Why the Calico Critters Maker Sued “Sylvanian Drama”—and Then Dropped the Case

Epoch sued Irish creator Thea Von Engelbrechten over her “Sylvanian Drama” videos featuring Calico Critters, then voluntarily dismissed the case. No public ruling decided whether the videos infringed its rights.

Epoch Company, the maker of Calico Critters and Sylvanian Families toys, sued Irish creator Thea Von Engelbrechten over her “Sylvanian Drama” videos, then voluntarily dismissed the case in August 2025. The suit never produced a publicly reported ruling on whether the videos infringed Epoch’s rights. Before the dismissal, legal experts told Ars Technica that the claims and possible defenses were uncertain—and that suing a popular creator over beloved toys could bring unwanted publicity.

What was “Sylvanian Drama”?

Von Engelbrechten made short comic videos using the small animal figures sold as Calico Critters in the United States and Sylvanian Families in other markets. The videos placed the toys in dramatic, sometimes dark storylines. The dispute intensified when the account also featured sponsored videos involving the toys and third-party brands.

Epoch’s April 7, 2025 complaint said the account’s name and use of the toys in commercial content infringed its intellectual property and could make viewers think Epoch had authorized or endorsed the videos. Those were allegations by the company, not findings by a court. The complaint described the account as having more than 2.5 million TikTok followers, 69 million TikTok likes, and 1 million Instagram followers; those figures were the plaintiff’s claims at filing, not independently verified or current audience measurements.

Why did Epoch sue?

Epoch filed its complaint in the U.S. District Court for the Southern District of New York. It alleged copyright infringement, trademark infringement, false designation or endorsement, and unfair competition. The company sought an injunction, profits, and damages, according to Ars Technica’s account of the complaint.

Epoch’s filing said it had sent TikTok a copyright notice in October 2023 and described efforts to address the dispute before filing suit. It also argued that the account’s commercial partnerships could affect licensing opportunities and create confusion about a connection to the toy brand. These, too, were Epoch’s description of events and its legal position.

Ars’s July 22, 2025 report discussed a possible statutory copyright damages ceiling of up to $150,000 per violation in the circumstances it described. That is a potential legal ceiling, not an amount awarded, a finding of infringement, or a prediction of what Epoch would have recovered.

What defenses did legal experts think might matter?

Experts interviewed before the case was dismissed described a fact-sensitive dispute, not an obvious winner. Santa Clara University School of Law professor Eric Goldman called it “not an easy case on either side.” Copyright and trademark raise distinct questions, and commercial sponsorship can complicate how audiences understand a creator’s relationship with a brand.

Copyright: does the work comment on the original?

A potential fair-use argument could turn on whether the videos use the toys to comment on the copyrighted characters or work, rather than merely using them as props for an unrelated joke. Harvard Law School professor Rebecca Tushnet told Ars that courts vary in how they treat parody and that humor is difficult to predict. In her view, a court that understood the joke might be more likely to see the contrast between the innocent-looking dolls and the storylines as parodic. That was an expert’s assessment, not a court’s conclusion about these videos.

Trademark: might viewers think Epoch approved the videos?

Trademark claims concern issues separate from copyright, including the relevant rights and whether a use is likely to confuse people about source, sponsorship, or endorsement. A creator’s use of a recognizable toy in a video does not, by itself, answer those questions. In this dispute, Epoch alleged confusion; no court publicly determined whether viewers were actually confused or whether the account implied authorization.

Commercial sponsorship: what does the context suggest?

Brand partnerships made the setting more complicated than a purely personal fan video. Viewers could potentially infer that a toy company approved a sponsored post, but sponsorship alone does not establish that confusion occurred or resolve whether a particular use infringed copyright or trademark rights. The outcome would have depended on the evidence and legal analysis, had the case continued.

Why did experts warn Epoch could regret suing?

The concern was reputational as well as legal. A lawsuit against a creator whose videos used nostalgic, widely recognized toys could draw attention to the dispute and invite criticism of the brand. Northeastern University law and media professor Alexandra Jane Roberts warned that drawing public attention to litigation against a beloved creator “can be really bad press.” She also noted the difficulty of claiming exclusive control over a basic visual idea: “There’s only so many ways to make a small fuzzy bunny that doesn’t look like this.”

Those comments were predictions about potential public reaction when the suit was active—not evidence that a measured consumer backlash occurred. Ars’s July article presented reputational risk alongside the uncertainty of the legal arguments.

What happened to the lawsuit?

Ars Technica reported on August 8, 2025, that Epoch had voluntarily dismissed the lawsuit. The dismissal filing did not explain why. Ars also reported that Von Engelbrechten appeared to be responsible for her own costs and fees. RTÉ later described the case as settled, but the public reporting cited here does not disclose the complete terms of any private resolution.

The dismissal is a procedural outcome, not a ruling that either side’s legal arguments were correct. The available reporting does not establish that Von Engelbrechten won on the merits, that Epoch was found liable, or that the parties agreed to specific restrictions on future videos.

Can creators use toys in sponsored videos?

This case does not establish a blanket rule permitting or forbidding it. A creator considering sponsored content with recognizable toys should distinguish three questions: whether the content uses copyrighted material fairly, whether the use risks trademark confusion, and whether the sponsorship or presentation could imply brand authorization. The answers depend on the particular content and context; a sponsor’s presence neither proves infringement nor guarantees permission.
