To run a merch giveaway responsibly, publish clear official rules before entries open, make the entry method easy to understand, disclose that the platform does not sponsor the promotion, and plan how you will select, contact, and deliver the prize. Twitch and YouTube have different requirements, and local laws vary—check the rules that apply where you and your entrants are located before launch.
Start with the rules, not the announcement
Write the official rules before you mention how viewers can enter. They should describe a promotion you can actually administer and fulfill. Twitch makes the streamer responsible for the promotion; YouTube requires contests to follow applicable laws and to be run and awarded as stated in the rules.
- Organizer: identify the person or organization running the giveaway.
- Dates: give the opening and closing date, time, and time zone.
- Eligibility: state age and residency requirements, exclusions, and any guardian process for minors.
- Entry: explain the free entry action, entry limit, and conduct that can disqualify an entrant.
- Prize: describe the merchandise, number of prizes, available sizes or variants, any substitutions, and delivery area. Include an approximate value if useful.
- Winner process: say whether selection is random or judged, explain judging criteria if relevant, and give the notification method, response deadline, and alternate-winner procedure.
- Fulfillment and privacy: state who pays shipping, where the prize can be delivered, what information you will collect from a winner, and how it will be used.
- Platform disclaimer: make clear that Twitch or YouTube is not sponsoring the giveaway, as applicable.
Link to the rules wherever viewers encounter the entry instructions, and keep a copy of the final rules and announcement. Do not promise a delivery destination, product option, or deadline until you have confirmed you can meet it.
How do I run a merch giveaway on Twitch?
Twitch treats the streamer as the promoter. You are responsible for compliance with applicable law, official rules, administration, winner selection, issuing the prize, and any required permissions, registrations, or bonds. Twitch may remove a promotion it reasonably believes violates its terms or the law. Its Terms of Service require this disclaimer when promoting, administering, or conducting a promotion:

“This is a promotion by [Your Name]. Twitch does not sponsor or endorse this promotion and is not responsible for it.”
Display or read the disclaimer as required, and provide the official rules before entry begins. For sponsored content, Twitch separately says creators must use its Branded Content tool and comply with advertising requirements. Its help guidance says enabling the tool automatically shows an “includes paid promotion” disclosure. Whether a particular brand arrangement counts as branded content depends on the arrangement and current guidance; do not assume every brand mention is treated identically.
How do I run a merch giveaway on YouTube?
YouTube requires a contest to comply with relevant federal, state, and local laws, and its contest rules must explain the promotion accurately. YouTube’s official contest policy also requires that your rules link to the YouTube Community Guidelines, include required legal disclosures and a legally compliant privacy notice, state that YouTube is not a sponsor, and release YouTube from contest liability. Do not suggest that YouTube is involved in or endorses the giveaway without written consent.
You must conduct the contest and award the prize as your rules specify. YouTube describes its contest-policy page as informational, not legal advice; it does not replace checking the laws that apply to your promotion.

Can viewers enter for free?
On YouTube, yes: entry must be free. YouTube also prohibits manipulating views, likes, dislikes, or subscriber metrics to misrepresent genuine engagement. Do not make an engagement metric the mechanism for entering or make rules that encourage artificial activity.
In the United States, FTC guidance warns that sweepstakes requiring a purchase are illegal. State requirements may also include disclosures, licensing, or bonds, and vary by jurisdiction. Do not assume that asking viewers to subscribe, donate, or buy merchandise is a safe entry condition. Check the applicable law before choosing mechanics, especially if entrants may be in more than one jurisdiction.
Choose a prize you can deliver
Pick merchandise that fits your channel and that you can supply in the promised quantity, variants, and delivery area. Before announcing it, check sizes and availability, packaging and shipping costs, delivery timing, and whether you can provide genuine channel branding. A general apparel item is not the same thing as custom-branded channel merchandise, so describe the actual prize rather than implying it is custom-made.

A Twitch-hosted set of official rules for a 2023 promotion is one example of how specific a prize description can be: it listed six winners, each receiving a merchandise bundle of 14 clothing items with an approximate retail value of $535 per prize, and limited delivery to the United States or Canada. Those figures describe that promotion only; they are not a standard budget or benchmark.
Set eligibility, entry, and winner selection
Define who can enter
Specify residency and age limits, exclusions such as people involved in running the promotion, and any guardian process for minors. Make geographic restrictions visible before entry. Do not advertise worldwide eligibility if shipping, restrictions, or fulfillment make that impractical.
Make entry unambiguous
State the one action that counts as an entry, how many entries each person may submit, when an entry is valid, and what disqualifies it. Keep it free on YouTube and avoid mechanics that manipulate platform engagement. If entry rules differ by platform or location, explain those differences plainly.

Explain how a winner is chosen
For a random drawing, say when it will occur and how the eligible entries will be included. For judged entries, disclose the criteria and selection process. State how and when you will contact the winner, how long they have to respond, and what happens if they are ineligible, cannot receive the prize, or do not respond. A Twitch official-rules example uses a drawing, random selection, notification channels, and successive contact attempts; use such details only if they fit your own process and rules.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Contact the winner and handle shipping privately
Collect only the information needed to contact the winner and deliver the prize. Tell entrants in the rules how winner information will be used, and include the privacy notice YouTube requires when running a YouTube contest. Never ask a winner to post a home address or other sensitive details in public chat. Arrange those details privately, and confirm the delivery area and shipping responsibility in the rules before the giveaway opens.
Keep a record of the published rules, announcement, selection process, winner contact, and delivery confirmation. This helps you demonstrate that you administered the promotion as promised.

Check legal and sponsorship obligations before going live
Requirements can vary by country, state, and locality. FTC guidance is a US-level orientation, not a complete legal checklist: it notes that states may require disclosures, licensing, or bonds. The available platform guidance does not settle state-by-state thresholds, tax treatment for a particular prize, or international eligibility rules. If those questions affect your promotion, verify them for the places involved or seek qualified legal advice.
If a brand provides merchandise or other value in exchange for promotion, disclose the relationship where required. FTC guidance explains that free products or other value exchanged for promotion can trigger endorsement rules; an incentive such as contest entry may matter if it affects how viewers assess an endorsement. For Twitch sponsored content, also check its current Branded Content tool guidance.
Or let it run in the cloud
If your giveaway is part of a YouTube stream built from uploaded video, StreamNeo can keep that stream running from the cloud: upload your recording or build a playlist, add your YouTube stream key, and go live. Nothing needs to stay on at home. Any quality up to 4K 60fps streams as uploaded at one price per slot, and StreamNeo automatically recovers if YouTube drops the stream. The first day is free with no card, and monthly billing is $9.99 per month. StreamNeo plays uploaded videos on YouTube; it does not stream from a camera. Start your free day on StreamNeo.
