1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsThe decisive difference is location: a refugee has crossed an internationally recognized international border and needs protection outside their country, while an internally displaced person (IDP) has been forced from home but remains inside their own country. That single fact changes which legal framework applies, which authority is primarily responsible, and how a person seeks protection. It does not determine the seriousness of need. Both refugees and IDPs may require immediate safety, shelter, food, water, health care, income, documentation, family support and protection from abuse.
Neither label guarantees a standard package of benefits. Eligibility and delivery depend on national law, the place where a person is located, individual circumstances and the capacity of the response. The sections below explain the distinction, the rights and assistance frameworks, and the practical steps for finding current help.
What is the difference between an IDP and a refugee?
| Question | Refugee | Internally displaced person (IDP) |
|---|---|---|
| Has the person crossed an international border? | Yes. The person is outside their country of nationality or, where relevant, former habitual residence. | No. The person remains within the internationally recognized borders of their own country. |
| Core protection framework | The 1951 Refugee Convention and its 1967 Protocol, together with applicable regional and national rules. | The United Nations Guiding Principles on Internal Displacement and the person’s domestic legal and human-rights protections. The Guiding Principles describe a situation rather than creating one universal international legal status. |
| Primary responsible authority | States normally receive and decide asylum claims. UNHCR determines refugee status in some places where national procedures are absent or inadequate. | The person’s own national authorities have primary responsibility to prevent arbitrary displacement, protect IDPs and support durable solutions, although governments may need help from UNHCR and other partners. |
| Typical protection or assistance examples | Protection against refoulement, permission to remain while a claim is handled under applicable law, humane treatment, and possible access to housing, work, education, health care and family-related rights. | Protection as a citizen or habitual resident, plus possible humanitarian help such as shelter, camp management, food, clean water, health care, protection-risk response and assistance accessing local services or income. |
| Where to verify eligibility | The relevant national asylum or immigration authority and the current UNHCR country Help information. | National and local authorities responsible for displacement response, together with current UNHCR or partner information for the affected location. |
The same service name does not mean the same eligibility or delivery in every country. A person should verify the current rules where they are, rather than relying on a global list of benefits.
How refugee status is defined
Under the Convention framework, a refugee is outside their country and cannot or will not return because of a well-founded fear of persecution. The Convention lists persecution for reasons of race, religion, nationality, membership of a particular social group or political opinion. A person who has crossed a border is therefore not automatically a Convention refugee; the legal test and any applicable procedure still matter.

Regional instruments and national laws may provide protection in additional circumstances. Some systems also offer complementary or subsidiary forms of protection when a person does not meet the Convention definition but would face serious harm if returned. The governing country’s law determines which route is available and what evidence or interview process is required.
Asylum and refugee status are not identical terms
A person can seek asylum before a government has decided whether they meet the refugee definition. During that process, the person is an asylum-seeker. If the claim is recognized, the person becomes a refugee under the applicable legal framework. Procedures, appeal rights, documents and permission to work differ by country.
Who decides a refugee claim?
States generally have primary responsibility for registering and deciding asylum applications. In settings where national procedures do not exist or do not function adequately, UNHCR may conduct refugee status determination. That role is context-specific; UNHCR is not the sole asylum decision-maker worldwide.

“Persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized state border.”
This definition covers displacement caused by conflict, generalized violence, human-rights violations, earthquakes, floods, storms, industrial accidents and other natural or human-made disasters. It is descriptive and does not create a distinct, universally applied legal status comparable to refugee status. An IDP remains entitled to the rights and guarantees of a citizen or other habitual resident under national and international law.
Primary responsibility rests with the State
UNHCR states: “National authorities have the primary responsibility to prevent arbitrary displacement, protect IDPs and support durable solutions for them.” That responsibility includes preventing unlawful displacement where possible, protecting people during flight and displacement, and helping them reach a safe, voluntary and sustainable solution. A government may be unable or unwilling to meet every need, however. UNHCR and humanitarian partners can then provide protection and assistance, subject to access, funding and the response established in that location.
Why the border distinction matters in practice
Crossing an international border changes the legal relationship between the displaced person and the State they left. A refugee needs protection from a country of asylum and may invoke the principle of non-refoulement: a person should not be returned to a place where they face the relevant danger, subject to the detailed rules and exceptions in applicable law. An IDP has not entered another State’s protection system. Their own government remains responsible, even when that government caused the displacement or cannot control the area where the person lived.

