A file being easy to find or labeled “free” does not prove it is authorized. Historical sources described Mp3skull as an unlicensed service, but they do not establish who operates any site currently using that name or whether a particular present-day listing is licensed.
When is a download from Mp3skull legal?
The key issue is whether the copyright owner authorized the specific file and download. Copyright owners generally have exclusive rights to reproduce and distribute their works. The U.S. Copyright Office states: “Uploading or downloading works protected by copyright without the authority of the copyright owner is an infringement of the copyright owner’s exclusive rights of reproduction and/or distribution.” U.S. Copyright Office, Copyright and Digital Files FAQ; see also Title 17, Section 106.
That rule does not mean every download is unlawful. A work may be offered with the owner’s authorization, or a statutory limitation or exception may apply. But the Copyright Office says authorization is a factual question. Original works fixed in a tangible form—including a computer file—are generally protected, so do not assume a song or film is free to copy unless there is clear information establishing that it is.
What is known about Mp3skull—and what is not
The available historical record warrants caution but does not identify the status of every current site, domain, or file bearing the Mp3skull name.

The RIAA’s 2015 account
In its 2015 Notorious Markets report, the Recording Industry Association of America (RIAA) described Mp3skull as an unlicensed service offering downloads and on-demand streaming of popular copyrighted sound recordings. The RIAA reported that copyright owners had sent notices concerning more than 3.3 million Mp3skull webpages since 2011, including 1.7 million URLs submitted by the RIAA. Those are the association’s historical figures, not a government count or a current audit.
The 2015 court complaint
A complaint filed by record labels in the Southern District of Florida on April 17, 2015 alleged that Mp3Skull indexed links to infringing recordings and encouraged free downloads. A complaint records plaintiffs’ allegations; it is not itself a court finding. The historical material does not establish whether a currently reachable site using the name is connected to that service, who operates it, or whether a particular current listing has a license.

Does downloading for personal use make it legal?
Not automatically. “Personal use” is not a blanket exemption from copyright. Fair use is evaluated case by case under four factors: the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality used, and the effect on the potential market or value of the work. U.S. Copyright Office, Fair Use FAQ and Index.
Noncommercial use may weigh in favor of fair use, but it does not decide the question. Songs and films are creative works, and copying a substantial portion may weigh against a fair-use finding. Whether an exception applies depends on the particular facts and legal analysis.

What could copyright infringement mean?
The Copyright Office says statutory damages may reach $30,000 per work infringed, and may rise to $150,000 per work if willful infringement is proven. An infringer may also be liable for the copyright owner’s attorney’s fees. These are possible remedies, not automatic fines imposed for every download. How to choose a lawful way to watch or listen
Use a service that is authorized to offer the specific title in the United States. The Copyright Office points readers to authorized online services for music, ebooks, and films and notes that unauthorized sources can carry risks beyond copyright issues. Before using a service, check that it offers the exact song or video with authorization and that its terms match what you need—streaming, a permanent download, or both. Availability and terms can vary by title and region, so a service’s general reputation or catalog is not proof that every specific file is authorized.

No. The Digital Millennium Copyright Act includes conditional protections for online service providers in certain circumstances and a notice-and-takedown process through which copyright owners can request removal.
