The Mann Act is the common name for a federal law that criminalizes certain transportation across state or national borders for prostitution or other specified criminal sexual activity. In Sean “Diddy” Combs’s case, a jury convicted him on two counts under the law, while acquitting him of racketeering conspiracy and sex trafficking. The verdict therefore included Mann Act convictions, but not a sex-trafficking conviction.
What the Mann Act prohibits today
The Mann Act is now principally codified at 18 U.S.C. §§ 2421–2423, within Chapter 117 of the federal criminal code, titled “Transportation for Illegal Sexual Activity and Related Crimes.” The provision central to Combs’s case is § 2421(a), the general transportation offense.

Under 18 U.S.C. § 2421(a), a person commits an offense by knowingly transporting an individual in interstate or foreign commerce, or in a U.S. territory or possession, with the intent that the individual engage in prostitution or sexual activity for which someone can be charged with a criminal offense. The statute also covers attempts. For a violation of § 2421(a), the authorized penalties are a fine, imprisonment for up to 10 years, or both. The maximum prison term is specific to this subsection; it should not be applied automatically to every offense in Chapter 117.
The statute concerns transportation together with the specified intent. It is not a general ban on crossing state lines, nor does the text make consensual travel alone an offense. Whether conduct meets the statute’s elements depends on the facts and applicable law.

How the charges in Combs’s case differed
After an eight-week trial, the jury found Combs guilty on two counts of transporting people for prostitution under the Mann Act. It acquitted him of racketeering conspiracy and sex trafficking. The charges and verdict are distinct: the two Mann Act convictions were not sex-trafficking convictions, and the acquittals on the other charges did not undo the guilty findings.

What the judge said about prostitution in this case
Judge Arun Subramanian’s opinion addressed Combs’s arguments about how the jury could understand prostitution under the instructions it received. The instruction defined prostitution as “engaging in sexual activity for money or its equivalent.” The judge rejected the argument that the person transporting someone must have a financial motive, and also rejected the argument that payment had to be a direct exchange between the people engaged in sexual activity.
Those points describe the court’s reasoning about the instructions and arguments in this case. They are not a substitute for the statutory text or a universal summary of every issue that might arise under the Mann Act. The opinion’s opening sentence states: “After an eight-week trial, a jury convicted Sean Combs of two counts of transporting people for prostitution under the Mann Act.”
How the law’s name and language changed
Congress enacted the law in 1910. It became known as the Mann Act after Representative James Robert Mann of Illinois. The original statute used gendered language and referred to transporting a woman or girl for prostitution, “debauchery,” or another “immoral purpose.” Those historical terms are not the wording of the current general offense.
Congress revised the statute in 1986, making it gender-neutral and replacing the old “debauchery” and “immoral purpose” language with a reference to sexual activity for which a person can be charged with a criminal offense. The current text, rather than the original moral language, governs explanations of § 2421(a) today.

The law’s early enforcement history remains controversial. Boxer Jack Johnson was convicted under it in 1913 after traveling with his white girlfriend, who was a sex worker. The Associated Press also describes an earlier Supreme Court interpretation that treated consensual “illicit fornication” as an immoral purpose under the old statute. That history illustrates how the original law was used; it does not define the present-day elements of § 2421(a). Associated Press explainer on the Mann Act.

“The Mann Act” is often used as a broad name for the law, but Chapter 117 contains multiple offenses. Section 2421(a) is the general transportation provision at issue in Combs’s verdict. Section 2423 contains provisions specifically concerning minors and other illicit sexual conduct, with distinct rules and penalties. The Department of Justice’s Mann Act Criminal Resource Manual discusses those provisions, including rules concerning minors under 18.

Because the sections have different elements, it is important to identify the provision being discussed rather than treating every Chapter 117 offense as interchangeable or assigning § 2421(a)’s penalty to the entire chapter.
What the verdict does—and does not—establish
The jury’s verdict establishes that it found Combs guilty on two § 2421-related Mann Act counts and not guilty on the racketeering-conspiracy and sex-trafficking charges. The later district court opinion denied his motions seeking acquittal or a new trial. Those are the case outcomes supported by the court record; the verdict should not be restated as a conviction for charges on which the jury acquitted him.
Earlier statements about the case need to be read in their own procedural context. The Justice Department’s September 2024 announcement concerned charges, not a jury’s findings, and cautioned that indictment allegations are accusations and that a defendant is presumed innocent unless and until proven guilty. Its July 2025 verdict statement described the officials’ view that investigators and prosecutors prioritized a victim-centered approach; that characterization belongs to those officials, not to the jury or court.
