Tom Girardi’s August 2024 guilty verdict established his criminal responsibility for four federal wire-fraud counts. It did not establish that his wife, Erika Girardi, was guilty or knowingly involved. The federal case against Tom and the bankruptcy trustee’s separate civil suit involving Erika are different proceedings, with different parties and outcomes.
What did the jury decide?
A federal jury found Tom Girardi guilty in August 2024 on four counts of wire fraud. The U.S. Department of Justice said the case involved taking money owed to clients from settlement proceeds and using law-firm funds for illegitimate expenses. The DOJ’s account of the verdict describes the criminal case against Girardi; it does not report a conviction of Erika.
Prosecutors said more than $25 million from Girardi Keese’s operating account paid expenses for EJ Global, a company the DOJ described as formed by Girardi’s wife in connection with her entertainment career. That financial evidence does not, by itself, establish that Erika knew the money was improperly obtained or that she committed a crime.
After the verdict, U.S. Attorney Martin Estrada called it a sign that “the game is up” and said victims had been callously betrayed. That was the prosecutor’s characterization, not a separate finding by the jury about Erika.

What happened to Tom Girardi after the verdict?
In June 2025, Girardi was sentenced to 87 months in federal prison. The DOJ announced the sentence in its sentencing release. The Associated Press reported that the court also ordered a $35,000 fine and $2.3 million in restitution. Those are outcomes in Girardi’s criminal case; they do not resolve the trustee’s separate claims against Erika.
What does the verdict mean for Erika?
On the cited record, it means the jury found Tom—not Erika—criminally responsible for the four wire-fraud counts. The DOJ’s account links Girardi Keese money to EJ Global expenses, but that payment evidence is not a verdict about Erika’s knowledge, intent, or criminal responsibility.

Erika’s reported legal exposure was in a separate civil proceeding brought by the bankruptcy trustee. Bloomberg Law reported in 2026 that the trustee’s suit, which sought approximately $25 million, had settled confidentially. Bloomberg Law did not disclose the settlement terms. The report therefore does not establish a settlement amount, an admission, or a final dismissal detail.

Why the distinction matters
A criminal conviction is a finding of guilt against the defendant in that case. A civil recovery suit by a bankruptcy trustee is a separate effort to recover money for an estate. A claimed transfer, a payment made to a company, or a civil settlement should not be described as a criminal conviction or proof of knowing participation unless a reliable source establishes that finding.

For viewers who know the Girardis through reality television, the distinction is easy to lose amid headlines about the couple and the law firm. The legal outcomes reported here are narrower: Girardi was convicted and sentenced in the federal case; the trustee’s separate suit involving Erika was reported settled, with its terms undisclosed.
