How to Escalate a Public-Service Complaint When the First Agency Does Not Resolve It

When a public agency’s first response does not resolve your complaint, use its formal review stage, document the unresolved issue and choose the independent body with jurisdiction. This guide explains the process, deadlines and country-specific examples.

Start by using the agency’s formal review process, not by sending the same complaint to a random oversight body. Confirm that your complaint has a reference number, identify exactly what remains unresolved, ask for the next internal stage, and then approach the independent ombudsman, tribunal, appeal body or other reviewer with jurisdiction over that service. Keep every date and check the external deadline separately: an internal review may not stop the clock.

The correct route depends on the country, agency, service and what you are challenging. Poor complaint handling, an underlying administrative decision and a statutory appeal can be separate matters. The examples below cover UK central government, Australian Commonwealth and Victorian services, and New Zealand; use your own agency’s procedure and decision letter for the controlling rules.

First identify what is actually unresolved

“The agency did not fix my complaint” can describe several different disputes. Before escalating, write one sentence stating which of these applies:

  • Complaint handling: the agency missed its stated time, failed to investigate, ignored evidence, gave no reasons or did not follow its own complaints procedure.
  • The underlying decision: you believe a benefit, licence, visa, penalty, housing decision or other administrative decision was wrong.
  • Both: the process was defective and the decision remains disputed.
  • A specialist subject: the matter is covered by a sector regulator, tribunal, statutory appeal or special route named in the agency’s policy.

An ombudsman can often examine maladministration or complaint handling, but an ombudsman complaint does not automatically replace an appeal. If the decision letter gives an appeal, reconsideration or tribunal deadline, treat that as a separate right unless the responsible body confirms otherwise.

The five-step escalation path

1. Confirm that the formal complaint was received

Find the agency’s published complaint procedure and the acknowledgement or response. Record the complaint reference number, the date submitted, the person or team handling it and the deadline the agency gave you. If there is no acknowledgement, ask the agency to confirm whether the matter is in its formal process and request a reference number.

The Commonwealth Ombudsman’s complaint instructions say to raise a formal complaint with the agency first, retain its reference number and date, and follow up when the agency has not responded within its published timeframe. A telephone conversation can be useful, but send a short written confirmation so the record does not depend on memory.

2. Define the unresolved issue and the remedy you want

Do not merely say that you are dissatisfied. State what happened, which parts of the reply you dispute, what evidence was overlooked and what outcome would resolve the matter. A remedy might be a corrected record, a fresh decision by an uninvolved officer, an explanation of the policy applied, a payment or service correction, an apology, or a review of the complaint handling. Ask only for outcomes the agency or reviewer has authority to provide.

UK central-government complaint guidance emphasises clarifying the issues, the outcome sought, the process and likely timescales. Use a compact chronology: date, event, document and consequence. Explain any practical effect, such as a missed payment, loss of accommodation or inability to access a service, without exaggerating it.

3. Ask for the next internal stage

If the first response is unsatisfactory, ask the agency how to have the complaint reviewed under its procedure. Use the agency’s label—often “Stage Two,” “internal review,” “senior review” or “reconsideration”—rather than inventing a route. Ask who will decide it, whether that person was involved in the original response, what issues will be examined and when you should expect a decision.

The Commonwealth Ombudsman advises discussing dissatisfaction with the agency before contacting the Office. In Victoria, Ombudsman guidance describes internal review followed, where appropriate, by external review. Completing a required internal stage can determine whether an external body will accept your case.

4. Choose the independent body that covers this service

After the required internal steps, identify the body with jurisdiction over the specific agency and subject. It might be an ombudsman, a public-service complaints commissioner, a tribunal, a regulator, a ministerial review channel or a court. Read its eligibility rules and referral instructions; names that sound similar can have different powers.

Some bodies accept a person’s complaint directly. Others require a referral by a legislator, lawyer or the agency, or require a final internal response first. Submit the final response, your chronology, the original decision and a focused explanation of what remains wrong. Do not assume that sending material to one oversight body preserves a deadline for another.

