A film that is genuinely in the public domain may be lawful to stream, but that does not guarantee YouTube will avoid a Content ID match, claim, or interruption. YouTube scans live streams while they run; if it detects third-party content, it may display a placeholder and warn you, then temporarily interrupt or terminate the stream if the content continues. If you archive the stream, YouTube says a Content ID claim may be made after the stream ends.
The key distinction is between having the legal right to show a film and avoiding a platform match. Public-domain status may support your right to use a particular work, but it does not switch off YouTube’s detection systems.
What can happen during and after a livestream?
YouTube says it scans all live streams for matches to third-party content, including content in another live broadcast. If it identifies a match, it may show a placeholder image and warn you to stop streaming the material. If the material remains, YouTube may temporarily interrupt or terminate the stream. For an archived livestream, Content ID claims are made after the stream is complete, if you choose to archive it. YouTube’s live-stream copyright guidance describes these separate timings.
A match is not proof that the film is still copyrighted, but a public-domain label is not proof that the exact copy is clear either. YouTube states that none of the options it describes for using content guarantees avoiding copyright issues. Its copyright tips also put the legal question in context: “Copyright isn’t decided by YouTube, it’s decided by law.”

Content ID claim, interruption, and copyright strike are different
A Content ID claim can result in a video being blocked, monetized by the claimant, or tracked. Policies can vary by country or region. A claim ordinarily affects the video rather than the channel; it is not automatically a copyright strike. A copyright removal request is a separate legal process. If YouTube receives a valid removal request, it can remove the video and issue a strike. YouTube explains Content ID claims, and its copyright-strike guidance explains removal requests and strikes.
How to check whether a film is public domain
Public domain means a work is not protected by copyright, for example because its copyright term expired or it was not eligible for protection. Copyright rules vary by country or region. YouTube gives a broad generalization that copyright commonly lasts for the author’s life plus 50 to 70 years, but that is not a reliable shortcut for clearing a particular film. YouTube’s public-domain overview cautions that rules vary by territory.

Identify the exact work, version, and territories
Record the film’s title, country of origin, publication history, and the exact version you intend to stream. Check the status in each territory relevant to your intended audience; a conclusion about one country does not establish the status worldwide. A film’s age, a label on a video-sharing site, or the fact that you own a copy is not enough on its own.
Use official records carefully
For the United States specifically, the U.S. Copyright Office says works published in the United States before January 1, 1931 are currently in the public domain because their copyright protection has expired. Do not apply that date to foreign works, works published later, or other countries. Certain foreign works that were once public domain in the United States later had protection restored under the Uruguay Round Agreements Act. The Copyright Office’s Notices of Restored Copyrights page points to official records. These rules do not establish the status of any particular film without its publication and origin details.

Check the copy’s soundtrack and added material
Clear the specific print or copy, not just the underlying story or an earlier version. A soundtrack, restoration, edit, or other addition may raise separate rights questions. Derivative works can contain original contributions, and restored copyrights may apply in some cases. That does not mean every restoration or transfer has a new copyright; it means you should verify the exact version and its provenance. U.S. Copyright Office guidance on derivative works discusses original contributions to works based on preexisting material.
Keep evidence before you go live
Save the records and reasoning that support your conclusion: identification of the film and version, publication and source-country facts, official records or other reliable rights documentation, and any separate checks for the soundtrack or added material. The status of a specific film cannot be determined without those work-specific facts.

Why a public-domain film may still receive a Content ID match
YouTube’s eligibility guidance says public-domain footage, recordings, and compositions are not eligible as Content ID reference material, and that claimants must have exclusive rights to material submitted as a reference. That standard does not guarantee that a stream containing public-domain material cannot be matched, mistakenly claimed, or interrupted. YouTube’s live scanning process still applies to the stream.
A match may also concern an element of the copy rather than the underlying film—for example, a soundtrack or version-specific addition. Check the matched segment against the exact version you are streaming before deciding how to respond.

What to do if YouTube identifies or claims the film
If the live stream is interrupted
Note the warning and any information YouTube provides, then stop or replace the identified content if needed to restore the broadcast. Review the film version and its rights documentation before trying again. A public-domain conclusion does not itself prevent a live interruption.
If an archived video receives a claim
- Open the claim in YouTube Studio and review the claimant, matched segment, and any territory-specific details.
- Compare the match with the exact film version, including its soundtrack and any restoration or added material.
- Dispute only if you have the necessary rights, believe the content was misidentified, or have another valid basis—and retain the evidence supporting that basis.
YouTube says that giving credit, owning a copy, or choosing not to monetize does not by itself justify a dispute. If a dispute lacks a valid basis, the claimant may request removal; a valid removal request can lead to a strike. YouTube’s dispute guidance describes when and how to challenge a claim.
If you have a licence rather than relying on public-domain status
For an actively licensed stream, YouTube advises asking the rights owner to add your channel to its Content ID allowlist. An allowlist request is relevant to a licence; it does not replace checking that a film is public domain.
Practical checklist before scheduling an old film
- Identify the exact film and the version you will broadcast.
- Check publication history, country of origin, and legal status in the relevant territories.
- Review official records, including possible restored rights for relevant foreign works in the United States.
- Check the soundtrack, restoration, edits, and other additions separately.
- Keep evidence of your rights conclusion and be prepared for a platform match even if your conclusion is well supported.
- Decide whether to archive the stream, knowing that an archived livestream may receive a claim after it ends.
