हाँ—भारत में रहने वाला uploader YouTube के जरिए counter notification भेज सकता है, अगर उसका मानना है कि copyright removal request के कारण content गलती से या गलत पहचान के चलते हटाया गया। YouTube इसे कानूनी अनुरोध मानता है; इसे केवल तभी भेजें जब आपके पास इस विश्वास का अच्छा-विश्वास वाला आधार हो। आवेदन से बहाली की गारंटी नहीं मिलती, और इससे यह तय नहीं होता कि भारतीय कानून के तहत आपका इस्तेमाल वैध था।
पहले पता करें कि livestream पर कौन-सी कार्रवाई हुई
हर copyright notice का जवाब counter notification नहीं होता। YouTube Studio में दिख रही कार्रवाई और उपलब्ध विकल्प पढ़ें: live interruption, archived stream पर Content ID claim और formal copyright removal request अलग स्थितियाँ हैं।
लाइव स्ट्रीम रोकी गई या समाप्त हुई
YouTube कहता है कि सभी live streams को तीसरे पक्ष के content से matches के लिए scan किया जाता है, जिसमें दूसरी live broadcast में मौजूद copyrighted content भी शामिल है। Match मिलने पर content हटाने या रोकने की चेतावनी मिल सकती है; content बने रहने पर stream अस्थायी रूप से बाधित या समाप्त हो सकती है। केवल interruption या termination से यह साबित नहीं होता कि formal copyright removal request जारी हुई है। पहले Studio में notice और remedy देखें।
स्ट्रीम का archive बनने के बाद Content ID claim आया
Stream खत्म होकर archive होने के बाद उस पर Content ID claim आ सकता है। यह अपने-आप formal takedown या copyright strike के समान नहीं है। Studio में claim की स्थिति और उसके लिए दिखाए गए विकल्प देखें; counter notification हटाए गए video के लिए copyright removal request वाली प्रक्रिया है, सामान्य Content ID claim का सार्वभौमिक जवाब नहीं।

Formal removal request से video हटाया गया
Counter notification इसी प्रकार हटाए गए content के लिए है। अगर removal अभी scheduled है और प्रभावी नहीं हुआ है, तो YouTube के निर्देशों के अनुसार उस चरण में counter notification दाखिल नहीं किया जा सकता; removal प्रभावी होने के बाद ही यह विकल्प लागू हो सकता है। Copyright के कारण सक्रिय livestream हटाए जाने पर strike और सात दिन का live-streaming access restriction भी हो सकता है।
भारत का copyright कानून आपके मामले में क्या मायने रखता है
Copyright Act, 1957 की धारा 51 copyright infringement से संबंधित है। धारा 52 में अधिनियम की शर्तों के अधीन कुछ अपवाद हैं, जिनमें निर्दिष्ट उद्देश्यों के लिए fair dealing शामिल है। कोई खास संगीत, फिल्म, खेल प्रसारण या अन्य संरक्षित सामग्री किसी अपवाद में आती है या नहीं, यह उपयोग के तथ्यों और लागू शर्तों पर निर्भर करता है। केवल भारत में होना या सामग्री का छोटा हिस्सा इस्तेमाल करना अपने-आप वैधता स्थापित नहीं करता।

YouTube अपनी counter-notification guidance में fair use, fair dealing और public domain को उन संभावित कारणों के उदाहरणों में रखता है जिनसे removal गलती या misidentification हो सकता है। इसका अर्थ यह नहीं कि YouTube भारतीय fair dealing के किसी विवाद का अंतिम कानूनी फैसला करता है। भारत के कानून के तहत अपने उपयोग का आकलन अलग प्रश्न है।
Counter notification भेजने से पहले इन बातों को तौलें
- कार्रवाई का प्रकार: क्या यह formal copyright removal request है, live interruption है या archive पर Content ID claim? उपाय notice के प्रकार के अनुसार बदलता है।
- स्थिति और समय: क्या removal प्रभावी हो चुका है, या अभी scheduled है? Scheduled removal के दौरान यह filing उपलब्ध नहीं होती।
- आपका आधार: क्या आप विशिष्ट रूप से बता सकते हैं कि removal गलती या misidentification क्यों था? यदि आपका आधार किसी कानूनी अपवाद पर है, तो उसकी शर्तें आपके वास्तविक इस्तेमाल पर लागू होती हैं या नहीं, यह जाँचें।
- जानकारी और घोषणाएँ: क्या आप आवश्यक संपर्क जानकारी, कानूनी घोषणाएँ और claimant के साथ जानकारी साझा किए जाने के परिणाम स्वीकार करने को तैयार हैं?
YouTube के बताए अन्य रास्तों में claimant से retraction माँगना या Copyright School पूरा करके 90 दिन इंतजार करना शामिल हो सकता है। 90 दिन बाद strike समाप्त हो सकती है, लेकिन हटाया गया video अपने-आप बहाल नहीं होता। किसी विकल्प को चुनने से पहले अपने Studio notice में उपलब्ध स्थिति और निर्देश देखें।

