Police received a 911 call at about 2:45 a.m. reporting a woman in the roadway near Villa Paul Restaurant, according to a police-based report by Patch. The Suffolk County District Attorney’s Office later said a passing motorist found Burack on the shoulder and called 911 at that time.
What did prosecutors allege about the collision?
In its October 20, 2025 announcement, the Suffolk County District Attorney’s Office alleged that at about 2:26 a.m. on June 19, Amanda Kempton was driving a 2004 Toyota Highlander westbound on West Montauk Highway near Springville Road when she struck Burack, who prosecutors said was walking westbound with a suitcase. The office further alleged that the suitcase became lodged beneath the vehicle.

Those details—including the time, vehicle, directions of travel, and sequence of events—are the prosecution’s account. They should not be treated as facts established by a court. Prosecutors said a passing motorist later discovered Burack and called 911.

Dylan Eckardt, whom Patch identified as a colleague who worked with Burack at Nest Seekers for nearly five years, remembered her as “an unbelievable agent” who “could handle herself in New York as well as the Hamptons.” He offered condolences to her family.
Burack’s friend Paulette Corsair told NBC New York, “This was an amazing person, loved by so many people,” and described her as “a genuine good person who did good and helped others.” Her destination that night was not established in the reports; prosecutors’ allegation that she was walking with a suitcase does not explain why she was on the highway or where she was going.

Was anyone arrested in the Hampton Bays hit-and-run?
Southampton Town police announced Kempton’s arrest on June 20, 2025. ABC7 reported the next day that Kempton, 32, of Virginia, was charged with leaving the scene of a motor vehicle accident in which a fatality occurred.
On October 20, 2025, the Suffolk County District Attorney’s Office announced that a grand jury had indicted Kempton on one count of Leaving the Scene of an Incident Resulting in Death, a Class D felony. The office said she was arraigned that day. District Attorney Raymond A. Tierney called leaving the scene of a fatal collision an additional harm in an already tragic situation; his statement that the defendant allegedly left Burack without rendering help was the prosecutor’s characterization, not a court finding.

The DA’s October 20, 2025 announcement said Kempton was due back in court on November 20, 2025. It described the charge as carrying a possible prison term of 2⅓ to 7 years if convicted. That was the potential penalty stated by prosecutors, not a sentence imposed.
The available official update establishes the indictment and scheduled court date, but not a later disposition. As of September 30, 2026, the sources cited here do not establish whether the case resulted in a conviction, acquittal, dismissal, or another outcome, or Kempton’s current custody status. The DA’s announcement states that an indictment is accusatory and that a defendant is presumed innocent until proven guilty.
