The event was organized as part of Kirk’s American Comeback Tour, a campus speaking series associated with Turning Point USA. The location was Utah Valley University in Orem, Utah—not Utah State University.
Utah Department of Public Safety officials said Kirk was transported to Timpanogos Regional Hospital and pronounced dead later that day. The department’s official account of the shooting is the primary public source for the initial response and investigation.

What investigators said happened after the shooting
According to information released by Utah officials and the FBI, the shooter reached a rooftop, fired, jumped from the building and fled. Investigators said a gun and ammunition were later left in a wooded area near the university.
Authorities also reported trace evidence on or near the rooftop, including shoe impressions, a forearm imprint and a palm print. Those details describe evidence collected during the investigation; they do not, by themselves, establish the defendant’s guilt.
The investigation involved the Utah Department of Public Safety, the FBI, the Utah County Attorney’s Office, the Utah County Sheriff’s Office and local police agencies. Two people who initially attracted attention were questioned and released. Officials later said neither had a current connection to the shooting.
Who is charged in the case?
Tyler James Robinson was arrested in September 2025. The initial arrest-related charges included:

- Felony discharge of a firearm causing serious bodily injury; and
- Obstruction of justice.

The filing alleges that Robinson hid the rifle and clothing, directed his roommate to delete text messages and seek counsel if questioned, and fired while children under 14 were visible at the event. These statements are allegations in a criminal filing, not findings that have been proven at trial.

What happened at the 2026 preliminary hearing?
The weeklong preliminary hearing concluded on July 10, 2026. A preliminary hearing is not a trial. Its purpose is to determine whether prosecutors have presented enough evidence for the case to continue—often described as whether probable cause exists to bind the defendant over for trial. It does not decide guilt beyond a reasonable doubt.
Prosecutors presented surveillance footage, forensic evidence, testimony about digital communications and evidence concerning the rifle allegedly recovered near the campus. Robinson did not testify.
DNA evidence was contested, not conclusive
A forensic biologist testified about DNA testing involving items that included the rifle, a towel, ammunition and a rotary tool. According to the Associated Press, some likelihood-ratio calculations were at least one trillion times more likely under a proposition that Robinson and one unrelated person contributed the DNA than under a proposition involving two unknown unrelated people.
That statistic needs careful explanation. A likelihood ratio compares how well competing propositions fit laboratory results; it is not the probability that Robinson committed the shooting, and it is not the same as a statement that the defendant’s DNA was definitively identified on an item. The forensic witness specifically emphasized that the laboratory’s methodology did not support an absolute conclusion of that kind. The defense challenged aspects of the DNA interpretation and ballistics evidence.

The Kirk family was permitted to view an edited and enhanced surveillance video in court. The media camera was restricted from recording the same material. That distinction matters: descriptions of courtroom video may reflect an edited evidentiary presentation rather than an unedited public recording.

Where does the criminal case stand now?
Judge Tony Graf did not immediately rule at the end of the preliminary hearing on whether Robinson must stand trial. The parties were scheduled to submit legal briefs, followed by final arguments on September 1, 2026. A probable-cause ruling could follow, but the scheduled proceeding should not be described as a completed trial or conviction.
Until a court enters a different determination, the legally accurate descriptions are the defendant, the man accused of killing Kirk, or prosecutors allege Robinson shot Kirk. Who was Charlie Kirk?
