Larry David said he wished he could join the class action over FTX because some of his compensation for the company’s Super Bowl ad was paid in cryptocurrency—and he lost money when it collapsed. He was joking about his own loss, not saying he had become a plaintiff. In the same interview, he called his decision to make the ad a mistake: “So, like an idiot, I did it.”
What Larry David said about the FTX ad
David made the comments in an Associated Press interview at the Los Angeles premiere of the final season of Curb Your Enthusiasm. CBS News reported them on January 31, 2024. Asked about the commercial, David said he had consulted friends who knew the subject and was reassured it was okay to participate. David also said he would love to be part of the class action because part of his salary had been in crypto and he had lost a lot of money. The remark was self-deprecating: it described his reported financial loss, not a request to join the case or a claim that he had sued himself. CBS News
What the 2022 commercial showed
The FTX commercial aired during the 2022 Super Bowl. It cast David as a skeptic who rejects celebrated inventions and ideas before dismissing FTX, followed by a message urging viewers not to miss the next big thing. The class-action complaint described David as an FTX brand ambassador and alleged that the ad promoted the exchange. What the court had decided by May 2025
In an order dated May 7, 2025, the U.S. District Court for the Southern District of Florida addressed David’s request to dismiss remaining Florida and Oklahoma securities claims. The judge found a ruling on those two counts premature at that stage. The order also dismissed counts 2–12 and 14 without prejudice and allowed the plaintiffs to amend their complaint. This was a decision about what claims could proceed at the pleading stage—not a finding that David was liable, knew about FTX’s fraud, or would lose at trial. “Without prejudice” means the dismissed counts were not barred from being brought again in an amended pleading.

What is known about the case’s later status