5. Check every deadline and preserve the record

Ask the external body, in writing if possible, what time limit applies and when it starts. Check whether the limit runs from the event, the agency’s final response or the date you became aware of the problem. An internal review does not necessarily pause an external deadline.

Keep a folder containing the original complaint, acknowledgement, reference number, every response, attachments, call notes, screenshots and proof of submission. Name files with dates and keep the version you sent. If a deadline is close, file the required notice or appeal first and explain that an internal review is continuing only if the rules permit it.

Internal review and external review are not the same

Question Internal review External review or appeal
Who decides? An agency officer or team designated by the agency’s procedure; ask whether they were involved originally. An independent ombudsman, tribunal, regulator or other body with a defined jurisdiction.
What is examined? Usually the complaint response, process and sometimes the underlying decision, according to the agency’s rules. Depends on the body: maladministration, legality, merits, procedural fairness or a specialist statutory issue.
Must internal steps be completed? This is the agency’s own stage. Many bodies expect a final agency response; some exceptions allow direct access.
How do you apply? Follow the agency’s Stage Two, review or reconsideration instructions. Use the body’s form, portal, legislator referral or statutory notice exactly as required.
What can happen? The agency may uphold, vary or explain its response, reopen enquiries or refer the matter. The body may recommend action, investigate, set aside or remake a decision where empowered, or dismiss a matter outside its jurisdiction. Powers differ.
What is the deadline? The agency’s published timeframe. A separate limit set by the external body or statute; confirm it rather than assuming the internal timetable applies.

UK central-government example

UK central-government complaints illustrate why an agency’s own stages matter. The government’s complaints-management guidance describes an initial response followed, if the complainant remains dissatisfied, by a Stage Two complaint reviewed by a Stage Two complaints team. The agency should explain how to proceed when it gives a verbal or written response. The guidance states: “When any verbal or written response to the complaint is provided, the complainant must be informed about how they can take forward their complaint if they are not satisfied with the reply.”

After the second response and completion of the full internal process, the guidance says a complainant can ask their Member of Parliament to refer the case to the Parliamentary and Health Service Ombudsman. That is a route for the UK central-government example, not a universal rule for every public service. The same guidance identifies special routes and exceptions, including particular arrangements for some detention-related complaints and other specialist matters.

The Public Service Ombudsman’s guidance says that, for a complaint about a UK government department or public organisation, the person needs to make the complaint to an MP within one year of becoming aware of the problem. Treat this as a jurisdiction-specific rule: check the current requirement, exceptions and the actual date calculation for your case. If you are challenging the decision itself, also read the decision letter for any statutory appeal or tribunal route.

Australian routes: Commonwealth and Victoria

Commonwealth services

The Commonwealth Ombudsman’s “How to make a complaint” instructions put the agency first. Make a formal complaint, record the reference number and submission date, and follow up if the published response time passes. Discuss your dissatisfaction with the agency before approaching the Ombudsman. Its guidance captures the next step in plain language: “Step 3: If your issue remains unresolved, contact the Office.” The sentence is from the Commonwealth Ombudsman’s complaint instructions.

When contacting the Office, show that you used the agency’s process and identify the remaining defect. Attach the agency’s response and explain whether you seek correction of handling, reconsideration of a decision or another remedy. The Ombudsman’s jurisdiction and available outcomes depend on the service involved.

Victorian services

Victorian Ombudsman guidance describes a sequence of internal review followed, where appropriate, by external review. Ask the agency for the review stage specified in its procedure and wait for the required response unless the Ombudsman’s rules provide an exception. Then check that the Victorian Ombudsman covers the agency and issue, and that you are within its time and eligibility requirements.

Do not transfer a Commonwealth deadline or procedure to Victoria. Even agencies performing similar functions can have different review powers, forms and time limits.

