Jason Patric and Danielle Schreiber’s dispute over their son Gus involved two separate legal questions: whether Patric could be recognized as Gus’s presumed father, and whether the court could order joint custody under California’s domestic-violence presumption. In 2017, a California appeals court affirmed Patric’s presumed-father status but reversed the joint-custody order on a separate evidentiary issue. The ruling did not erase his parentage status or settle every later custody question.
What was the dispute about?
Gus was conceived through IVF using Patric’s sperm. The central disagreement was whether Patric had participated only as a sperm donor or had taken on a parental role that could give him legal status as Gus’s presumed father.
Schreiber’s position, as reported by ABC News in May 2014, was that Patric offered his sperm on the express condition that he would not be a father and would have no parental rights or responsibilities. Patric’s account, presented in contemporaneous ABC interview coverage, was that he had acted as Gus’s father. What did the courts decide?
The 2014 ruling let the parentage question proceed
In 2014, an appellate court allowed the question of presumed parentage to go forward. Its analysis considered whether the statutory rule for sperm donors applied in these circumstances, along with evidence about Patric’s conduct and relationship with Gus. It was a procedural ruling allowing the parentage claim to proceed—not a final custody award. California Court of Appeal, 2014.

The 2017 ruling affirmed presumed-father status and reversed joint custody
In 2017, the California Court of Appeal affirmed the determination that Patric was Gus’s presumed father. Separately, it reversed the joint-custody order because the trial court had not received evidence that Patric and Schreiber had completed the counseling required to rebut the custody presumption under California Family Code section 3044. The opinion recounted a finding of inappropriate verbal harassment and disturbance of Schreiber’s peace. It also stated there was insufficient evidence of physical violence and noted that the trial judge expressly rejected a finding of physical violence. That description should not be recast as a finding of physical abuse.

Why parentage and custody are not the same thing
Presumed-father status addressed Patric’s legal parentage; custody concerned the separate question of what parenting arrangement could be ordered. The 2017 decision illustrates the distinction: the court upheld the parentage determination while reversing the joint-custody order because of a problem with the evidence required under section 3044. Neither ruling, on its own, establishes the full details of any later custody arrangement.
