Renee and Elisha Herbert publicly criticized the 12-month jail sentence imposed on their brother, Eric Serge Herbert, after he pleaded guilty to offences linked to a coal-train protest near Newcastle in 2021. PerthNow reported that the sentence included a six-month non-parole period. The sisters described his actions as climate activism; NSW Police defended the penalty by pointing to the dangers of entering rail corridors.
Why was Eric Herbert jailed?
PerthNow reported that Herbert, then 22 and from the Sunshine Coast, pleaded guilty in Newcastle Local Court to obstructing a rail locomotive, attempting to hinder the working of mining equipment, and attempting to assist in obstructing a rail locomotive. The coverage connected the offences to a protest that stopped a coal train near Newcastle and said Herbert had filmed himself on the train. PerthNow’s November 2021 report said Magistrate Janine Lacy sentenced him to 12 months’ jail, with a six-month non-parole period. It also reported individual terms for the offences and the revocation of an earlier community corrections order. The available coverage does not include sentencing reasons or an official court record, so the magistrate’s rationale should not be inferred beyond what the report states.
PerthNow also reported that Herbert faced charges in the ACT at the time. That was a description of his reported status in 2021, not confirmation of his current legal position.
What did Renee and Elisha Herbert say?
PerthNow reported that Renee and Elisha shared criticism of the sentence on Instagram. Renee described her brother as courageous for opposing climate injustice and argued that authorities were silencing activists. The sisters’ characterization of his motives and of imprisonment’s effects was their stated view, not a court finding.

In a statement quoted by PerthNow, Renee said: “He is the courageous person we need to stand up against climate injustice.” She also said: “All he wants is justice and peace for the world like all of us.” 7NEWS reported that the sisters criticized his incarceration and shared information about a Brisbane rally in support of him. It also said Elisha compared people who knowingly break laws to pursue social change with Rosa Parks, Nelson Mandela and Martin Luther King Jr. That was her reported analogy, not a legal comparison or an endorsement by the court.
How did police and protest supporters differ?
The reports presented competing opinions about the sentence. Blockade Australia spokeswoman Rilka Laycock-Walsh criticized it as an overreach, according to PerthNow. NSW Police Assistant Commissioner Peter McKenna defended the penalty on rail-safety grounds. PerthNow quoted him saying police were taking “a zero-tolerance approach to those that want to infiltrate our rail network.”

7NEWS reported McKenna’s view that the maximum penalty was “commensurate with the level of danger and criminality we are now seeing … they’re entering rail corridors with moving trains, not just coal trains.” These comments explain the speakers’ positions; neither settles the legal merits of the sentence.

The contemporaneous coverage establishes what the outlets reported about the guilty pleas, sentence and public reactions at the time. PerthNow and 7NEWS both gave the Herbert sisters a combined Instagram following of 3.3 million in 2021; that dated figure is not a current follower count. The reports do not establish a later outcome for the ACT charges or provide an independent statistic comparing Herbert’s sentence with other cases.
