David “Heavy D” Sparks was jailed in October 2025 under a civil contempt order in the long-running Clean Air Act case involving Diesel Brothers—not on a new criminal pollution charge. He was released after an October 9 hearing, and the court found the relevant contempt purged on October 23. In February 2026, plaintiff Utah Physicians for a Healthy Environment (UPHE) reported a settlement and payment of the fees and costs debt.
Why did Heavy D go to jail?
The immediate reason was post-judgment enforcement: the court said Sparks had failed to comply with enforcement orders and had not paid fees and costs. Its October 2, 2025 order found ongoing civil contempt and commanded his incarceration until he complied. The order described repeated violations of court orders over the course of the litigation; it did not announce a new pollution conviction. Read the October 2 order.
The order followed an earlier contempt ruling. On August 1, 2025, the court found Sparks in civil contempt over an ongoing asset sale that violated a court order and directed that he be incarcerated until he purged that contempt. Read the August 1 order.
Was Sparks jailed for pollution?
No. The underlying lawsuit concerned alleged removal of diesel emissions controls and use of defeat devices, conduct addressed under the federal Clean Air Act. The October 2025 custody arose later, in proceedings to enforce court orders and collect fees and costs. Civil contempt is distinct from a criminal prosecution and sentence: the October order tied incarceration to compliance with the court’s requirements, rather than imposing a new criminal punishment for the alleged emissions conduct.

What was the Diesel Brothers emissions case about?
UPHE brought the federal case over diesel emissions-control tampering and defeat devices. The district court ruled for UPHE after a 2019 trial and entered a permanent injunction, according to the organization’s case history. In 2021, the Tenth Circuit reviewed the case and ordered a remand for adjustments and further findings on statutory penalties. UPHE’s 2026 case-history page recounts trial evidence that a diesel truck with all federally required emissions controls removed typically emits nitrogen oxides at 36 times and particulate matter at 21 times its original EPA-certified emissions rates. Those are figures reported by UPHE from the trial record, not measurements of every modified truck. The same page says the district court found Diesel Power Gear revenue of $12,576,067 in 2018.

What did the court order, and how did the case reach contempt?
After the 2020 judgment, the court ordered fees and costs in 2021. It later found the defendants in contempt in June 2024 for nonpayment. Subsequent enforcement orders required documents and restricted asset transfers. The October 2025 order recited an initial fee award of $928,602.23; after Keaton Hoskins settled and his liability was resolved, the remaining defendants’ fee liability was reduced by $85,000, to $843,602.23. These are historical court-order amounts, not the amount UPHE later said had been paid under the settlement.
The case also involved civil penalties. UPHE’s case history reports that the district court assessed $851,446 in civil penalties, including $90,000 for Davis County to administer a Tampered Diesel Truck Restoration Program. The Tenth Circuit opinion discusses an earlier statutory-penalty assessment of $117,290,620 before the district court applied statutory factors and assessed lower amounts; the appeals court ordered a remand. The $117.29 million figure should therefore not be mistaken for the final amount owed.

When was Sparks released, and is he still in jail?
Sparks appeared in custody at a contempt hearing on October 9, 2025. The court released him at the hearing’s end, based on argument and a stipulation. After reviewing a status report, the court found on October 23 that he had substantially complied with specified requirements or that compliance was impossible, and it found the relevant contempt purged. Read the October 23 order. The available status update does not say that Sparks remains jailed.

In a February 2026 update, UPHE said the parties had agreed to settle the longstanding dispute and that Sparks and defendant companies had paid their full fees and costs debt. UPHE also said they remained liable for approximately $200,000 in civil penalties and continued to be subject to restrictions against disabling emissions controls and selling or installing defeat parts.
