Universal Music Group (UMG) asked a federal judge to throw out Drake’s lawsuit over Kendrick Lamar’s “Not Like Us,” arguing that the track’s accusations were opinion and rap-battle hyperbole, not verifiable facts. On October 9, 2025, Judge Jeannette A. Vargas granted UMG’s motion, finding that a reasonable listener would not understand the song as conveying factual claims about Drake. Drake appealed; the appellate docket information available through February 2026 does not establish the appeal’s later status.
What Drake’s lawsuit challenged
Drake, whose legal name is Aubrey Drake Graham, sued UMG Recordings in federal court in New York in January 2025. His complaint challenged UMG’s publication and promotion of Kendrick Lamar’s “Not Like Us,” alleging that the song contained false and defamatory accusations. What UMG argued in its motion
In a March 17, 2025 filing, UMG asked the Southern District of New York to dismiss Drake’s amended complaint with prejudice. The label argued that the lyrics were nonactionable opinion and rhetorical hyperbole in the context of a rap battle. Why Judge Vargas dismissed the case
On October 9, 2025, Judge Jeannette A. Vargas granted UMG’s motion. Her decision turned on context: the song appeared in an intense rap battle marked by exaggerated insults and offensive accusations. In that setting, the court concluded, a reasonable listener would not take the challenged statements as verifiable facts about Drake. What the appeal record establishes
Drake appealed the dismissal. The located Second Circuit docket identifies the case as Graham v. UMG Recordings, Inc., No. 25-2758. It records that on January 27, 2026, Drake’s motion to certify a question of state law to the New York Court of Appeals was referred to the panel that would decide the appeal’s merits; UMG filed an opposition on February 2, 2026.