The distinction also affects registration, documentation, movement, assistance coordination and durable solutions. It does not create a ranking of suffering. An IDP facing bombardment may need more urgent help than a refugee in temporary accommodation, and a refugee may face detention, family separation or homelessness. Legal category and humanitarian need must be assessed separately.
What support can refugees access?
The Convention overview describes minimum standards that can include humane treatment, housing, employment and education. Depending on the country and the person’s legal stage, refugee protection may also involve permission to remain, access to health services, family-related rights and protection from forced return. These are frameworks and minimum standards, not a promise that every refugee will receive a particular apartment, cash payment, work permit or medical package.
During an asylum procedure
People normally begin with the responsible national asylum authority, following the registration deadline, appointment system and identification requirements in that country. They should ask what document proves registration, whether movement is restricted, how to request an interpreter, how to report urgent protection concerns and how to appeal a refusal. Where national procedures are unavailable or inadequate, the local UNHCR office may explain whether it conducts status determination or refers people to the competent authority.
After recognition
Recognized refugees should obtain the document issued by the competent authority and check its validity, renewal process, travel limits and work or study conditions. The document may be needed to access housing, education, health care, employment or family-reunification procedures. The exact entitlement, fees and waiting times are country-specific, and services can depend on capacity as well as legal eligibility.

Urgent needs
Someone seeking asylum can still have immediate humanitarian needs before a decision. Protection actors may help with emergency shelter, safety planning, health referrals, food or water, and risks such as violence, exploitation or family separation. Asking for humanitarian help does not itself decide the legal merits of an asylum claim; the two processes address different questions.
What support can internally displaced people access?
IDPs retain the rights of citizens and habitual residents. In practical terms, assistance may include life-saving supplies, safe shelter, camp or site management, food, clean water, health care, protection against violence and exploitation, and help reaching local services or income opportunities. The available response may be delivered through government agencies, UNHCR or other humanitarian partners.
Finding the responsible service
Start with the national or local authority responsible for the displacement emergency, civil registration or social protection in the area where the person is staying. Ask which office registers displaced households, what identification is accepted, whether assistance is tied to a particular site or district, and how to report missing relatives or protection threats. Current UNHCR country information can identify partner services when government capacity is limited.
Why an IDP may receive different help from a neighbour
Programmes often target specific risks, locations or household circumstances. A family in an informal settlement may qualify for shelter support while an IDP household living with relatives receives a referral to health or income services. Eligibility can change as a person moves, returns, integrates locally or becomes able to meet needs independently. The absence of a cash grant or camp placement does not mean an IDP has lost their legal rights.

How displacement status can change
Displacement is not a permanent label. An IDP who crosses an international border to seek safety may become a refugee or another form of person in need of international protection, depending on the legal test in the receiving country. Conversely, a refugee who returns to their country but cannot go back to their home area may be internally displaced there. A person can also stop being displaced after a safe and sustainable return, local integration or relocation, although legal documents and assistance may continue during transition.
Durable solutions for refugees
Commonly discussed solutions are voluntary return in safety and dignity, local integration in the country of asylum, or resettlement to a third country. None is automatic. Conditions in the place of origin, consent, legal status, family unity and available programmes all matter.
Durable solutions for IDPs
For IDPs, solutions generally involve safe and voluntary return, sustainable local integration or settlement elsewhere within the country. A move is not durable merely because a person leaves a camp or receives transport. Safety, access to housing and services, documentation, livelihoods and protection from discrimination must be considered.
Global scale of internal displacement
UNHCR reported 72.1 million internally displaced people worldwide at the end of June 2024. IDPs represented 59 percent of the world’s forcibly displaced population at that point. These figures are specifically dated to June 2024; they are not a 2026 total, and country-level counts can change rapidly as new displacement, returns and improved registration alter the picture.

Common mistakes to avoid
- “Everyone who crosses a border is a refugee.” Cross-border movement is essential to the basic distinction, but Convention refugee status requires the applicable persecution test. Regional or national complementary protection may apply instead.
- “IDPs left their country.” By definition, they have not crossed an internationally recognized state border.
- “Refugees automatically receive a fixed benefit package.” Rights and services depend on national law, legal stage, location, personal circumstances and available capacity.
- “UNHCR decides every asylum claim.” States normally decide; UNHCR handles determinations only in some settings.
- “Humanitarian need proves legal status.” A person may urgently need food, shelter or medical care even while their refugee or displacement status is being assessed.
A practical checklist for someone seeking help
- Identify the location and border fact. Record whether the person is inside their country or has crossed an international border, and keep any identity, travel or registration documents safe.
- Contact the primary authority. For a refugee or asylum-seeker, ask the national asylum authority or current UNHCR country Help service. For an IDP, contact the responsible national or local displacement authority and check UNHCR or partner guidance.
- State urgent risks first. Mention immediate danger, serious illness, disability, pregnancy, unaccompanied children, family separation, trafficking or lack of shelter so that protection referrals can be prioritized.
- Ask for the next documented step. Confirm the appointment date, case or household number, required documents, appeal deadline and the office responsible for changes of address.
- Recheck locally. Rules, registration sites and available services can change. Verify current instructions in the country and locality where the person is actually staying.
The practical rule
Use the border question to identify the starting framework, then ask which authority is responsible today and what the person’s immediate risks are. Refugee protection is generally sought from a country outside the person’s own; IDP protection remains primarily a responsibility of the person’s State. In both situations, the reliable route to assistance is current, location-specific information rather than assumptions about a universal benefit list.