YouTube के जरिए counter notification कैसे भेजें
- हटाए गए video की स्थिति पक्की करें। YouTube Studio में notice देखकर सुनिश्चित करें कि कार्रवाई formal copyright removal request है और removal प्रभावी हो चुका है। अगर मामला केवल live interruption या archived-stream claim है, तो उसी notice में दिए गए उपाय पढ़ें।
- अपना कारण तैयार करें। अपने शब्दों में संक्षेप और तथ्यपरक रूप से समझाएँ कि video गलती या misidentification के कारण क्यों हटाया गया। YouTube के अनुसार, आवेदन में पूरा कानूनी नाम, भौतिक पता, फोन नंबर, हटाए गए content का सीधा link और यह स्पष्टीकरण देना होता है।
- Studio या YouTube के बताए दूसरे माध्यम से आवेदन करें। YouTube Studio के जरिए video के लिए आवेदन किया जा सकता है। YouTube के प्रकाशित निर्देश ईमेल, fax या mail का विकल्प भी देते हैं। उपलब्ध विकल्पों और जमा करने के निर्देशों के लिए अपने मामले का notice और YouTube Help की “Submit a copyright counter notification” प्रक्रिया देखें।
- कानूनी घोषणाएँ और हस्ताक्षर ध्यान से पढ़ें। YouTube के निर्देशों में निर्धारित US federal-court jurisdiction को स्वीकार करने और claimant से service स्वीकार करने की घोषणा, तथा perjury penalty के तहत good-faith belief की घोषणा शामिल है। पूरे कानूनी नाम से हस्ताक्षर आवश्यक है। प्रतिनिधि आवेदन करे तो uploader से उसका संबंध बताना होता है।
- जानकारी साझा होने का जोखिम समझकर ही जमा करें। YouTube कहता है कि वह counter notification claimant के साथ साझा करता है। यदि व्यक्तिगत जानकारी साझा किए जाने को लेकर चिंता है, तो YouTube अधिकृत प्रतिनिधि—जैसे वकील—के माध्यम से आवेदन करने का विकल्प बताता है।
भारत के आवेदकों के लिए US jurisdiction घोषणा का प्रश्न
YouTube की प्रकाशित घोषणा के अनुसार, US के बाहर पते वाला व्यक्ति उस judicial district की jurisdiction स्वीकार करता है जहाँ YouTube स्थित है। उपलब्ध आधिकारिक सामग्री यह स्पष्ट नहीं करती कि भारत में रहने वाले व्यक्ति के लिए इस घोषणा के भारतीय कानूनी निहितार्थ क्या हैं या किसी खास विवाद में इसे कैसे लागू किया जाएगा। यदि इस शर्त या किसी अन्य घोषणा को लेकर संदेह है, तो आवेदन भेजने से पहले योग्य भारतीय वकील से सलाह लें।

YouTube के अनुसार, अगर counter notification वैध मानी जाती है और claimant को भेजी जाती है, तो claimant के पास 10 US business days होते हैं कि वह content की बहाली रोकने के लिए कानूनी कार्रवाई का सबूत दे। यदि YouTube को उस अवधि में ऐसा सबूत नहीं मिलता, तो content बहाल किया जाता है—जब तक uploader ने उसे delete न किया हो—और संबंधित strike हट सकती है। यह न तो भारतीय न्यायालय की समय-सीमा है, न बहाली की गारंटी: पहले YouTube को आवेदन valid मानकर claimant को भेजना होगा, और परिणाम परिस्थितियों पर निर्भर करता है।
