Justin Timberlake’s lawyer, Edward Burke Jr., said on July 26, 2024, that Timberlake was not intoxicated when police arrested him in Sag Harbor, New York. That was the defense’s position, not a court finding. Timberlake later pleaded guilty to a reduced, non-criminal charge of driving while ability impaired.
What Timberlake’s lawyer said
After a court hearing on July 26, 2024, Burke told reporters: “The most important fact to know about this case is that Justin was not intoxicated and should not have been arrested for DWI.” Burke also said police had made “a number of very significant errors in this case” and that the defense was confident the charge would be dismissed. Those remarks stated the defense’s view at that point in the case; they were not a judicial determination. CBS New York and Court TV reported Burke’s comments that day.
What police and court papers reportedly alleged
Timberlake was arrested shortly after midnight on June 18, 2024, in Sag Harbor. The Associated Press reported that the stop followed an alleged stop-sign violation and a concern about his lane position. According to the court papers described in contemporaneous reporting, an officer noted bloodshot and glassy eyes, an odor of alcohol, slow speech, unsteadiness and poor performance on standardized field sobriety tests. Reports also said Timberlake told the officer he had consumed one martini and that court papers said he refused a breath test. These are reported allegations and descriptions of records, not findings that should be conflated with Burke’s denial. The Associated Press’s June 18, 2024 report covered the arrest account.
How the case was resolved
On September 13, 2024, Timberlake pleaded guilty to a reduced, amended, non-criminal charge of driving while ability impaired. Burke said the plea was consistent with the defense’s account. Timberlake told reporters, “This is a mistake that I made, but I’m hoping that whoever is watching and listening right now can learn from this mistake. I know that I certainly have.” The plea is the later case outcome; the July statement that he was not intoxicated remains an earlier defense claim. ABC News reported on the plea and statements.

What the 2026 video report adds
In March 2026, the Associated Press reported that police video of the arrest had been released. Its account described Timberlake struggling with field sobriety tests and noted that the case had already been resolved.
