Massachusetts Democratic Sen. Ed Markey introduced the Extend the TikTok Deadline Act on Jan. 15, 2025. The bill, S.103, proposed changing the statutory divestiture period from 270 days to 540 days. It was only introduced and referred to committee, so it did not itself extend the deadline or change the law.
What Markey proposed
Edward J. Markey, a Democrat who represents Massachusetts, sponsored S.103, formally titled the Extend the TikTok Deadline Act. The bill would have amended the Protecting Americans from Foreign Adversary Controlled Applications Act by replacing the words “270 days” with “540 days.” The proposed change would have given ByteDance, TikTok’s Chinese parent company, more time to complete a qualifying divestiture.
The measure did not repeal the divestiture requirement or create a new ownership arrangement. It sought only to lengthen the statutory period available for completing one.

What the 270-day deadline meant
The law did not simply make it a crime for individuals to use TikTok. It established restrictions on covered applications controlled by a foreign adversary unless the ownership condition was satisfied.

Divestiture condition
ByteDance would have to separate TikTok from foreign-adversary control through a transaction that met the statute’s requirements. A nominal sale or partial restructuring would not necessarily qualify.

What could happen without a qualifying sale
If the condition was not met, app stores and internet-hosting companies could face prohibitions involving the covered application, including distribution, updates or hosting in the United States. News reports commonly called the result a “TikTok ban,” but the statutory mechanism focused primarily on the companies that distribute and support the app.
Possible statutory extension
The original law provided a 270-day period, with a possible additional 90-day extension under specified conditions. Markey’s bill proposed changing the baseline period itself to 540 days. That was not a guaranteed grace period; it would have required passage by Congress and presidential approval.
Why the proposal arrived just before January 19
The statutory deadline was approaching on January 19, 2025, putting users, creators and businesses on a short timetable. Contemporary coverage described concerns about losing access to audiences, communities and income tied to TikTok. The timing also coincided with the Supreme Court’s review of a challenge to the law, creating a separate possibility that enforcement could be blocked or altered.

Markey had previously participated in legislative and legal debates concerning TikTok. His support for additional time was therefore notable: he was not arguing that privacy or youth-safety concerns should be ignored, but that an abrupt shutdown or forced loss of access raised other legal and economic issues.
Markey’s stated reasons
In Senate remarks and public statements, Markey presented the proposal as a way to address competing concerns. His arguments included:
- TikTok had significant privacy and youth-safety problems that still required action.
- Millions of users could be affected by a sudden loss of service.
- Creators, advertisers and small businesses relied on the platform for audiences and revenue.
- TikTok supported communities that users might not be able to recreate elsewhere.
- The law raised First Amendment and free-expression concerns.
These were Markey’s stated arguments, not findings established by the bill itself. Supporters of the underlying law continued to point to alleged data-security and national-security risks associated with foreign-adversary control.

Markey introduced S.103 with Sens. Ron Wyden and Cory Booker as original cosponsors. Sen. Chris Van Hollen joined as a cosponsor on January 16, 2025. The official Senate record identifies Democratic sponsors and cosponsors; it does not establish that the measure had broad bipartisan support.
A companion House measure, H.R.391, was introduced by California Democratic Rep. Ro Khanna on January 14, 2025. It contained the same proposed change from 270 days to 540 days and was referred to the House Energy and Commerce Committee.

Did Markey’s bill become law?
No. Congress.gov records show that S.103 was introduced, read twice and referred to committee. The record does not show passage by the Senate or House, or a presidential signature. The House companion likewise remained at the introduced-and-referred stage in the cited legislative history.
That distinction matters when interpreting headlines. Markey sought to extend the deadline; he did not extend it. Congress did not approve a 540-day period through S.103, and the bill did not by itself guarantee that TikTok would remain available.

Other ways the situation could change
Markey’s proposal was one of several legally distinct paths:
- Congressional action: The House and Senate would have to pass an extension, followed by presidential approval, before the statutory text changed.
- Judicial action: The Supreme Court could block, narrow or otherwise affect enforcement through the constitutional challenge before it.
- Executive implementation: An administration could make enforcement decisions, but those decisions would not be the same as Congress amending the deadline.
- Qualifying divestiture: ByteDance could seek a transaction that satisfied the statute, potentially avoiding the restrictions without a legislative extension.
These routes were separate. Markey’s bill could not take effect merely because it was introduced.
What the proposal meant for TikTok users
For users, creators and small businesses, the announcement signaled an attempt to create more time—not a completed legal reprieve. It did not immediately change app-store or hosting obligations, guarantee uninterrupted service, or determine whether any future sale would satisfy the statute.
