Disney announced on September 22, 2025, that Jimmy Kimmel Live! would return to ABC the following day, five days after ABC said it was preempting the show indefinitely. The decision followed FCC Chair Brendan Carr’s public warning to broadcasters about Kimmel, prompting critics to call the suspension capitulation to government pressure. Disney gave a different explanation, and Carr later denied that federal pressure caused the suspension. The public record establishes the sequence and the competing claims—not Disney’s private motive.
Why did ABC suspend Jimmy Kimmel?
The dispute began with Kimmel’s September 15, 2025, monologue about reactions to the killing of Charlie Kirk and President Donald Trump’s public response. The Free Speech Center’s timeline records Kimmel’s “MAGA gang” remark and his criticism of Trump’s description of his own feelings.
On September 17, Carr appeared on conservative commentator Benny Johnson’s podcast and urged broadcasters to take action against Kimmel, warning of further FCC work. The Free Speech Center quotes Carr saying, “We can do this the easy way or the hard way.” ABC then announced that the show would be preempted indefinitely.
Disney later said it paused production to avoid “further inflaming a tense situation” and because it considered some of Kimmel’s comments “ill-timed and thus insensitive.” Those were Disney’s stated reasons; the timing of the announcement, soon after Carr’s warning, led critics to argue that regulatory pressure influenced the decision.

Why did Disney bring the show back?
On September 22, Disney said the show would return Tuesday, September 23, following conversations with Kimmel. The company said: “We have spent the last days having thoughtful conversations with Jimmy, and after those conversations, we reached the decision to return the show on Tuesday.”
In his September 23 return monologue, Kimmel addressed the criticism and his intent. As quoted by ABC, he said, “It was never my intention to make light of the murder of a young man,” and acknowledged that some viewers may have found his comments unclear or ill-timed. He also spoke about the importance of free expression.

Did the FCC pressure Disney or ABC?
Carr’s warning came shortly before ABC’s preemption, and critics cited that proximity as evidence of pressure. FCC Commissioner Anna Gomez called the episode “a concerning moment of direct government intervention into business decisions.” She also said, “This wasn’t simply a ‘business decision,’” according to Reuters.
Carr rejected that interpretation. Reuters quoted him on September 22 saying, “Jimmy Kimmel is in the situation that he is in because of his ratings, not because of anything that’s happened at the federal government level.” That is Carr’s account, not an independent finding about Disney’s reasoning.

In a September 24 letter, Senator Adam Schiff characterized Carr’s remarks as threats and argued broadcasters were operating under extraordinary duress. That, too, is a lawmaker’s argument—not a court or agency finding. The available accounts establish what the parties said and when; they do not settle what privately motivated Disney’s decision.
What does “capitulation to the FCC” mean here?
“Capitulation” is a critical characterization, not Disney’s description of its decision. Critics use it because Carr publicly invoked possible FCC action and ABC announced an indefinite preemption soon afterward. Disney cited its view of Kimmel’s remarks and the tense moment, while Carr denied that federal pressure played a role. Chronology makes the concern understandable, but by itself it does not prove the company’s motive.

The legal context also requires care. The Free Speech Center’s timeline reproduces an FCC statement that the First Amendment and Section 326 of the Communications Act limit the Commission’s authority to censor broadcast speech. The statement also says the FCC has long held that the public interest is best served by free expression and counter-speech. Those general limits do not, on their own, determine how Carr’s conduct should be legally characterized; the sources cited here provide no judicial ruling on this episode.

No. ABC reported that Nexstar and Sinclair stations continued to preempt the show after Disney announced its return. In its September 2025 report, ABC said full episodes were available the following day on Hulu and Disney+, with clips on YouTube. That information describes the distribution ABC reported at the time; it does not establish current streaming availability or the current carriage status of every affiliate.
