CBS Studios investigated. Del Rio was fired and escorted from the lot on the same day the studio acted, according to published reports. The firing became public on October 9, 2025. CBS initially declined to discuss the matter in detail, later confirming that Del Rio had left the series.

The underlying allegation has not been described publicly in a sufficiently detailed, independently tested account. Lewis has not publicly set out her version of events or named Del Rio in a detailed statement. A social-media post in which she wrote that she was “moving forward in love and strength” was later deleted or expired, according to reporting.
Why did CBS fire David Del Rio?
The immediate reason was an internal CBS Studios investigation into the allegation. That is different from a criminal prosecution. An employer can decide that an employee’s conduct breached workplace standards or an employment agreement without prosecutors filing charges or a court determining criminal guilt.
CBS has not publicly explained its evidentiary standard, released its report, or provided a detailed account of how investigators reached their conclusion. Later reporting said CBS handled the investigations internally rather than using an independent outside investigator. The studio declined detailed comment, citing legal and confidentiality concerns.

Was David Del Rio charged with sexual assault?
The public reports reviewed for this article do not establish that Del Rio was arrested or criminally charged. They describe a workplace investigation and termination, not a publicly documented criminal case. It would therefore be inaccurate to write that he was convicted or to present the allegation as a proven offense.

Del Rio has denied the allegation. His attorney, Shawn Holley, later said that text messages and witness testimony would challenge the way the encounter had been characterized publicly. Those assertions came from Del Rio’s legal team and had not been tested in a public court proceeding as of the latest reporting.
Why was the investigation reopened?
After retaining Holley, Del Rio’s team reportedly gave CBS text messages and the names of possible witnesses. CBS then reopened or supplemented its review in November 2025. The later process reportedly included interviews with Del Rio and Holley, as well as additional people connected to the matter.
CBS completed that supplemental review in February 2026 but did not reverse the firing. Entertainment Weekly confirmed the outcome, while CBS again declined to provide a public account of its reasoning.
Some later reporting said the internal description of the matter shifted from “sexual assault” to “unwelcome sexual conduct.” That characterization was attributed to unnamed sources and has not been confirmed in a detailed public statement from CBS. The change in terminology should not be treated as a published finding about what happened.
What is the arbitration about?
On March 4, 2026, Del Rio initiated arbitration against CBS Studios. Holley said the claim would address what she described as false and misleading allegations that harmed Del Rio professionally and reputationally. She also said the case would rely on real-time text communications and other evidence.

Arbitration is a private process commonly used for employment and contract disputes. It is not the same as a criminal trial, and the existence of an arbitration claim does not prove that CBS acted unlawfully. Conversely, CBS’s decision to maintain the firing does not by itself establish that the alleged conduct occurred.
At the latest reporting available, no public arbitration ruling had decided whether the allegation was true, whether CBS’s process was defective, or whether the termination breached Del Rio’s contract. What happened to Billy Martinez on Matlock?
Del Rio had already filmed enough material to appear in the early part of Season 2. His final reported appearance as Billy was Season 2, Episode 7, “Prior Bad Acts,” which aired on December 4, 2025.
The series did not recast Billy. Instead, it wrote him out. The midseason story explained his absence through personal and family circumstances, including his girlfriend’s miscarriage and Billy’s decision to step away from the firm.
That storyline was a production solution to Del Rio’s departure. It was not presented on screen as an accusation that Billy had committed sexual misconduct, and viewers should not confuse the character’s exit with a fictional confirmation of the real-world allegation.
