The John R. Cash Revocable Trust sued The Coca-Cola Company in federal court in Tennessee, alleging that a singer in a college-football ad sounded recognizably like Johnny Cash and was used without permission. Coca-Cola denies that the voice was Cash’s and denies infringement. The dispute over voice identification, endorsement and Tennessee’s ELVIS Act had not been resolved on the merits in the available case materials.
What the Johnny Cash estate says Coca-Cola did
The Trust filed John R. Cash Revocable Trust v. The Coca-Cola Company, No. 3:25-cv-01373, on November 25, 2025, in the U.S. District Court for the Middle District of Tennessee. The complaint alleges that Coca-Cola used a tribute singer’s performance in an advertising campaign and that the voice was readily identifiable and attributable to Johnny Cash. It says the ad included an original musical composition performed by the singer and that the Trust had not authorized the use. These are allegations, not findings by a court. Read the complaint.
The Trust’s lawyers at Loeb & Loeb identify the campaign as “Fan Work is Thirsty Work,” say it began airing in August 2025, and name Shawn Barker, a professional Johnny Cash impersonator, as the singer. What claims the complaint makes
The Trust brings three claims: violation of Tennessee’s ELVIS Act, violation of the Tennessee Consumer Protection Act, and false endorsement under Section 43(a) of the federal Lanham Act. It alleges that viewers could be confused into thinking Johnny Cash or the Trust endorsed Coca-Cola. The complaint requests damages, profits it says resulted from the alleged use, punitive or enhanced damages under the pleaded laws, and an injunction. Those are requested remedies, not amounts or relief awarded by a court. The complaint sets out the claims and requested relief.

Why the ELVIS Act is central
The complaint cites the ELVIS Act, Tennessee Code Annotated § 47-25-1101 et seq. A May 2026 report quotes the law’s definition of “voice” as a sound readily identifiable and attributable to a person, whether it contains that person’s actual voice or a simulation. In this case, the parties dispute whether the performance meets the relevant standard and whether the Trust holds the rights it asserts. The case materials available here do not establish a broader interpretation of the law or settle how it applies to a human tribute singer. What Coca-Cola says
Music Business Worldwide reported on May 14, 2026, that Coca-Cola filed an answer on May 8. The company denied that the singing voice was Cash’s and denied infringement. It acknowledged that the ad featured a male singing voice and that Coca-Cola caused the ad to appear on television, social media and online platforms. The company reportedly said the ad first aired during the 2025 college-football season and disputed the estate’s description of the performer as a “sound-alike singer.” These are positions reported from Coca-Cola’s answer, not a court’s conclusions. Coca-Cola also raised defenses reported as lack of standing, First Amendment protection and preemption of state-law claims. The available materials do not show that a judge accepted those defenses.

Where the case stood in the available docket
A Justia docket mirror records Coca-Cola’s May 8, 2026 answer and lists a jury trial for December 7, 2027. It also lists discovery due March 31, 2027, amended pleadings due July 3, 2026, and dispositive motions due July 12, 2027. The mirror says its docket report was last retrieved May 20, 2026. It therefore does not verify later filings or schedule changes through October 8, 2026. See the Justia docket mirror.
Accordingly, the available record supports describing the case as an active dispute with no reported merits ruling, but not treating those schedule entries as a confirmed live calendar. The procedural posture could have changed after the mirror’s retrieval date.

What remains unresolved
The central factual questions are whether the performance is legally attributable to Cash’s voice under the law the Trust invokes, whether the Trust can establish the rights it claims, and whether the ad conveyed an endorsement in a way that supports the pleaded claims. Coca-Cola disputes the key voice-identification allegation. The available materials do not show a judicial answer to those questions.
Tim Warnock, a lawyer for the Cash estate, told The Guardian: “Stealing the voice of an artist is theft. It is theft of his integrity, identity and humanity.” That is the plaintiff’s counsel’s advocacy, not a finding about Coca-Cola’s conduct. The Guardian’s report.
