Penthouse’s June 2002 issue featured topless beach photographs it identified as Anna Kournikova. Her representatives denied she was pictured. The magazine first stood by its identification, then apologized and acknowledged it had made a mistake: the woman in the photographs was Judith E. Soltesz-Benetton.
What was the dispute about?
The controversy concerned a Penthouse pictorial in the magazine’s June 2002 issue. Contemporary reports described the images as topless beach photographs presented as showing tennis player Anna Kournikova—not as evidence that she had posed for a nude spread.
On April 27, 2002, the Los Angeles Times reported that Octagon, Kournikova’s management agency, said the woman in the pictures was not her. Penthouse counsel Victor A. Kovner said the magazine had reviewed the images and was confident they showed Kournikova.
How did Penthouse correct the identification?
On May 8, the Los Angeles Times reported that Penthouse had apologized to Kournikova and to the woman pictured. The magazine said: “We deeply regret this unintentional error and offer our heartfelt apologies to both women…. We were wrong.” The report identified the woman as Judith E. Soltesz-Benetton and said the photographs had been taken seven years earlier.

British Vogue also reported on May 8, 2002 that Penthouse had apologized for featuring photographs of the wrong woman and acknowledged, “We were wrong.”
What did Kournikova seek?
The Los Angeles Times reported that Kournikova’s complaint sought more than $10 million in damages. That figure was a reported legal demand, not a court award or a finding about the magazine’s liability.
