Elizabeth Holmes’ Prison Sentence and Release: What to Know

Elizabeth Holmes was sentenced to 135 months (11 years and three months) in federal prison, followed by three years of supervised release. She was ordered to surrender on April 27, 2023. A September 2026 ABC News report says a Department of Justice victim-notification update schedules her move to a community correction center in August 2027 and lists February 22, 2030 as her projected full-release date. Those later dates are reported projections, not guarantees or direct confirmation from the Bureau of Prisons.

The short answer

Holmes’ sentence stems from her conviction for defrauding investors in Theranos, the blood-testing company she founded. On November 18, 2022, a federal judge imposed 135 months in prison and three years of supervised release. The sentence did not begin with the sentencing announcement alone: the court set April 27, 2023, as her surrender date.

Her appeal did not erase the conviction or sentence. On February 24, 2025, the U.S. Court of Appeals for the Ninth Circuit affirmed the judgment; Associated Press reporting says the court also upheld the restitution order. In March 2026, ABC News reported that U.S. District Judge Edward Davila granted a sentence reduction. The report did not publish the order itself, so the precise legal basis and calculation for that reduction should not be assumed.

The most recent publicly reported schedule is different from the original 2022 sentence. ABC News said a DOJ Victim Notification System update scheduled Holmes for placement in a community correction center in August 2027 and gave February 22, 2030 as a projected full-release date. A community correction center is a custody transition, commonly called a halfway house; it is not the same thing as completing the prison sentence. The Bureau of Prisons told ABC that it “does not discuss the conditions of confinement for any individual, including release plans,” so the 2027 and 2030 dates should be treated as reported, changeable projections.

What sentence did Elizabeth Holmes receive?

Prison term

The sentence announced by the U.S. Attorney’s Office for the Northern District of California was 135 months in federal prison. That equals 11 years and three months when expressed in years and months. The announcement and case materials are available from the U.S. Attorney’s Office case page.

Supervised release

After imprisonment, Holmes was also ordered to serve three years of supervised release. Supervised release is a separate period that begins after a person leaves prison and is administered in the community under conditions set by the federal court. It should not be added to the 135-month prison term as though it were additional prison time; it follows custody.

Restitution

Holmes and former Theranos executive Ramesh “Sunny” Balwani were ordered to pay $452 million in restitution jointly and severally, according to Ninth Circuit and Associated Press coverage. “Jointly and severally” means the victims’ total award can be collected from either defendant or both, subject to the court’s restitution order; it does not establish how much Holmes personally has paid. The federal restitution order is available through GovInfo.

Elizabeth Holmes’ sentence and release timeline

Date Event What it means
November 18, 2022 Sentenced to 135 months in prison and three years of supervised release The original judgment set the custodial term and post-prison supervision.
April 27, 2023 Ordered surrender date The date the court required Holmes to report to begin serving the sentence.
February 24, 2025 Ninth Circuit affirmed the conviction and sentence The appellate court left the judgment in place; AP also reported that restitution was affirmed.
March 2026 Sentence reduction reported by ABC News Judge Edward Davila reportedly reduced the sentence. The underlying order and exact calculation were not included in the cited report.
August 2027 Reported community correction center placement ABC said a DOJ Victim Notification System update scheduled this custody transition.
February 22, 2030 Reported projected full release ABC listed this as the projected date for completion of the custodial portion, subject to change.

The Ninth Circuit government brief filed in August 2023 listed December 19, 2032 as the then-projected date. That figure is historical, not the current projection reported in 2026. The difference illustrates why release dates can change as sentence calculations, credits, court orders or placement decisions are updated.

When did Holmes actually go to prison?

The court ordered Holmes to surrender on April 27, 2023. That is the custody-start date specified in the federal case announcement, rather than the November 2022 sentencing date. A sentencing date records the judgment; a surrender date identifies when the defendant must report to begin serving it.

Federal custody dates can be displayed differently in court filings, Bureau of Prisons records and victim-notification systems. For that reason, a date appearing in an older filing should not automatically replace a later reported projection. The 2032 date in the 2023 appellate brief is an example of a snapshot that was superseded by later reporting.

Did Elizabeth Holmes win her appeal?

No. On February 24, 2025, the Ninth Circuit affirmed her conviction and sentence. AP reported that the appellate court also upheld the restitution order. The published Ninth Circuit opinion is available via GovInfo, and AP’s report is at Associated Press.

An affirmed appeal means the judgment survived the issues presented to that appellate court. It does not mean that no later administrative or judicial event can alter a projected release date. The reported March 2026 reduction is a separate later development, and its precise legal mechanism should be taken from the district court’s order rather than inferred from news summaries.

Is Elizabeth Holmes going to a halfway house?

