Randy Bachman and Burton Cummings settled their dispute with fellow former Guess Who members Jim Kale and Garry Peterson in September 2024. The parties’ joint announcement says Bachman and Cummings acquired The Guess Who trademark; it does not disclose the rest of the settlement terms. In 2026, the pair returned to touring under the name.
What the settlement changed
The public resolution was announced on September 4, 2024. The joint statement says Bachman and Cummings acquired The Guess Who trademark and describes the settlement as a way to move forward while honoring the band’s shared history. The full agreement was not published, and the parties said its other terms were confidential. The joint announcement and Bloomberg Law’s report do not establish a purchase price, damages award, admission of wrongdoing, or specific restrictions beyond the disclosed transfer.

That distinction matters: this was a settlement, not a court judgment deciding the allegations. The public record described here identifies the outcome, but not every provision governing use of the name.
How the dispute began
Bachman and Cummings filed suit on October 30, 2023, in the U.S. District Court for the Central District of California against Kale, Peterson, and a Canadian partnership identified in the complaint as The Guess Who. Their complaint alleged that the defendants used the band name in ways that could mislead audiences about whether Bachman and Cummings performed with, or were affiliated with, the touring group. Those were the plaintiffs’ allegations, not findings by a judge. The complaint is the source for the filing details.

Bloomberg Law reported that Bachman and Cummings alleged Kale and Peterson had formed a partnership without them and exploited the band name. The complaint also says Kale registered THE GUESS WHO as a U.S. service mark in 1986. That registration history is the complaint’s account; it should not be mistaken for a judicial finding in the dispute.
Why the name carried weight
The conflict involved both control of a valuable band identity and how audiences understood who was performing. The complaint identifies Cummings, Bachman, Kale, and Peterson as the original four members and describes the original group as disbanding in 1975. Bachman and Cummings were central songwriters and performers; Kale was the original bassist and Peterson the original drummer, according to the complaint’s account.

The parties’ 2024 announcement says The Guess Who emerged from Winnipeg in 1965 and names “These Eyes,” “No Time,” and “American Woman” among the group’s catalog. It reports that the 1970 album American Woman reached No. 1 in Canada and the U.S. top ten, and that the band had more than thirty Canadian Top 40 singles and fourteen U.S. Top 40 singles. Bachman and Cummings returned to touring in 2026
The change in trademark control was followed by a return to the stage under The Guess Who name. The Associated Press reported in March 2026 that Bachman and Cummings planned a U.S. tour. The official Burton Cummings biography says the pair reunited for the 2026 Takin’ It Back tour, and an August 2026 Atlanta Journal-Constitution report describes them touring after the settlement. Speaking to AP, Cummings said, “I’m glad that’s all over with.” He also described the purpose of the performances: “Now we can go out and honor the songs. We’re going out to honor the music.” In the AJC interview, he characterized the dispute as “a nightmare” and said, “we finally had enough.” Those comments convey Cummings’s view; the settlement announcement itself does not assign fault.

The public announcement confirms the trademark acquisition, but leaves the rest of the agreement confidential. The available reporting therefore does not establish a payment amount, damages, an admission of wrongdoing, or detailed terms limiting future uses of the name. The settlement resolved the dispute between the parties without making the complaint’s allegations proven facts.
