Wilson Fisk did not break out of prison. Daredevil: Born Again explains that he was acquitted after the FBI corruption scandal came to light. Vanessa Fisk gives that explanation in the season-one finale; the series does not detail the court proceedings that led to the acquittal.
Why was Fisk back in prison at the end of Daredevil?
In the earlier Daredevil series, Matt Murdock defeated Fisk and made him agree to return to prison. As part of their bargain, Matt kept Vanessa’s involvement out of it and protected his own identity. Marvel’s official character history recounts the deal and Fisk’s return to custody.

How did Fisk get out?
Fisk was acquitted, not shown escaping. In the season-one finale, Vanessa tells Benjamin Poindexter: “The whole FBI corruption scandal, Agent Nadeem, all that … it’s why my husband was acquitted.” The Ringer’s recap of the finale reproduces her explanation. Agent Ray Nadeem’s confession helped expose the FBI corruption, linking the scandal to Fisk’s acquittal.
The show gives the reason in dialogue but does not explain the specific legal procedure or provide a detailed ruling. It establishes an acquittal connected to the exposed corruption—not a jailbreak or an explicitly described pardon.

How did his release lead to the mayor’s office?
Once free, Fisk entered politics. In the premiere, he declares his candidacy for mayor, and the episode ends with news that he has won, as detailed in The Ringer’s premiere recap. His mayoralty also advances his criminal ambitions: later in season one, he uses his authority in connection with the Red Hook port project.
