The February 15, 2022 report described a dispute over whether owning a physical card gave its owner permission to create and use a related NFT—not a court ruling on that question.
What MtgDAO proposed
According to Futurism’s February 15, 2022 report, MtgDAO proposed that people who owned particular Magic cards could mint them as NFTs, with the tokens potentially eligible for tournament play. The group’s stated rationale was that buyers already owned the physical cards and that the NFTs would preserve scarcity.
Those were MtgDAO’s claims as reported at the time. The article did not establish that the project launched or that its ownership argument was legally accepted.
Why Wizards objected
Futurism reported that Wizards of the Coast objected to the proposed use of its copyrights and trademarks. The company’s reported position was that buying a physical card—or buying one through an authorized online retailer—did not make the proposed NFT use lawful.

The distinction at the center of the dispute was therefore between owning a physical collectible and having permission to reproduce or use the intellectual property associated with it. Wizards’ objection was a position stated in a letter, not a judicial finding about the project or a general ruling on NFTs.
What the letter and white paper said
Futurism reproduced two sentences attributed to Wizards’ lawyers: “Your enthusiasm for MAGIC: THE GATHERING is evident and appreciated.” The letter continued: “Unfortunately, your intended use of Wizards’ intellectual property, including its trademarks and copyrights, would be unlawful.” The report did not name an individual lawyer who wrote the letter.

The same report quoted MtgDAO’s white paper saying, “I think crypto and the world of DAO’s can take this game to the next fucking level,” and describing the group’s claim that it could build a protocol “legally” over the existing game. These were the project’s assertions, not an independent legal analysis.

The report establishes that Wizards was reported to have sent a demand letter in response to MtgDAO’s proposed Magic-card NFT project, and that the parties took opposing positions about whether physical-card ownership permitted the planned use. It does not report a court decision resolving the disagreement.

Nor does the February 15, 2022 article establish whether MtgDAO later launched or abandoned the project, whether the parties settled, or whether a court subsequently ruled. Its closing question about who would mint the first Magic NFTs reflected uncertainty at that time; it is not evidence of what happened afterward.
