Short answer: The Texas Second Court of Appeals ruled against Vic Mignogna in August 2022, affirming dismissal of his claims and related sanctions and fee determinations. It sent Monica Rial and Ronald Toye’s fee amount back for a new determination. But on December 30, 2022, the Supreme Court of Texas vacated both the appellate and trial-court judgments and remanded the case. The court records cited here do not establish a final post-remand fee amount.
What did the appeals court decide?
In Victor Mignogna v. Funimation Productions, LLC, Jamie Marchi, Monica Rial, and Ronald Toye, No. 02-19-00394-CV, the Texas Second Court of Appeals issued its decision on August 18, 2022. Mignogna challenged the dismissal of his claims and related sanctions and attorney-fee rulings; Rial and Toye separately challenged the amount of their fee award.
The appeals court affirmed the dismissal of Mignogna’s claims and affirmed the sanctions and fee determinations in relevant part. It also directed the parties to pay the costs of the appeal. Its ruling on the amount awarded to Rial and Toye was different: the court concluded that the amount was not supported by factually sufficient evidence and remanded that issue for redetermination. The opinion did not itself set a new amount.
How much had Rial and Toye sought?

The appellate court did not simply replace the trial court’s $100,000 award with the $282,953.80 requested. It returned the amount question for another determination.

What happened after the appeal?
On December 30, 2022, the Supreme Court of Texas granted Mignogna’s petition for review, vacated the appellate court’s judgment and the trial-court judgment, and remanded the case to the trial court. That later order changes the procedural endpoint: the August 2022 appeals-court ruling is not the final operative judgment.
The cited court materials do not establish the final attorney-fee amount, if any, entered after the Supreme Court’s remand. They therefore do not settle whether Mignogna ultimately has to pay additional fees or how much. A definitive current payment answer would require the subsequent Tarrant County trial-court docket and any later orders.
