R. Kelly’s lawyers sought emergency release to home detention in June 2025, alleging that prison officials had directed another inmate, Mikeal Glenn Stine, to kill him. On June 20, U.S. District Judge Martha M. Pacold denied the request because she lacked jurisdiction to grant the relief Kelly sought. The denial did not determine whether the alleged plot happened.
What did R. Kelly’s lawyers allege?
In a June 20, 2025 filing in Kelly’s Chicago federal case, his attorneys said Stine told Kelly that officials had sent him to FCI Butner and instructed him to murder the singer. The filing described Stine as a longtime Bureau of Prisons inmate and member of the Aryan Brotherhood. It recounted Stine’s claim that an official offered him the chance to spend his final months free in exchange for killing a prisoner who allegedly threatened to expose damaging information about prison officials. These are allegations in a defense filing, not established findings. The filing in United States v. R. Kelly, Document 498, is the primary source for what Kelly’s lawyers asserted; it does not independently corroborate the account.
The filing recounts Stine saying, “I told him that I had been sent to kill him.” That statement is attributed to Stine through the defense’s account, not presented as an independently verified finding. The Chicago Sun-Times also reported on Kelly’s request for help in June 2025.
What release did Kelly request?
Kelly’s attorneys asked the court for emergency release to home detention, arguing that he faced danger in custody. The request was a bid for a change in his confinement, not a decision that he had been cleared of his convictions or that the alleged solicitation had been proven.

How did the judge rule?
On June 20, 2025, Judge Pacold canceled a scheduled hearing and denied the emergency request. The Associated Press reported that the judge found Kelly had not identified a statute or rule authorizing the court to grant the requested relief, and that he offered no evidence supporting his allegations. Pacold wrote: “Jurisdictional limitations must be respected even where, as here, a litigant claims that the circumstances are extraordinary. Kelly has not identified (nor is the court aware of) any statute or rule that authorizes the court to exercise jurisdiction. Thus, the court cannot award relief in this case.” The AP account of the ruling makes clear the decision was jurisdictional; it did not decide whether officials had asked Stine to kill Kelly.
What did the government and prison officials say?
In its response, the government described the allegations as a “fanciful conspiracy,” according to AP reporting. The Bureau of Prisons declined to comment on conditions of confinement or pending litigation. Those positions are responses to the allegations, not independent findings about what occurred. AP’s report on the allegations and responses also described additional claims by Kelly’s attorneys about his treatment in custody.

How are the other mistreatment claims different?
In separate allegations reported by AP, Kelly’s attorneys said he was moved to solitary confinement and intentionally given an overdose, then hospitalized and underwent surgery for blood clots. Government attorneys rejected those allegations. They concern alleged mistreatment and medical care, distinct from the claim that Stine was asked to kill Kelly; neither set of claims was established by the judge’s jurisdictional ruling.

The emergency home-detention motion was denied and was not pending in 2026. A separate legal route appeared in later reporting: on July 16, 2026, The Guardian reported that Kelly’s request to President Donald Trump for commutation was pending. The report described him as serving a combined 31-year federal sentence, following convictions for racketeering and sex trafficking in New York and child-abuse-image and child-enticement counts in Chicago. A pending commutation request is not a release, and it did not reopen or reverse Judge Pacold’s ruling on home detention.
