Before using one in a continuous YouTube stream, identify who controls the rights in the music, performance, sound recording and any video, and obtain permissions that cover the way you intend to use it. The Indian Copyright Act’s religious-ceremony exception is limited to use “in the course of any bona fide religious ceremony”; it should not be treated as a general licence for a separate, continuous channel broadcast. YouTube’s copyright checks, Content ID process and monetization review are separate issues, so permission alone does not guarantee an uninterrupted stream or monetization.
What rights can be contained in a temple recording?
“Temple recording” describes where or what was recorded, not who owns every right in it. Indian copyright law recognizes distinct protected subject matter, including musical works, cinematograph films and sound recordings. A recording may also capture a performance by singers, musicians or other performers. The Copyright Act gives sound-recording owners rights that include communicating the recording to the public, while underlying works and performers’ rights are treated separately.
Depending on the material, relevant contributors or rightsholders may include the lyricist, composer, singer, musicians, producer of the sound recording, videographer or film producer, and a broadcaster whose programme is being reused. Permission from temple management to enter, record or use temple premises does not necessarily clear those separate rights. The Copyright Office’s handbook explains common music-industry roles; for a specific clearance, use the Act and obtain advice based on the actual contracts and content.
Does the religious-ceremony exception cover a 24/7 channel stream?
Section 52(1)(za) of the Copyright Act, 1957 refers to “the performance of a literary, dramatic or musical work or the communication to the public of any work or sound recording in the course of any bona fide religious ceremony.” The Act’s explanation includes a religious ceremony and associated marriage procession and festivities.

The limiting words are “in the course of” the ceremony. They do not expressly establish a general right to make a separate recording and rebroadcast it continuously as channel programming. Whether a particular use falls within an exception depends on its facts; do not assume that a 24/7 stream is covered simply because the source material came from a religious event. If the exception’s application is disputed, consult an Indian copyright professional.
Live ceremony versus replay: what changes?

A commercially released bhajan, a recording made by the temple, a television broadcast, a previously published online video and ambient audio captured during aarti can involve different rightsholders. Identify the actual source and embedded material rather than treating all devotional audio or video as one rights category.

What YouTube requires and what can interrupt a stream
YouTube’s livestream terms put responsibility on the channel provider to have the necessary rights to exploit the live content on Google services, including applicable music rights, and to comply with regulatory and licensing requirements in the stream territory. Rights clearance is therefore a matter to resolve before going live, not something a channel can assume YouTube will arrange.
YouTube says it scans live streams for matches to third-party content, including another live broadcast. If it identifies third-party material, it may replace the stream with a placeholder, warn the creator to stop using the material, or temporarily interrupt or terminate the stream if it continues. A licence does not necessarily prevent an automated interruption: YouTube advises creators with licensed third-party content to ask the owner to add the channel to its Content ID allowlist. Archived streams may also receive Content ID claims after the live broadcast ends.

These are distinct outcomes: permission concerns what the channel is authorized to use; allowlisting concerns whether a rightsholder has configured Content ID for the channel; and YouTube’s enforcement systems can still affect a stream or its archive. None of these steps guarantees uninterrupted transmission.
Clear a recording before scheduling it
- Inventory the material. For every segment, note whether it is live temple ambience, a devotional performance, a commercially released recording, a broadcast, or a previously published online video. Identify the music, lyrics, performers and any video or broadcast material it contains.
- Identify the rightsholders. Establish who controls each relevant right in the underlying work, performance, sound recording and video. Do not assume that the temple, the person who uploaded a file or the person who made the recording controls all of them.
- Get written permission for the actual use. Confirm that permission covers YouTube live transmission, the intended territory and duration, monetization if planned, and any recording, replay or archive. Clarify any limits or conditions and retain the written terms.
- Ask about Content ID allowlisting. Where a rightsholder uses Content ID, ask them to allowlist the exact YouTube channel and keep their confirmation. A licence and an allowlist are not the same thing.
- Run an operational check. A private or unlisted test can help identify technical problems and visible restrictions in YouTube Studio. It is not proof that the material is cleared, immunity from claims, or a guarantee that a later public stream will remain uninterrupted.
- Plan the archive separately. If you need a replay, decide how it will be recorded and stored, and make sure the relevant permissions cover that use too.
Copyright clearance does not settle monetization
YouTube reviews monetization eligibility separately from copyright enforcement. Its monetization policies call for original and authentic content, and the reused-content rule is separate from whether a creator has permission or receives a copyright claim. Reviewers may assess the channel as a whole; highly repetitive or mass-produced content can be ineligible. A 24/7 relay of recordings with little original contribution can therefore raise a channel-level monetization question even if the creator has permission to stream the material. That is a policy risk, not a prediction of the result for a particular channel.

Eligible monetized channels may enable ads and fan-funding features on live streams, but YouTube does not guarantee that ad slots will serve ads. Do not treat a licence, an uninterrupted stream or the presence of ads as a promise of revenue.

YouTube’s help guidance says it can automatically archive a live stream if it is less than 12 hours, and warns that a stream exceeding 12 hours may not be captured at all. A single nominal 24/7 broadcast should therefore not be treated as a reliably archived video. If viewers need replays, consider separate shorter sessions and/or a local recording, subject to the same rights clearances for recording and replay.
