Brittany Moreland sought full legal and physical custody of her daughter with Marlon Wayans in 2024, while Wayans asked for joint custody in response. The latest case development located is TMZ’s report that Moreland filed papers to dismiss the case in June 2026. That report does not establish a current custody schedule or the terms of any agreement.

What Moreland requested in 2024

Entertainment Tonight reported on March 21, 2024, that court documents said Moreland had filed a California petition to determine a paternal relationship. She sought legal and physical custody of Axl, then 15 months old, and asked that Wayans receive visitation. The requests were proposals in a filing, not court rulings. Entertainment Tonight’s report also said Moreland requested pregnancy and birth expenses and legal fees.

What the reported figures mean

Entertainment Tonight described Moreland’s income and expense declaration as listing estimated monthly expenses of $22,080. It also reported her filing stated that Axl spent 95 percent of the time with Moreland and 5 percent with the other parent. Both figures reflect claims or estimates reported from her filing; they are not independently verified budgets or a court-established parenting schedule.

How Wayans responded

In July 2024, Wayans sought joint legal and physical custody and asked that pregnancy and birth expenses and legal fees be shared, according to Entertainment Tonight’s report on his response. A request for joint custody is not evidence that a judge granted it.

During the dispute’s public coverage, Wayans said he was voluntarily paying more than $18,000 per month in child support, according to remarks reported by Us Weekly and Entertainment Tonight. That was Wayans’s account of his payments, not a reported court-ordered amount. Entertainment Tonight quoted him reacting to the requested visitation arrangement: “Do you pay all that money per month and be called a ‘visitor’? Do the math. This is delusional.” That was his opinion, not a court finding.

What the latest report says about the case

TMZ reported on June 16, 2026, that Moreland filed papers to dismiss the custody case. The outlet said the matter had seen no updates for more than a year and suggested the parents may have resolved their issues, but that is not confirmation of a settlement. TMZ’s report does not disclose settlement terms, whether dismissal was with or without prejudice, or a current custody schedule.

What is—and is not—established publicly

Legal custody concerns decision-making; physical custody concerns where a child lives and parenting time. Moreland’s 2024 filing and Wayans’s response described what each parent sought. The reports cited here do not establish that a court granted either request. Nor does the reported 2026 dismissal filing, by itself, reveal the parents’ present arrangement or the legal effect of the dismissal.

Other details reported in connection with the case do not answer that question. For example, TMZ reported in May 2026 that court documents listed a daily rate of $1,246 for Axl’s appearance as “Princess Axl” in Hudson Avenue. That figure is employment-related context, not evidence of a custody ruling or schedule. TMZ’s account attributes it to court documents.

Wayans also stated publicly that he preferred to keep his daughter’s private life private. Entertainment Tonight quoted him saying: “All love, all God. The baby isn’t a secret. The mama has been posted. But I chose to keep the baby’s private life private.” That expresses his stated preference; it does not establish how much of Axl’s life has been kept private.
