Do not assume a music license covers a continuous YouTube livestream just because it permits online video, background music, downloads, or a standard upload. Check the written grant for YouTube livestreaming, repeated or 24/7 playback, the relevant rights, territories, monetization, and any saved replay. Then confirm with the rights owner whether your channel must be allowlisted in YouTube Content ID. A license can grant permission while YouTube’s separate systems still interrupt the stream.
Start by identifying exactly what the license covers
This checklist can help you assess an agreement, but it cannot determine whether an unseen contract clears a particular stream. The answer depends on the wording, the track and recording, the rights controlled by the licensor, your territories, and whether you will keep an archive. For a disputed or high-stakes commercial stream, get a written answer from the rights grantor or qualified counsel in the relevant territories.
Identify the track, recording, and licensor
Record the exact track title and version, the sound recording or master owner, the songwriter or publisher information if available, and the identity of the company or person offering the license. Ask whether the licensor controls—or is authorized to grant—all rights your planned use needs. YouTube distinguishes rights in a recording from rights in its underlying composition; they may be managed by different parties. Permission from one rights holder may not settle every right.
Read the operative grant, not just the sales description
Search the agreement and any terms it incorporates for wording such as “livestream,” “live stream,” “live broadcast,” “real-time,” “continuous,” “online video,” or “background.” These phrases do not have universal meanings. Read the definitions, permitted-use clauses, exclusions, and any restrictions on platforms or distribution. A marketing page or a general reference to online use is not a substitute for an express grant that covers your actual YouTube livestream.

Check whether the grant includes continuous or repeated playback
Describe the stream accurately to the licensor. A single live event is not necessarily permission for a recurring broadcast or an always-on channel. Confirm whether the license allows the specific schedule and pattern you intend, including repeated playback or looping.
- Maximum duration for each broadcast and the total license term.
- How often you may broadcast, whether tracks may repeat, and whether looping is permitted.
- Any limits on the number of channels, concurrent streams, audience size, or scheduled downtime.
- Whether permission continues if the subscription or license expires or is cancelled.
If you plan a 24/7 stream, ask the licensor to confirm that duration and repetition in writing. Do not infer continuous-use permission from terms that only describe a single event or one finished video. The applicable agreement must establish the scope; there is no universal permission for continuous streams.

Confirm the rights, territory, and commercial context
Check both the recording and the composition
Ask which rights the license covers. Depending on the music and use, you may need permission relating to the sound recording and to the underlying composition, including applicable public-performance rights. YouTube explains that master-use and composition rights can involve different rights holders. A local venue or business music license should not be assumed to clear an online audiovisual stream.
Match the license to where the stream can be viewed
Look for the permitted territories and any requirements to restrict access by country. Rights and available permissions can vary by territory and track. UK government guidance about TheMusicLicence, for example, concerns covered public music uses in the UK; it does not establish that a YouTube stream is cleared worldwide, and other rights bodies may be relevant.

Check monetization and other commercial uses
Verify whether the grant permits the actual context of your channel, including advertising revenue, sponsorships, donations, or business use. Check for channel-size limits or other eligibility conditions, and ask whether they apply to the channel or to each broadcast. Do not assume that permission for a noncommercial stream also permits monetization.
Treat a saved replay as a separate permission question
If YouTube will retain the livestream as a replay, confirm that the license covers more than the live performance. Ask whether it permits recording or fixing the performance, incorporating the music into audiovisual content, and making that recording available on demand for the intended period. A live-use grant may not include those uses.

ISM’s September 2023 performer guidance distinguishes live performance from making copyrighted material available on demand and notes that permissions may be needed from multiple sources. Reed Smith’s U.S.-focused guide from April 2020 also distinguishes live use from replay, but it predates current platform policies and is not current legal advice. Apply the actual agreement and current rules in the territories that matter to you.

Before going live, ask whether your exact YouTube channel must be added to the rights owner’s Content ID allowlist, and request written confirmation when that is done. YouTube says live streams are scanned for third-party matches and may be interrupted or terminated. Its guidance warns that even a licensed stream may be interrupted if the channel is not allowlisted by the content owner. If you archive the stream, YouTube says Content ID claims may be made after the stream ends.

Permission and platform handling are separate checks: a license does not itself confirm that Content ID will recognize your authorization. YouTube Creator Music also has a specific limitation: its tracks available for licensing or revenue sharing are for long-form videos, not livestreams. Do not treat a Creator Music license as permission to use those tracks in a live broadcast.
Keep a file proving what was authorized
YouTube’s livestream terms place responsibility on creators to have the necessary rights for their live content. Keep the documents and correspondence that establish the scope of your permission:
- The signed license and the version of any incorporated terms that applied when you obtained it.
- Track title, recording version, rights-holder details, territory, and license term.
- Written confirmation that continuous or repeated livestreaming, the planned monetization, and any replay are covered.
- Invoices or receipts, if applicable, and confirmation of Content ID allowlisting.
Compare licenses by their written grants
When considering more than one genuine licensing option, compare the actual terms rather than relying on labels such as “royalty-free.” Check each of these points before choosing:
- Use type: one live event, recurring broadcasts, continuous streaming, standard video, or archived replay.
- Rights and repertoire: recording/master, composition, public performance, and who can grant each right.
- Territory: countries covered and any geo-blocking requirements.
- Commercial context: monetization, sponsorships, donations, business use, and channel limits.
- Term and repetition: license duration, session length, number of streams, looping, and what happens on cancellation.
- YouTube operations: platform-specific permission, Content ID claim handling, and channel allowlisting.
A provider is not suitable for your use unless its current written terms address these points. A “royalty-free” label or consumer music purchase alone does not establish permission for continuous livestreaming.
