The version of Mickey Mouse in the 1928 film Steamboat Willie entered the U.S. public domain on January 1, 2024. That opens the film and its specific early depictions to reuse in the United States; it does not put every Mickey design, later film, or Disney-branded product beyond copyright or trademark concerns.
What entered the U.S. public domain?
Steamboat Willie was registered with the U.S. Copyright Office in 1928 and entered the U.S. public domain in 2024, according to the Library of Congress. Duke University’s Center for the Study of the Public Domain identifies Steamboat Willie and the 1928 version of Plane Crazy among the works from that year entering the public domain on January 1, 2024 (Duke University).
The key distinction is between a particular work and a character’s entire evolving franchise. The material available to reuse is the 1928 film and the early visual renditions of Mickey and Minnie in it—not every image that later came to represent them. The Library of Congress contrasts the now-public-domain 1928 drawing with later Mickey depictions that remain protected.
Is Mickey Mouse in the public domain?
That phrasing is too broad. The 1928 Steamboat Willie depiction of Mickey is in the U.S. public domain; later drawings, films, and other creative works must be assessed separately. A project that starts with the early design but adds later features may use material with a different rights status.

Copyright covers creative expression for a limited term. The Copyright Office says that, under current U.S. law, works created on or after January 1, 1978 generally receive copyright protection for the author’s life plus 70 years (U.S. Copyright Office). That general rule is not the calculation for this 1928 film; for its transition, the Library of Congress gives the relevant historical account.
Can I use or sell something with Steamboat Willie Mickey?
In the United States, the public-domain status of the 1928 work means copyright permission is not required merely to reuse expression that genuinely comes from that work. Selling an item does not, by itself, answer every rights question. The exact image, any added material, the product’s presentation, and the markets where it will be sold all matter.

- Identify the source. Check that the artwork or footage comes from the 1928 material, rather than a later film, drawing, or adaptation.
- Check the design. Keep the use to the early depiction if relying on that work’s public-domain status; later visual features may have separate protection.
- Review the presentation. Product names, packaging, logos, and advertising can affect whether buyers might think an item is official Disney merchandise or sponsored by Disney.
- Consider where it will appear. This article addresses the U.S. transition. Rights differ by jurisdiction, so U.S. public-domain status alone does not establish permission for distribution everywhere.
- Separate other protected content. Music, artwork, or other material outside the public-domain work may have its own rights status.
These are general distinctions, not a legal ruling on a particular product or design. For commercial use, review the actual assets, branding, sales territory, and applicable law.
Does Disney still have a trademark on Mickey Mouse?
Trademark and copyright are different rights. Copyright concerns creative expression; trademark concerns identifying the source of goods or services and the possibility of consumer confusion. A character can be protected by copyright as creative work and can also function as a trademark when consumers recognize it as indicating who made or authorized a product, as Duke explains in its public-domain discussion.

The Library of Congress cautions that Disney trademark considerations still apply even to artwork no longer protected by copyright. That does not mean every use of the early depiction infringes a trademark. It does mean that a creator should avoid implying official Disney origin or sponsorship and should consider the design, packaging, title, and marketing context. Whether a specific use creates a trademark problem depends on its facts.
When does fair use matter?
Fair use is a separate, case-specific copyright doctrine. It may matter when a project uses protected material in addition to the public-domain film or depiction; it is not necessary simply to reuse material that is genuinely in the public domain. The Copyright Office lists criticism, comment, news reporting, teaching, scholarship, and research as examples of purposes that may qualify, while explaining that fair use must be assessed under the law’s framework (U.S. Copyright Office).

A project is not automatically fair use because it is a film, is commercial or noncommercial, or includes the 1928 character. The presence of public-domain material does not settle the status of other material used alongside it.

In January 2024, news reports described two horror-film projects announced soon after the public-domain transition. The Associated Press reported on January 2 that filmmakers had announced the projects and that Disney said it would continue protecting modern versions of Mickey and other works still under copyright (Associated Press). The American Bar Association also discussed the announced horror-film use and the separate trademark question (American Bar Association).

The announcements illustrate that creators quickly explored projects using the early depiction. They do not establish a court ruling, validate every design or marketing choice, or grant blanket permission to use later Mickey material.

- Pin down the source. Identify the exact film, drawing, or other asset you plan to use.
- Compare the artwork. Determine whether it is limited to the 1928 depiction or includes later features or protected material.