What the reported placement means

Yes, in the limited sense that ABC News reported a scheduled move to a community correction center in August 2027. Community correction centers are residential facilities used during a transition from secure imprisonment to release in the community. Residents generally remain subject to federal custody and facility rules while receiving structured support for work, housing and reentry, although the exact conditions vary and were not publicly detailed for Holmes.

Why it is not the same as release

Moving to a halfway house does not mean the sentence is finished. It changes the setting and degree of confinement. The projected full-release date reported by ABC is February 22, 2030, more than two years after the planned August 2027 placement. The two milestones answer different questions:

  • Community correction center placement: a reported transition within the custodial period.
  • Full release: the reported projected end of the prison-custody portion.
  • Supervised release: the separate three-year period ordered to follow imprisonment.

Because the Bureau of Prisons declined to discuss individual release plans, no public source in this record confirms the precise conditions, facility or day-by-day schedule of the proposed placement.

When will Elizabeth Holmes be released?

Projected full-release date

ABC News reported February 22, 2030 as Holmes’ projected full-release date, citing government-related records and a DOJ Victim Notification System update. “Projected” is important: the date is an estimate in a records system, not a promise that cannot move. Sentence reductions, credit calculations, transfers and other administrative changes can affect a projection.

What happens after that date?

The original judgment included three years of supervised release after imprisonment. A full release from prison therefore does not necessarily end all court-ordered obligations. Supervision is a distinct post-custody phase, and the applicable conditions are those imposed in the judgment and administered by federal probation authorities.

Why older articles show 2032

Some earlier coverage or filings may show December 19, 2032. The Ninth Circuit government brief filed in August 2023 used that date as a then-current projection. It should be labeled as historical because ABC’s September 2026 reporting described a later schedule following the reported sentence reduction.

What changed in March 2026?

ABC News reported that Judge Edward Davila issued a March 2026 order reducing Holmes’ sentence. The report quoted the judge as writing: “To be clear, this sentence reduction does not diminish the enormity of Holmes’s crimes, nor does it ignore the significant negative impact her conduct has had on the community.”

The cited report does not provide the court order or explain the exact statutory basis, credits or arithmetic behind the reduction. It is therefore accurate to say that a reduction was reported, but not to assign a specific legal mechanism or calculate a new term beyond the later projected dates. Readers seeking the controlling explanation should consult the district court’s March 2026 order when available.

Why the case led to prison and restitution

Holmes’ prosecution followed the collapse of Theranos, which had promoted blood-testing technology to investors. Federal prosecutors charged that she misled investors about the company’s technology and business. The sentence, appeal and restitution proceedings concern the criminal judgment; they are separate from the many documentaries, books and dramatizations that have told the Theranos story.

The restitution award of $452 million was imposed jointly and severally on Holmes and Balwani. That figure describes the court-ordered obligation reported in the appellate coverage and restitution record. It does not show an up-to-date personal payment balance for Holmes, and no current balance is established here.

How to read the dates without confusion

  1. Start with the judgment: 135 months in prison plus three years of supervised release, imposed November 18, 2022.
  2. Identify the custody start: April 27, 2023, the surrender date set by the court.
  3. Check the appeal result: the Ninth Circuit affirmed the conviction and sentence on February 24, 2025.
  4. Separate later changes: ABC reported a March 2026 sentence reduction, but the precise legal basis requires the order.
  5. Distinguish placement from completion: August 2027 is the reported community-correction-center move, while February 22, 2030 is the reported projected full-release date.
  6. Account for supervision: three years of supervised release follows the prison term under the original judgment.

This sequence prevents the most common error: treating a halfway-house date as though it were the end of the sentence, or treating an old projected date as the current one.

What is confirmed, and what remains conditional?

Claim Status Source or qualification
135-month prison sentence Confirmed judgment U.S. Attorney’s Office announcement dated November 18, 2022.
Three years of supervised release Confirmed judgment term Included in the federal sentence announcement.
April 27, 2023 surrender Confirmed court-set date Specified in the U.S. Attorney’s Office case materials.
Appeal affirmed Confirmed appellate outcome Ninth Circuit decision dated February 24, 2025; restitution also reported affirmed.
March 2026 sentence reduction Reported development ABC News report; the cited article does not include the order’s legal analysis.
August 2027 community correction center move Reported schedule ABC’s account of a DOJ Victim Notification System update; not a guarantee.
February 22, 2030 full release Reported projection ABC report; BOP declined to discuss Holmes’ individual release plans.

Bottom line on Holmes’ prison term

Holmes received an 11-year-and-three-month federal prison sentence and three years of supervised release, surrendered on April 27, 2023, and lost her Ninth Circuit appeal in February 2025. ABC News’ September 2026 reporting places a possible community-correction-center move in August 2027 and a projected full release on February 22, 2030. Those dates describe the latest reported schedule, not an irrevocable promise, and the halfway-house move is not the end of custody.
