AI-generated music is overwhelming parts of the music business—but the clearest evidence is about uploads, not listening. Deezer said that in July 2026 it received nearly 90,000 fully AI-generated tracks a day, topping half of daily deliveries on peak days. Yet those tracks accounted for only about 1–3% of streams on its service. The immediate crisis is a flood of material that platforms must identify and moderate, compounded by impersonation and royalty fraud—not proof that machines have replaced human musicians.
What the “AI music flood” includes
The phrase covers different practices with different creative, ethical and legal consequences. Treating them all as fraud—or as equivalent forms of authorship—obscures what is actually at stake.
- AI-assisted human music: A person writes, performs, arranges, edits or produces music with AI tools in a supporting role.
- Fully synthetic music: A model generates most or all of the lyrics, composition, vocals and instrumentation.
- Impersonation: A synthetic recording imitates a recognizable performer’s voice or identity, with or without that person’s consent.
- Spam or fraud: Tracks are generated and distributed at scale to capture attention, mislead listeners or collect royalties through fake engagement.
A human using AI transparently to develop a demo is not doing the same thing as an operator using bots to make a synthetic catalog appear popular. The tool alone does not establish whether a track is lawful, honest or fraudulent.
What the upload numbers do—and do not—show
Deezer reported nearly 90,000 fully AI-generated tracks delivered per day in July 2026, exceeding 50% of daily deliveries on peak days. It reported roughly 60,000 a day, about 39% of deliveries, in January 2026, and said it detected and tagged more than 13.4 million AI tracks on its service during 2025. These are Deezer’s own platform-specific figures, not a census of every streaming service. Deliveries are not necessarily unique songs, successful releases or evidence of listener demand. The contrast with listening is crucial: Deezer said fully AI-generated songs represented about 1–3% of streams on its service. A majority share of uploads on peak days is therefore not a majority share of music heard, either on Deezer or across the industry. The figures show a supply and moderation challenge, not that AI has broadly displaced human artists.
There are several kinds of displacement, and evidence for one does not prove the others:
- Market-volume displacement: Synthetic releases occupy upload capacity and may crowd search, playlists or discovery surfaces.
- Revenue displacement: Fake engagement can redirect money from shared royalty pools.
- Labor displacement: A company or client may substitute generated music for paid work by performers, composers, engineers or producers. The upload figures do not measure this effect.
- Cultural displacement: Listeners may have less reliable information about who made a recording and whether an artist profile is authentic.
How AI-enabled streaming fraud works
Low-cost generation makes it easier to produce a large catalog, but generating music is not itself streaming fraud. Fraud occurs when people manipulate engagement or misrepresent activity to obtain money. The U.S. Department of Justice said that Michael Smith pleaded guilty in March 2026 after using hundreds of thousands of AI-generated songs and automated accounts to produce billions of fake streams and more than $8 million in royalties. Prosecutors described a scheme that used thousands of bot accounts; the case is evidence of a particular criminal operation, not proof that AI tracks generally are fraudulent. The DOJ describes royalties as distributed proportionately from pools to songwriters, performers and other rights holders. AI can reduce the cost of making the tracks; automated playback can fabricate the engagement. Platforms may detect and remove suspicious streams, but enforcement can come after the activity has already burdened their systems and affected royalty calculations.

Deezer reported that up to 85% of streams of fully AI-generated tracks on its service were fraudulent in 2025. That figure describes streams of detected AI tracks in Deezer’s reporting—not 85% of all AI songs, all AI streams worldwide or all AI music users. Where the law is unsettled—and where it is clearer
“Is AI music legal?” has no single answer. Training data, the resulting composition or recording, a performer’s identity, copyright ownership and stream manipulation raise separate questions. A dispute about one does not decide the others.
Training on copyrighted recordings
Major recording companies have sued Suno and Udio, alleging that copyrighted sound recordings were used without permission to train their models. Both companies have raised fair-use arguments, according to a 2026 law-review analysis. These disputes are not a final ruling that training is either lawful or unlawful. The outcome may depend on what was copied or processed, how a model was trained, what it produces and the relevant market effects. Copyright in the finished track
The U.S. Copyright Office’s January 29, 2025 report takes a human-authorship approach. AI assistance does not automatically rule out copyright: human-authored lyrics or music may be protected, and a sufficiently creative human arrangement, selection or modification can matter. But merely prompting a model is generally not enough to establish authorship of the expressive material the model determines. Purely machine-determined material may not qualify for copyright protection. A mixed work may therefore contain protectable human contributions without giving its creator exclusive rights over every generated element. Voice, identity and misleading presentation
A voice imitation is not automatically a copyright claim. It may instead raise questions involving publicity or digital-replica laws, false endorsement, consumer confusion, unfair competition or contracts; copying lyrics, a melody or a recording can raise copyright issues as well. There is no general copyright in an artist’s style, and style, voice, name, likeness and a specific recording should not be treated as interchangeable.
Presentation matters too. A synthetic performer presented as a real person, or a release placed on an established musician’s profile, can mislead listeners even when a separate copyright claim is uncertain. Fraud is different from uncertain copyright
Copyright questions about training or authorship do not excuse fake streams. In the Smith case, the criminal conduct described by prosecutors was automated manipulation and deception to obtain royalties. Conversely, a track’s synthetic origin alone does not show that it infringes someone’s rights or that its streams are fake.

