Not necessarily. One music permission can cover both a YouTube livestream and its archived replay, but only if its terms grant the rights for both uses. Check the license’s scope rather than assuming that permission to play a song live also covers leaving it available on demand. YouTube holds creators responsible for having the necessary rights for their Live Content and any archive.
One permission may cover both, but check what it grants
YouTube’s livestream terms require creators to have the rights needed to use Live Content on Google services, including music rights. The terms also apply to an archive when one is made. They establish a rights obligation; they do not require creators to buy two separate licenses. Whether one permission is enough depends on its wording.
Read the license for permission to transmit the music in a live broadcast and to make the broadcast available later as an on-demand replay. Also check its permitted platforms, territories, term, monetization, edits and attribution requirements. A license limited by any of these terms may not cover the way you plan to use the recording.
Check rights in both the song and the recording
A track can involve separate rights in the underlying musical work and in the sound recording, and different parties may control them. Permission for one layer does not necessarily clear the other. For a commercial track, identify who controls each and confirm that the permission covers the uses you need.

India’s Copyright Act, 1957 includes rights in musical works such as reproduction, public performance and communication to the public; rights in sound recordings include communication to the public. The Act defines communication to the public to include making a work or performance available to be heard or seen, including at times chosen individually. That is why an archived replay is worth checking explicitly, even if the same music was already heard during the live event.
Why YouTube may interrupt a live stream or claim its replay later
During the broadcast
YouTube scans live streams for third-party content. If it detects content that may infringe another party’s rights, it can interrupt or terminate the stream. A license alone does not guarantee that automated detection will recognize your permission.

After the broadcast
If you archive a live stream, YouTube says claims on the archived stream are made after the live stream ends. A live interruption and a later claim on the replay are therefore distinct events. Check the stream and its archive in YouTube Studio after the broadcast.
If you have a license
Ask the rights owner or licensor to add your YouTube channel to its Content ID allowlist when the track may be matched. Without allowlisting, a licensed stream can still be interrupted. Keep written evidence of permission and the version of the terms that applied when you streamed.

A practical rights check before you go live
- Identify the track and rights holders. Establish who controls the sound recording and who controls the underlying composition.
- Confirm the uses in writing. Check that permission covers YouTube livestreaming and the archived, on-demand replay, as well as your territory, monetization plans, duration, edits and attribution.
- Ask about Content ID. If the music may be matched, ask the rights owner or licensor to allowlist your channel before the broadcast.
- Keep the record. Save the written permission and the relevant version of its terms.
- Check both stages. After the broadcast, review the live-stream status and, if available, the replay in YouTube Studio. Handle an interruption during the broadcast separately from a later replay claim.

Do not assume an exception or statutory license clears the music
The Copyright Act includes specific exceptions, including fair dealing for named purposes, but the statutory text does not establish a blanket exception for ordinary background music in an entertainment livestream. Whether an exception applies depends on the facts; do not assume that calling a use “fair use” or “fair dealing” clears it.
Section 31D is framed as a statutory license for a broadcasting organisation and is subject to statutory conditions and rules. The cited law does not establish that an individual YouTube creator can assume it covers a livestream and replay. For a particular license, contract or proposed use, confirm the scope with the rights holder or a qualified Indian copyright professional.
