name the relevant territories, media, and release windows, including festivals, theatrical, broadcast, streaming, educational, or home-video plans where applicable.
  6. Include promotion and term. State the requested license term and whether trailers, advertising, social promotion, or other marketing will use the music.
  7. Disclose soundtrack plans. Say whether the music may be included in a soundtrack or released through separate audio-streaming services.
  8. Ask about deliverables. Confirm credit language, cue-sheet requirements, required approvals, and any information the licensor needs from production.

There is no dependable universal price for independent-film music clearance. The fee depends on the music and the scope being requested, among other factors. Ask for a quote based on the actual use rather than relying on a generic per-song figure or assuming that a low-budget production has a standard rate.

Compare offers and put the agreement in writing

When you receive an offer, compare the terms that determine whether it solves the production’s needs. A lower fee is not necessarily the better fit if the permitted media, territory, term, promotion, or rights covered are too narrow. Confirm what the offer does and does not include, and make sure all required rights holders or shares are accounted for.

Term to check Question for the production
Rights covered Does the agreement cover the composition, the recording, or both, and what shares can the licensor authorize?
Permitted media and distribution Does it cover the planned release channels and windows?
Territory and term Do the geographic scope and duration match the release plan?
Type and duration of use Does permission cover the described scene, excerpt length, and prominence?
Promotional use Are trailers, advertising, social promotion, and other out-of-context uses included?
Soundtrack rights Is a separate soundtrack or audio-streaming release allowed, or does it require additional terms?
Fee, credit, and obligations Is the fee clear, is the credit wording specified, and are cue-sheet or approval requirements stated?

Get the deal in writing and retain the executed agreement and related correspondence. The written license should make the granted rights and any limits understandable to the production team that will later deliver the film. WIPO’s guide advises documenting the license and notes that it may specify credit and require details to appear in the cue sheet. If a term is unclear or the rights are disputed or unusually complex, seek advice from a qualified professional familiar with the law and territories involved.

Track music and prepare the cue sheet as you work

A cue sheet records the music used in a production. It serves as a reference for public-performance-right licensing when the film is distributed, and some distributors, including broadcasters, request one. It is not a substitute for negotiating and documenting synchronization or recording permissions.

WIPO’s guide describes common cue-sheet information: production identification; music title; duration; manner of use; songwriters, composers, publishers, and their shares; and production-company contact details. BMI also describes cue sheets as documenting music written specifically for film, television, or other audiovisual work.

  1. Open a music log during editing. Track each cue as it enters the cut rather than waiting until delivery.
  2. Record the scene and use. Note where the music appears, how it is used, and the excerpt duration.
  3. Capture authorship and publisher data. Add songwriter, composer, publisher, and share information as it is confirmed.
  4. Connect cues to permissions. Keep the relevant license, credit wording, and any limits alongside the cue entry.
  5. Reconcile at picture lock and delivery. Check the log against the final film and the distributor’s delivery requirements.

Maintaining the record as production proceeds is more reliable than rebuilding it from memory at delivery. If a cue is replaced or shortened in the edit, update the music log and verify that the final use still matches the permission.

Common clearance mistakes to avoid

  • Clearing only one layer. Permission for a composition does not necessarily cover a particular recording, and permission for a recording does not establish that the composition is cleared.
  • Treating a cover as fully cleared. A new performance may avoid the original recording but still needs composition synchronization permission.
  • Relying on a performance license. A general public-performance license does not replace film synchronization permission.
  • Assuming a purchase grants film rights. Buying a recording or soundtrack does not by itself grant permission to synchronize the music with a film or use a master recording.
  • Describing the request too narrowly. Leaving out trailers, other promotion, new platforms, territories, or a soundtrack can create a later gap between the license and the actual release.
  • Assuming one contact controls everything. Verify the licensor’s authority and any additional owners or shares that require approval.
  • Leaving documentation until delivery. Keep signed licenses, correspondence, credits, and cue-sheet details organized while the film is being made.

Apply the workflow across release territories

The composition-and-recording distinction and the practical need to match permissions to actual uses are useful planning principles, but the legal framework and licensing arrangements are not identical in every country. The U.S. Copyright Office and BMI describe U.S.-oriented copyright and licensing concepts; do not treat those descriptions as a complete statement of law elsewhere.

For a film produced in one country and released in others, identify the territories in the request and ask the licensor what rights it can grant in each. Confirm local requirements for production and distribution, including any public-performance arrangements that apply at exhibition. A distributor’s cue-sheet request helps document music use, but it does not answer whether the production has secured all permissions required for its particular release.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

As a practical decision point, do not lock a track into the final cut until the permissions, scope, and obligations are clear enough for the production’s release plan. Where a rightsholder cannot grant the needed scope or approvals cannot be obtained, choose another route—such as a new performance, commissioned music, or a properly scoped library track—and clear that alternative on its own terms.
