Tempo Music Investments filed the lawsuit in September 2024 in the U.S. District Court for the Central District of California. The complaint alleges that “Flowers” duplicates protected melodic, harmonic and lyrical elements of “When I Was Your Man.” Reuters reported that Tempo pointed to alleged similarities in melodies, bass lines, chord progressions and lyrics. Bruno Mars co-wrote “When I Was Your Man,” but he is not a plaintiff or a party to this case. Tempo’s lawyers were quoted in complaint-era reporting saying, “Any fan of Bruno Mars’ When I Was Your Man knows that Miley Cyrus’ Flowers did not achieve all of that success on its own.” That is advocacy by the plaintiff’s lawyers, not independent evidence or a court conclusion.
How does Cyrus’s legal team respond?
Cyrus’s lawyers dispute that the alleged similarities amount to infringement. In arguments reported in February 2026, they contended that the cited material includes commonplace or unprotectable elements and that the songs differ in their musical and lyrical expression. Cyrus’s legal team was quoted as saying, “No one owns these words, which are commonplace tropes in breakup songs.” The quote reflects the defense’s position; it does not determine whether any particular musical or lyrical element is protected or was copied.
What has the court decided—and what remains unresolved?
On March 18, 2025, the court denied a motion to dismiss based on standing. The order states: “For the reasons set forth below, the Court DENIES Songwriter Defendant’s Motion to Dismiss for Lack of Standing.” The issue was whether Tempo could pursue the claim based on the share it said it acquired from co-writer Philip Lawrence. The ruling allowed the case to proceed past that challenge; it did not decide whether “Flowers” infringed copyright, whether the songs are substantially similar, or whether Tempo will win. The latest located docket summary, updated August 24, 2026, reports that the defendants’ summary-judgment motion and both sides’ motions concerning expert evidence were argued on May 26, 2026, and taken under submission. Why has the dispute drawn attention?
The songs’ commercial success adds context to the news, but it does not establish copying. Reuters reported that “Flowers” had more than 1 billion Spotify streams when its September 2024 story was published; streaming totals change over time.
