The Los Angeles Police Department said Heche sustained significant injuries and was transported to a local hospital. Its initial investigation included the collection of toxicology and medical evidence.

Contemporaneous reports described the Walgrove Avenue impact as the last in a series of collisions in the neighborhood. Because the publicly available material does not amount to a complete reconstruction report, details about the exact sequence, speed, and driving behavior should be treated carefully. Some widely repeated descriptions came from early news coverage or later civil pleadings rather than a definitive public accident reconstruction.

The vehicle entered the home of Lynne Mishele, a renter. Mishele and her pets survived, but the resulting fire destroyed the residence and personal property inside it. The property damage became the subject of a separate civil claim against Heche’s estate.

Heche’s injuries and death

Heche suffered extensive burns and a severe brain injury in the collision and fire. On August 11, 2022, she was declared legally brain-dead. Her family said that organ donation had long been her choice, and she remained on life support while OneLegacy evaluated whether donation was possible.

That ruling addresses the manner and medical cause of Heche’s death. It does not mean that every detail of how the collision occurred was publicly resolved, nor does it determine civil liability for the damage to Mishele’s home. Those are separate questions.

What the final toxicology showed

Early reports prompted speculation that Heche had been impaired by cocaine or another drug. The final medical examiner findings did not support a conclusion that illicit drugs or alcohol impaired her at the time of the collision.

The toxicology details matter:

  • No alcohol was found in the relevant blood testing.
  • Benzoylecgonine, an inactive metabolite of cocaine, was detected. Its presence indicated prior cocaine use, not active cocaine intoxication at the time of the crash.
  • Cannabinoids were detected in urine but not blood. The medical examiner characterized that result as consistent with prior use rather than use at the time of the injury.
  • Fentanyl was attributed to medical treatment after the crash. Its detection was not evidence that Heche had taken fentanyl before the collision.

There is an important distinction between detecting a substance and proving impairment. The final findings support the statement that there was no evidence of active alcohol or illicit-drug impairment at the time of the crash. They do not establish why Heche lost control of the vehicle. The available findings do not, by themselves, prove that a medical episode, mental-health condition, mechanical failure, or intentional act caused the collision.

What happened to the criminal investigation?

LAPD initially investigated the possibility of a felony DUI case while waiting for toxicology results and medical records. After Heche’s death, the department announced that it would make no further investigative efforts in the case.

Since Heche had died, a criminal prosecution against her could not proceed. The final toxicology results also weakened the early impairment narrative. However, it is more accurate to say that the criminal investigation was closed or discontinued than to say that Heche was “cleared of all wrongdoing.” Ending a criminal case against a deceased person does not resolve civil liability, insurance disputes, property claims, or every factual question about the crash.

Lynne Mishele’s civil claim

In November 2022, Lynne Mishele filed a civil lawsuit against Heche’s estate seeking at least $2 million. The complaint described losses related to the destruction of the home, personal possessions, and emotional distress. Reports on the filing said that Mishele and her pets were inside the residence when the vehicle entered it and the fire began.

Mishele’s lawsuit was separate from the LAPD investigation. It proceeded through the civil and estate-claims process, not through criminal court. Has the estate settled the crash-related claims?

The status of the estate’s obligations remains the least settled part of the story. In November 2025, Laffoon reportedly told the court that a tentative agreement had been reached with creditors and that court approval was required. In June 2026, Mishele disputed that she had reached a binding settlement.

The careful current description is that settlement discussions, and a claimed tentative agreement, have been reported, but the available record summarized here does not establish a final, publicly verified resolution. That means readers should not assume that Mishele has been paid, that all claims have been released, or that the estate has been closed.

The Los Angeles Superior Court’s case-access system is the appropriate place to verify a later development in the probate or civil dockets.
