Sweets dies at the end of the Season 10 premiere, “The Conspiracy in the Corpse,” after he is attacked in a parking garage while caught up in the conspiracy surrounding Booth. The next episode reveals that Kenneth Emory killed him. Behind the scenes, the decision followed actor John Francis Daley’s four-month absence to direct Vacation; executive producer Stephen Nathan said the producers chose a permanent, emotionally significant exit rather than an uncertain return during the season.

Why did the show kill Sweets off?
The immediate production problem was Daley’s directing schedule. He asked for four months away from Bones to direct Vacation, and the film’s schedule overlapped with the start of the show’s tenth season. Daley said he would have preferred to finish the film and return to the series. “One hundred percent. I knew it would be tough, because I was asking for four months off,” he told TVLine.
Nathan said the producers did not initially intend to kill Sweets. But, as he explained to TV Guide, they thought having the character “come and go” would disrupt the storytelling. Instead, the writers made his death permanent. (TV Guide’s interview with Stephen Nathan; TVLine’s interview with John Francis Daley)

How Sweets’ death fit the conspiracy storyline
The scheduling issue explains the production choice; the conspiracy plot explains the character’s fate within the story. Nathan told TVLine that the writers saw a way to connect Sweets’ death to Booth’s imprisonment and give the season’s opening episodes emotional weight: “And then we realized that this fit in very well with the conspiracy arc [that landed Booth in jail]. It gives us something very rich and very emotional to play within the first half of the season.”
Daley recalled that Nathan believed viewers would find a dramatic resolution more satisfying than leaving Sweets’ future uncertain and bringing him back midway through the season. That was the production’s judgment, not Daley’s stated preference: he said he hoped to return after directing the film.
