Its presence is documented, but that fact alone does not explain what every person carrying it intended to communicate.
What the Gadsden flag depicts
The familiar design has a yellow field, a coiled rattlesnake and the motto “Don’t Tread On Me.” It is associated with South Carolina politician Christopher Gadsden and the Revolutionary period. The Smithsonian National Zoo likewise identifies Gadsden with the yellow-field flag and snake.
What is known—and uncertain—about its early history
Accounts connect the design to 1775, but the path from earlier rattlesnake imagery to the familiar Gadsden flag is not fully settled. A 1966 Congressional Record entry calls it the “Gadsden Flag First Marine Flag, 1775.” That is a later government description of the flag, not by itself proof that every detail of the design’s lineage is certain.
The flag’s Revolutionary-era association is meaningful historical context, but it should not be confused with a complete, uncontested account of its origin.

How the flag’s political meaning shifted
The warning “Don’t Tread On Me” has been taken up in different political settings. The historical account describes later use by the Tea Party and, at times, militia movements. Those uses changed the context in which the flag could be read; they do not establish one fixed meaning for everyone who displays it.
A flag’s public associations and an individual carrier’s reason for carrying it are separate questions. The symbol can identify a political tradition or stance in a particular setting without revealing a person’s full beliefs or purpose.

What the records establish about January 6
Accounts of the attack report that protesters flew Gadsden flags at the Capitol. A U.S. Department of Justice complaint provides a specific example: it says Kenneth Grayson carried a flagpole bearing a yellow Gadsden flag and describes investigators using Capitol security footage to track his movements inside the building.
That complaint documents one named individual and a described sequence of events. It is not evidence that every person carrying the flag entered the Capitol, shared Grayson’s actions, or had the same motive.

How the Smithsonian documented the attack
On January 7, 2021, Smithsonian National Museum of American History staff followed a rapid-response protocol to collect discarded ephemeral materials on the National Mall, including rally signs, posters and flags. The museum described the effort as part of documenting January 6 and its broader impact on American democracy. Its announcement does not identify a particular Gadsden flag among the items collected.
Anthea M. Hartig, the museum’s director, said: “The Jan. 6 attack on the Capitol, and on the foundation of the United States’ democratic republic, revealed the fragility of our political system.”

What the surviving evidence cannot tell us
The sources establish that Gadsden flags were displayed at the Capitol and document at least one person carrying one. They do not trace every flag to its maker or owner, identify every carrier, or establish each person’s intent. The historical record supports a careful conclusion: the flag’s presence is part of the documented scene, while the meaning of that symbol for any particular carrier must be assessed from evidence about that person—not inferred from the flag alone.
