Start with the official rules that applied when the giveaway was open. Check the claim deadline, how the winner was to be notified, what they had to submit, and what the rules say happens if they do not respond. If the rules and applicable law allow an alternate winner, follow that process consistently and keep records. There is no universal claim period, and an unclaimed prize cannot automatically be kept, donated, or redrawn.
Check the rules before taking action
Find the version of the official rules and promotion materials that applied while entries were being accepted. Look for:
- The deadline for claiming the prize, including the time zone or event that starts the clock.
- The stated method of notification and the contact details or account the entrant was expected to monitor.
- The exact response instructions and any required eligibility affidavit, release, or tax forms.
- What the rules authorize if the winner misses the deadline, is ineligible, or fails to return required documents.
Do not substitute a deadline or consequence that is not in the rules. If they do not clearly say what to do after a missed claim, pause before choosing a remedy and check the law that applies to the promotion.
Confirm that notice and the original selection were handled properly
- Verify the draw. Confirm that the winner was selected by the method announced in the rules and meets the eligibility requirements.
- Use the specified notice channel. Contact the potential winner using the method and contact information the rules prescribe. Save the date, message, delivery status, and any reply. A sent notice is not proof that it was received.
- Give the stated instructions and deadline. Request only documents required by the rules or applicable law, and handle personal information securely.
- Record what happened by the deadline. Note whether the required response arrived, when it arrived, and whether it was complete.
For a concrete example—not a general deadline—the New York City Department of City Planning’s sample giveaway rules allow two days from when an award notification was sent to claim. They also describe possible forfeiture and selection of an alternate if the winner is ineligible or fails to return a required affidavit and release on time. That two-day period belongs to those sample rules only.

Can you select an alternate winner?
Only do so when the promotion’s rules and applicable law permit it. If they do, use the stated method, document the selection, verify the alternate’s eligibility, and follow the same notice and claim procedure. Do not assume that an alternate draw is allowed just because the first winner did not respond.
If the rules do not provide a clear next step, or the promotion is subject to additional legal requirements, get jurisdiction-specific advice before declaring a forfeiture or choosing a replacement. Do not assume you may keep, donate, substitute, or leave the prize unawarded.

Check which laws apply to the promotion
Federal prize-promotion guidance has a defined scope
The Federal Trade Commission’s Telemarketing Sales Rule guidance for prize promotions addresses covered seller and telemarketer promotions. It discusses disclosures including odds, a free method of participation, and material costs or conditions for receiving or redeeming a prize, and prohibits misrepresentations about material aspects. It does not establish a general deadline for a winner to claim, or a universal rulebook for every social-media giveaway.
Florida has specific requirements for covered game promotions
Florida Statutes §849.094 applies to defined game promotions connected with the promotion or sale of consumer products or services where chance and a prize are involved. The 2024 Florida statute, including 2025C, prohibits arbitrary disqualification and failing to award prizes offered. For covered promotions with a total announced prize value above $5,000, it calls for advance filing of rules and prize information at least seven days before the promotion begins, security by trust account or bond subject to a statutory waiver route, and a certified winners list within 60 days after winners are finally determined. These are Florida-specific requirements; confirm the statute’s current effect and whether it covers your promotion before acting. The Florida Department of Agriculture and Consumer Services also summarizes requirements and warns against failing to award prizes in its game promotions and sweepstakes guidance.

For entrants: watch for prize-claim scams
A real sweepstakes prize should not require you to pay money to claim it. The FTC says, “A legitimate prize promotion does not require any purchase or payment of money for a consumer to participate or win.” Treat urgent demands for a claim fee, payment details, or sensitive financial information as warning signs. Verify a message using contact information you find independently, not a phone number or link in the suspicious message. See the FTC’s advice on fake prize, sweepstakes, and lottery scams.
