What Drake’s company alleged
Frozen Moments LLC filed the pre-action petition on Drake’s behalf. It alleged that UMG and Spotify participated in boosting “Not Like Us” and misleading listeners about the track’s popularity. The petition described alleged tactics including bots, pay-to-play promotion and other marketing methods. It also alleged that UMG gave Spotify preferential licensing terms in exchange for recommending the song.
Those were claims made by Drake’s company in a filing, not findings by a court. The petition sought disclosure and preservation of information in anticipation of a possible lawsuit. The available reporting and court materials do not establish that the alleged tactics occurred.
How UMG and Spotify responded
UMG rejected the claims
A UMG spokesperson told the Associated Press: “The suggestion that UMG would do anything to undermine any of its artists is offensive and untrue.” The company also said it followed the highest ethical practices in marketing and promotion. (Associated Press, Nov. 26, 2024)

Spotify disputed the alleged arrangement
In its court filing, Spotify argued that the petition was an improper use of pre-action discovery. It also denied that it and UMG had the specific arrangement alleged: reduced licensing rates in exchange for recommending “Not Like Us.” Spotify said it had no economic incentive to have listeners stream the track rather than Drake’s own music. (Pitchfork, Dec. 2024)
What happened to the petition—and what followed
| Date | Proceeding or event | What it means |
|---|---|---|
| November 2024 | Frozen Moments LLC filed a New York pre-action petition. | It sought disclosure and preservation of records and alleged manipulation of the track’s popularity. It was not a court finding on those allegations. |
| December 2024 | Spotify opposed the petition. | Spotify challenged its procedural basis and denied the alleged licensing-for-recommendations arrangement. |
| January 2025 | Drake withdrew the petition and filed a separate federal defamation suit against UMG. | The later case concerned the track’s content and its promotion, rather than adjudicating the original petition’s stream-manipulation claims. |
| October 9, 2025 | The U.S. District Court for the Southern District of New York dismissed the defamation case. | The court treated the statements at issue in the song as nonactionable opinion in the context of a rap battle. It did not decide whether streaming manipulation had occurred. |
The court’s dismissal addressed the legal question in the later defamation suit, not the truth of the earlier allegations about streams. Judge Jeannette A. Vargas wrote that “A reasonable listener could not have concluded that ‘Not Like Us’ was conveying objective facts about Drake.” (U.S. District Court opinion, Oct. 9, 2025)

What the reported stream count does—and does not—show
The October 2025 court opinion reported that “Not Like Us” had more than 1.4 billion Spotify streams globally as of April 2025, citing Drake’s amended complaint. That is a dated figure attributed to a party’s pleading. It is not a court finding about whether the streams were authentic or artificially generated. (U.S. District Court opinion, Oct. 9, 2025)