Why artists may use AI while opposing its abuses
AI can help a solo musician produce a demo, explore an arrangement, separate stems or clean up audio without replacing the human performance or writing. It can lower barriers for creators with limited budgets or particular accessibility needs. The same technologies can also make it easier to imitate a singer, generate catalogs at scale or substitute for paid creative labor. An ethical judgment depends on consent, disclosure, control and use—not simply on whether AI appears in the workflow.

Before using a tool for a commercial release, check the specific terms and keep a record of the creative work you contribute:
- Find out what the vendor says about training data, and whether it identifies licensed sources.
- Check whether commercial-use permission applies to the plan you used and to tracks created during that subscription. Such permission is a contractual grant, not a government guarantee of copyright ownership or freedom from third-party claims.
- Read what the vendor promises about ownership, licenses, indemnity and changes to terms; do not assume that “commercial use” means every element is cleared.
- Confirm that you own or have permission to upload source audio, including vocals used for tuning, remixing or personalization.
- Do not clone or imitate a recognizable performer’s voice without authorization; check applicable law and your distributor’s rules.
- Keep project files, stems and notes that show human-written lyrics, performances, arrangement, editing and production decisions. These can help document your contribution, though they do not settle a legal dispute by themselves.
- Check platform disclosure requirements and make material AI involvement clear where required or appropriate.
- Consider what happens if a vendor changes its policy or a court later limits the service’s rights or outputs.
Edge cases matter. A human-written song with AI instrumentation, a human vocal over generated accompaniment, and a heavily edited AI draft can involve different contributions. A cloned voice may raise identity concerns even if no melody is copied; an honestly labeled synthetic track is different from one falsely attributed to a real artist. Copyright may protect some human-made parts of a work without covering all of it.

Deezer: tag, limit exposure and withhold fraudulent streams
Deezer says it detects and tags AI-generated music, removes detected AI tracks from algorithmic recommendations and editorial playlists, and excludes fraudulent streams from royalty payments. It also says it licenses its detection technology to industry participants. These are Deezer’s stated policies, not independently verified proof that every synthetic track is found or that detection establishes infringement, consent or authorship. Spotify says it does not treat music differently solely because of the tools used to make it. At the same time, it says it is investing in protection against releases delivered to the wrong artist profile, faster content-mismatch reviews, artist reporting tools and unauthorized voice cloning. That is a different emphasis from Deezer’s stated policy of excluding detected fully synthetic tracks from recommendations: Spotify foregrounds artist identity and misuse. Detection can produce false positives, such as unusual processing being mistaken for synthesis, and false negatives, particularly when synthetic material is edited or blended with human performances. A tag cannot establish which model made a track, whether the uploader had permission or whether the output infringes. Profile checks, disclosure, reporting and fraud monitoring therefore address different parts of the problem.
Could licensing make AI music fairer?
Spotify and Universal Music Group announced a planned paid add-on for licensed fan-made covers and remixes, with participating artists and songwriters sharing in value under a model based on consent, credit and compensation. It offers one possible alternative to unlicensed imitation, but it is not a general license for every catalog, model or upload, nor does it resolve disputes over unrelated training data or deceptive releases. Consent-based licensing can clarify who may use a work, how artists are credited and whether they are paid. Its reach depends on which artists and rights holders participate, what uses are covered and whether creators can opt in meaningfully. It cannot by itself govern models operating outside the arrangement.

The ethical questions go beyond copyright
Legality is a floor, not a complete ethical test. A lawful use may still be exploitative or misleading; a transparent and consensual use may still involve unsettled copyright questions. The central questions include:
- Consent: Did performers and songwriters agree to training, voice imitation or commercial reuse?
- Compensation and credit: Do contributors benefit when their work helps a model or a release earn money, and can listeners see who made what?
- Labor: Does a production choice replace paid work for musicians, vocalists, composers, engineers or producers?
- Cultural extraction: Are musical traditions absorbed into commercial systems without permission, attribution or benefit-sharing?
- Environmental cost: What energy and infrastructure are required to train models and generate, distribute and store enormous catalogs?
- Access and power: Does AI help independent creators make work, or concentrate control of data, models and distribution in a few companies?
- Quality and trust: Who bears the cost of filtering low-value uploads, correcting profile mistakes and helping listeners identify authentic releases?
There is no basis for treating all human-made music as ethical or all AI-made music as unethical. A transparent, artist-authorized tool can support creative work; a synthetic catalog can be harmless, confusing or fraudulent depending on how it is presented and used.
