Not automatically. Repeating a movie clip does not make it fair use—or automatically make it infringement. Under U.S. law, fair use depends on the purpose and character of the stream, the creative nature of the film, how much of it is used and how important that material is, and the effect on actual or potential markets. Replaying a scene can increase the amount of the movie communicated, but there is no seconds limit or repeat-count rule that settles the question.
What repetition changes—and what it does not
Each replay adds to the total amount of copyrighted material viewers receive. That can weigh against fair use, particularly if the repeated passage is a memorable or important part of the film, or if the stream lets viewers watch the scene as entertainment in its own right. But repetition is not a standalone legal test: context and the stream as a whole matter.
Ask what each replay contributes. Replaying a short passage to examine a detail, compare shots, or support sustained criticism is a different use from looping the scene for viewers to watch. That distinction is an application of the legal factors, not a YouTube safe harbor or a guarantee that the use is fair.
How U.S. fair use is assessed
Section 107 of the U.S. Copyright Act identifies four factors for courts to consider together. No one factor, label, or checklist guarantees the result. The U.S. Copyright Office’s Fair Use Index, which reported an update in July 2026, describes the inquiry as case-specific. Only a federal court can ultimately decide whether a particular use is fair use.

1. Purpose and character of the use
Consider whether the clips serve criticism, commentary, teaching, or another purpose that adds something distinct, and whether the use is commercial or nonprofit. Criticism and comment are statutory examples, but calling a livestream “commentary” does not decide the issue. A stronger case for a different purpose is more plausible when a clip is shown because it is needed to make a specific point and the streamer actually analyzes it, rather than presenting it as the attraction.
Monetization or another commercial aspect is relevant, but does not automatically rule out fair use.
2. Nature of the movie
Movies are highly creative works. All else equal, using expressive material such as a film is generally less favorable to fair use than using factual material.

3. Amount and substantiality
Courts look at both how much is used and whether the excerpt takes an especially important part—the work’s “heart.” A brief scene can still be qualitatively significant. A longer excerpt or repeated excerpts may increase the total use, but the reason for using them and their relationship to the commentary matter.

The Copyright Office provides no formula for a predetermined amount. Use only what is reasonably needed for the point you are making; that is a risk-reduction practice, not a legal guarantee.
4. Effect on the market
Consider whether viewers could use the stream in place of the movie, a scene, or a licensed clip, and whether widespread similar uses could harm existing or potential markets. A scene looped as watchable entertainment raises a different market question from an excerpt used to make a specific critical point. Neither scenario has an automatic outcome under this factor.

How YouTube may handle clips during and after a livestream
YouTube’s copyright systems and a court’s fair-use analysis are separate. YouTube’s published live-stream guidance, checked October 3, 2026, says streams are scanned for matches to third-party content, including another live broadcast. A detected match may lead to a placeholder replacing the live video and a warning to stop using the material. If the material remains, YouTube may interrupt or terminate the stream.
If you choose to archive the livestream, YouTube says Content ID claims on the archive are made after the live stream ends. A claim is not a court ruling that your use infringes; equally, getting no claim does not establish that the use is fair.

Licensed clips and allowlisting
If you have permission or a licence to use third-party material, check that it covers the specific platform, use, territory, and time period. YouTube advises asking the rights holder to add your channel to its Content ID allowlist. A licensed stream can still be interrupted if the channel has not been allowlisted.

Claims, takedowns, and disputes
A Content ID claim on an uploaded or archived video may block, monetize, or track it, sometimes differently by geography. A claim is different from a copyright removal request and a copyright strike. YouTube says it cannot decide whether a use qualifies as fair use or fair dealing. You may dispute a claim if you have a valid basis, including a copyright exception, but should do so only when confident you have the necessary rights; repeated or malicious misuse of the dispute process may result in penalties.
Copyright and monetization are separate questions
A stream can avoid a copyright claim and still have a monetization problem. YouTube’s reused-content policy assesses monetization separately from copyright enforcement. Its examples say that clips from a favorite show edited together with little or no narrative may not qualify for monetization. Conversely, a monetization rejection is not a court decision that the use infringes, and permission or the absence of a claim does not by itself settle eligibility under that policy.

- Get written permission or a licence. Confirm the permitted platform, territory, duration, and type of use. If the material is subject to Content ID, ask the rights holder to allowlist your channel.
- Rely on fair use only after assessing the actual stream. Consider all four factors for each work and the stream as a whole. Keep excerpts proportionate to the criticism or commentary, and make the analysis substantive. These steps can reduce risk but cannot guarantee fair use.
- Omit or replace material you cannot clear. Use footage you own or material for which you have the necessary permission or licence.
Buying a movie or using editing or streaming equipment does not give you the right to rebroadcast its clips.

This article describes U.S. fair use, not a universal copyright exception. Other countries may apply fair dealing or different exceptions, with different requirements. A U.S. fair-use argument does not establish that a stream is lawful everywhere it can be viewed.
