No court ruled that a Disney+ subscription prevents someone from suing Disney. In a Florida wrongful-death case, Disney initially argued that terms linked to Jeffrey Piccolo’s Disney+ trial and later Disney account use required arbitration. Piccolo disputed that argument. Disney waived its arbitration demand in August 2024, and the case proceeded in court before being reportedly dismissed with prejudice in February 2026. Public reporting did not disclose the terms of any private resolution.
What was the lawsuit about?
Jeffrey Piccolo filed suit in Orange County, Florida, in February 2024 as representative of the estate of his wife, Kanokporn Tangsuan. The case named Walt Disney Parks and Resorts U.S., Inc., doing business as Disney Springs, and Great Irish Pubs Florida, Inc., doing business as Raglan Road.
The complaint concerned a dinner on October 5, 2023, at Raglan Road Irish Pub and Restaurant at Disney Springs. According to the complaint, Tangsuan had severe allergies to nuts and dairy, and the couple asked about allergen-free food. The complaint alleged that staff assured them the food could be prepared without those allergens and that Tangsuan later suffered a fatal allergic reaction. These are allegations in the complaint, not findings established at trial. The Associated Press reported the complaint’s allegations.
Why did Disney invoke a Disney+ subscription?
In a motion filed May 31, 2024, Walt Disney Parks and Resorts U.S., Inc. asked the court to compel arbitration and pause the court case. Disney relied on terms associated with Piccolo’s Disney+ account and his later use of a Disney account, arguing that the provisions covered the dispute. That was Disney’s position in litigation—not a court ruling that the terms applied or prevented the case from being heard in court. The motion is available in the case docket.

How did Piccolo respond, and what did Disney do?
Piccolo’s August 2, 2024, response argued that he was bringing the claim as representative of Tangsuan’s estate, which had not agreed to the terms Disney invoked. The response also disputed that those terms covered this kind of claim. Those were arguments in the plaintiff’s filing, not judicial conclusions. The docket includes the filings.
On August 19, Disney said it would waive its right to arbitration and allow the case to proceed in court. Contemporary coverage described that as a reversal of Disney’s earlier position. The available reporting describes a waiver; it does not establish that a judge rejected Disney’s motion. The Associated Press covered Disney’s decision.

How did the case end?
Bloomberg Law reported in February 2026 that Piccolo filed a notice of voluntary dismissal with prejudice on February 27, and that his attorney described the case as resolved. Public reporting did not confirm whether the dismissal followed a settlement or disclose any terms. A dismissal with prejudice is a reported procedural outcome, not a verdict on whether the complaint’s allegations were true. Bloomberg Law reported the dismissal.

Amid the controversy, Disney Experiences chairman Josh D’Amaro said: “At Disney, we strive to put humanity above all other considerations.” That was a public statement, not an admission about the allegations in the lawsuit. The Associated Press reported the statement.
