What did Kardashian and Jenner say in their declarations?
On March 11, 2026, TMZ reported that Kardashian and Jenner submitted sworn declarations in litigation addressing Ray J’s claim that they planned the tape’s release. Kardashian rejected the broader allegation that she and her mother planned its release, defrauded the public, and filed a fake lawsuit to attract attention. She wrote: “ [Ray J’s] claim that I had a plan with my mother and others to release a sex tape, defraud the public, and file a ‘fake’ lawsuit against the porn company that released it to ‘create buzz’ is a lie.” TMZ reported the declaration and its wording.

Jenner denied being in charge of the tape’s commercial exploitation and denied involvement in its creation or distribution. In her declaration, she said: “Defendant’s allegation that I was in charge of the release and commercial exploitation of my daughter Kim’s sex tape is absolutely false.” Her statement was also reported by TMZ.
What did Ray J’s lawyer accuse Kardashian of?
Howard King, Ray J’s lawyer, told Rolling Stone that Kardashian’s sworn statements were demonstrably false and could expose her to criminal perjury prosecution. King also invoked Kardashian’s interest in potentially joining the California bar, saying: “If Ms. Kardashian is so concerned about demonstrating to the State Bar that she possesses the requisite moral character to be admitted to the Bar, when and if she passes the bar exam, she should not be committing perjury.” Rolling Stone reported King’s statement.

That is counsel’s accusation and rhetoric, not a finding that Kardashian’s declaration was false or that perjury occurred. The sources reviewed report competing allegations and denials, not a court determination of the release story.
What is disputed about the tape’s release?
The tape was recorded in 2003 and released by Vivid Entertainment in 2007, according to the cited reporting. Ray J alleges that its release was planned and that a fake lawsuit was used to generate publicity. Kardashian and Jenner deny that account. The available reports do not independently establish who arranged the release. The Guardian summarized the dispute and the release timeline.

How does this fit into the separate lawsuits?
Kardashian and Jenner sued Ray J for defamation and false light in Los Angeles in October 2025, after his public statements alleging racketeering and a federal investigation. Separately, Ray J’s related cross-complaint alleges that Kardashian and Jenner breached a settlement by discussing the tape. Those claims are distinct from the March 2026 dispute over what Kardashian and Jenner said in their declarations. Court News Service reported on the defamation case.
A case tracker reported that the contract dispute was sent to arbitration and listed the defamation case for trial on March 6, 2028. An August 2026 report, however, said the judge denied Ray J’s anti-SLAPP motion and gave a May 2028 trial date. The dates differ, so the case is best described as proceeding toward a 2028 trial rather than assigning it a precise date based on these reports. Neither procedural update establishes which account of the tape’s release is true. Law360’s case tracker reported the arbitration and March date; People reported the August 2026 ruling and May date.
