On the November 12, 2025 episode of The Megyn Kelly Show, Megyn Kelly relayed an unnamed person’s view that Jeffrey Epstein was “not a pedophile.” She then said he was interested in “the barely legal type” and, in her words, “liked 15-year-old girls.” Kelly also called the conduct disgusting, said she did not know what was true about Epstein, and argued that “There’s a difference between a 15-year-old and a five-year-old.” Those remarks were a reported opinion and a disputed framing—not an official finding or a clinical diagnosis.
What Kelly said on her show
Kelly made the comments while speaking with journalist and author Batya Ungar-Sargon. According to transcripts of the exchange, Kelly said someone close to the Epstein case believed he was “not a pedophile,” then described Epstein as attracted to “the barely legal type.” She added: “Like, he liked 15-year-old girls.” Media Matters’ transcript excerpt records the November 12, 2025 wording.
Kelly did not present the unnamed person’s view as something she had independently established. In the same conversation, she said she did not know what was true about Epstein, called the conduct disgusting and said she was not making an excuse for it. She also said she had not seen anyone come forward saying they were under 10 or under 14 when they first came within his purview, and contrasted a 15-year-old with a five-year-old.
A shorter clip in CNN’s November 14 transcript captures Ungar-Sargon objecting to the framing. Kelly replied, “I think there is a difference,” and repeated: “There’s a difference between a 15-year-old and a five-year-old.” CNN’s transcript provides that portion of the exchange.

What the 2019 federal case alleged
The official record supplies a separate category of evidence. On July 8, 2019, the U.S. Attorney’s Office for the Southern District of New York announced that Epstein had been charged with sex trafficking of minors and conspiracy to commit sex trafficking of minors. The indictment alleged that, from 2002 through 2005, he sexually exploited and abused dozens of underage girls, that victims were as young as 14, and that he recruited minors and paid some victims to recruit others. These are allegations in an indictment, not findings after a completed trial.
The case did not produce a trial verdict. The Department of Justice case record says the prosecution was formally dismissed after Epstein died in August 2019. The announcement and procedural history are available from the Southern District of New York.

Why the word “pedophile” needs qualification
Kelly’s comments used “pedophile” in a public argument about age and sexual interest. The materials documenting the exchange do not establish whether she, the unnamed source or other speakers were using the word in a clinical, colloquial or legal sense. The federal charges concerned trafficking and sexual exploitation of minors; the charging document does not, by itself, provide a clinical diagnosis.
For that reason, it is inaccurate to turn the unnamed source’s statement into an established fact, or to treat “pedophile” as interchangeable with the offenses alleged in the indictment. The available record supports describing the terminology as disputed and the legal allegations separately.

In a November 21, 2025 CNN interview, Lisa Phillips, whom CNN identified as an Epstein abuse survivor, was asked about Kelly’s distinction. Phillips said she could understand the point about prepubescent girls but rejected the implication that the distinction resolved the issue. Her concise response was: “They’re children.” CNN’s transcript records her comments.
Phillips was expressing her own view as a survivor; her statement is not a clinical determination. It does, however, explain why the age comparison was criticized as minimizing the experiences of minors.

What can—and cannot—be concluded
- Established about the broadcast: Kelly made the remarks on November 12, 2025, during her conversation with Batya Ungar-Sargon.
- Attributed, not verified: Kelly said an unnamed person close to the case believed Epstein was “not a pedophile.” The sources available here do not independently verify that person’s account.
- Officially alleged: The 2019 indictment alleged sexual exploitation and abuse of dozens of underage girls, with victims as young as 14, along with recruitment and payment allegations.
- Procedural outcome: Epstein’s federal prosecution ended with dismissal after his death; there was no trial verdict in that case.
- Terminology: The record here does not settle a clinical meaning for “pedophile,” so no diagnosis should be inferred.
- Survivor response: Lisa Phillips said the girls were children and gave her own assessment of Kelly’s distinction.