New Zealand: the agency-first rule has exceptions

Ombudsman New Zealand generally advises trying the agency first. Its public guidance says: “After you have complained to an agency, if you are not happy with their response, you can make a complaint to us.” That sentence is from Ombudsman New Zealand’s “How to make a complaint” guidance.

The same guidance notes exceptions, including some complaints about delays or decisions on official-information requests and direct access for children and young people. Therefore, check the exception before waiting for a final agency response. For any other subject, submit the agency complaint and its response, explain what remains unresolved and confirm the Ombudsman’s jurisdiction and deadline.

How to write the escalation request

A short, indexed submission is easier to review than a long narrative. Use headings that match the agency’s procedure and attach only material relevant to each point.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Request: name the internal review or external body you are asking for and identify the reference number.
  2. Issue: state whether you challenge complaint handling, the underlying decision, or both.
  3. Chronology: list the key dates in order, with document names.
  4. Unresolved points: quote or paraphrase the specific parts of the response that do not answer your complaint.
  5. Evidence: identify each attachment and the proposition it supports.
  6. Outcome sought: state the practical remedy or explanation you want.
  7. Deadline information: note any approaching appeal or referral date and ask the recipient to confirm how it applies.

Keep the tone factual. Avoid allegations about motives unless you have evidence; reviewers need the decision, the rule or process, the facts and the effect. If someone is helping you, include written authority where the body requires it.

When the complaint concerns the decision itself

Ask the agency or decision letter which mechanism applies: reconsideration, merits review, statutory appeal, tribunal, judicial review or another specialist process. A complaint may prompt an explanation or expose a process failure, but it may not change the legal decision. Conversely, an appeal body may examine the merits while having no power to investigate discourteous correspondence or delay.

Where both tracks are available, protect both rights. File the appeal or review application within its deadline, then explain that a complaint about handling is also proceeding if the rules allow parallel action. Ask whether one body will defer to the other. Never withdraw an appeal merely because an agency promises to “look into” the complaint unless you understand the legal consequence.

Common escalation failures and fixes

The agency says the complaint is closed

Request the written final response and the procedure’s next-stage instructions. If the agency has not addressed a material point, list it precisely and ask whether the review will reopen that issue.

No response arrives

Send a dated follow-up quoting the reference number and the published timeframe. Ask for a status update and a new expected date. Preserve proof of delivery; an unexplained delay may itself be relevant to an external complaint.

The external body rejects the case

Read the rejection reason. It may be the wrong jurisdiction, an incomplete internal process, a missed deadline, a statutory appeal that must be used, or a matter outside the body’s powers. Correct the defect if the rules permit; otherwise use the identified specialist route promptly.

The submission is too broad

Separate each decision, date and remedy. A reviewer can usually act only on matters within its jurisdiction and may close a submission that combines unrelated services or events.

A deadline is imminent

Contact the responsible body immediately and ask what filing preserves your position. Do not rely on an agency employee’s informal assurance that the deadline will be extended. Keep evidence of every request for an extension or clarification.

What the available evidence can—and cannot—show

The Commonwealth Ombudsman’s 2014 report, Complaint management by government agencies, recorded responses from 111 agencies about whether a complaint outcome could be reviewed: 94 said review was allowed, 12 said it was not and 5 said the question was not applicable. This was a historical agency survey, not a success rate for complainants and not proof that every agency currently offers review. No current, cross-jurisdiction statistic establishes how often escalations succeed.

Quick Recap

Decision checklist before you submit

  • Have you identified the agency’s formal complaint and review stages?
  • Do you have the reference number, submission date and final response, or evidence that the agency missed its deadline?
  • Have you separated handling defects from a challenge to the underlying decision?
  • Have you checked whether a tribunal, appeal body, regulator or specialist route is mandatory?
  • Does the external body cover this agency, service and geography?
  • Have you confirmed the referral method and deadline independently?
  • Can a reviewer see your requested remedy and the evidence supporting it?
  • Have you kept copies of everything submitted?
