What entered the public domain on January 1, 2024?
The change applies to Steamboat Willie, a 1928 work identified by the Library of Congress among works entering the U.S. public domain in 2024. It also covers the specific Mickey and Minnie visual depictions that appear in that short—not every version of either character.
The U.S. Copyright Office says works published in the United States before January 1, 1931 are currently in the public domain. The 1928 film reached the end of its U.S. copyright term after 95 years.
Why did the copyright expire after 95 years?
Under the U.S. term rule for works made for hire and anonymous or pseudonymous works, copyright lasts for 95 years from first publication or 120 years from creation, whichever expires first. The Copyright Office’s summary of the rule explains the two alternative limits; the Library of Congress identifies Steamboat Willie as a 1928 work that entered the public domain in 2024.

Which Mickey Mouse material is covered?

The distinction is about the material used, not simply the character name. A later image, design, film or other Disney element does not become free to use merely because it features Mickey Mouse.
Can you use Steamboat Willie Mickey?
In the United States, the public-domain status means the 1928 work and its included depictions can be copied and adapted under copyright law. But a use can raise a different issue if its marks, packaging or presentation lead people to believe it was made, produced or sponsored by Disney. The Library of Congress cautions that trademark considerations can apply to artwork even after copyright expires; Duke Law’s Center for the Study of the Public Domain also explains the consumer-confusion concern.
- Identify which specific image, footage or design you plan to use and whether it actually appears in the 1928 short.
- Keep later artwork and other Disney material out unless you have separately established the relevant rights.
- Avoid presenting your work as official Disney merchandise or implying Disney sponsorship or affiliation.
- Consider the law in every country where you will distribute or sell the work; U.S. public-domain status does not establish worldwide status.

Does the ruling apply outside the United States?
No worldwide conclusion follows from the U.S. expiration. Copyright terms and public-domain status differ by jurisdiction, so the relevant country’s rules must be checked before copying, adapting or distributing the film or its imagery there.
