That limit matters when reading the story alongside legal terminology. For a close reading, consult an edition of Till Death Do Us Part that includes “The Divorce”; the scholarly source identifies the collection, but the edition and contents have not been independently verified here.
Triple talaq and nikah halala are not interchangeable terms

In the Indian government’s 2021 factsheet, triple talaq refers specifically to talaq-e-biddat, described as a man pronouncing talaq three times. What Indian law says about instant triple talaq
The legal context here is India and concerns instant triple talaq, not divorce practices generally. In its 4 November 2021 factsheet, PIB says the Supreme Court’s majority judgment of 22 August 2017 set aside instant triple talaq as violative of Article 14. That is a summary of the judgment; it should not be extended to other forms of divorce or treated as a ruling on nikah halala.
PIB says Parliament passed the Muslim Women (Protection of Rights on Marriage) Bill in July 2019 and that the Act came into force retrospectively from 19 September 2018. The factsheet describes the Act as declaring instant triple talaq void and illegal, providing for imprisonment of up to three years, and including custody and subsistence-allowance provisions. The same factsheet says around 100 instances of triple talaq were reported between the 22 August 2017 judgment and the bill’s introduction on 28 December 2017. “Reported” is important: the figure is not presented as a comprehensive count. PIB also reports that cases fell by 82% within one year of the Act. The factsheet does not provide the underlying dataset or method, so this is a government-reported figure, not independently established evidence that the Act caused the decline.
After the 2017 judgment, Prime Minister Narendra Modi called it “historic” and said it “grants equality to Muslim women and is a powerful measure for women empowerment.” That is a political characterization attributed to the prime minister, not the Court’s legal holding.

What the 2025 paper says—and does not say—about nikah halala
Mohd Imran’s 2025 Cambridge Open Engage working paper frames nikah halala through religious interpretation, secular court decisions, and constitutional and legal controversy. It reports that petitions challenging its constitutionality were pending before the Supreme Court when the paper was posted. The paper was an early research output and was not peer reviewed at that time.
That dated account cannot establish the litigation’s status in 2026, and it should not be presented as a final judicial decision or definitive account of religious doctrine. Nor does it supply evidence that nikah halala is part of Devi’s story. Keeping that distinction in view prevents a legal debate from being read into a literary work without support from the text.

A careful way to read the story beside the legal context
- Begin with what the scholarly identification supports: the collection, the story title, and the names Kulsum and Arshad.
- Use the primary text to establish what happens and how the story represents divorce; do not infer plot or terminology from the title alone.
- When discussing Indian law, specify that the 2017 judgment and 2019 Act described here concern instant triple talaq, or talaq-e-biddat.
- Treat nikah halala as a distinct subject and date any account of its court challenges to the 2025 paper’s posting.
This approach allows a literary reading and legal context to inform one another without turning the story into a case report or treating separate practices as synonyms.
