How Peter Thiel and Hulk Hogan Broke Gawker: The Lawsuit, Verdict and Bankruptcy

Peter Thiel funded Hulk Hogan’s privacy lawsuit against Gawker. The $130 million jury award was later settled for $31 million, and the litigation drove Gawker Media into bankruptcy.

Peter Thiel did not single-handedly cause every problem that brought Gawker down. But his financing helped Hulk Hogan pursue a privacy lawsuit that ended in a $130 million jury award, and the litigation ultimately drove Gawker Media into bankruptcy. The company later settled with Hogan for $31 million and closed its flagship site, Gawker.com.

Why did Hulk Hogan sue Gawker?

In 2012, Gawker published an edited excerpt from a leaked video showing Terry Bollea, the wrestler known as Hulk Hogan, in a sexual encounter. Hogan sued over the publication on privacy-related grounds, not defamation. The Associated Press reported that the encounter involved the wife of Hogan’s then-best friend and that Hogan maintained he did not know he was being recorded. AP’s retrospective describes the dispute as a clash over the publication of intimate material.

Gawker argued that its publication was protected by the First Amendment and had news value. The jury did not accept that argument in these circumstances. That outcome did not establish that celebrity privacy always outweighs newsworthiness, or that truthful reporting about public figures is generally unprotected.

How did Peter Thiel become involved?

Thiel publicly acknowledged financing Hogan’s lawsuit. The Guardian reported in 2016 that the funding was about $10 million. Thiel said it was “less about revenge and more about specific deterrence.” That is Thiel’s description of his purpose, not an independently established account of his motives.

The funding had a history: Gawker had published a story about Thiel in 2007. Thiel also said, “I saw Gawker pioneer a unique and incredibly damaging way of getting attention by bullying people even when there was no connection with the public interest.” The Guardian reported those comments in 2016. The bankruptcy court acknowledged Thiel’s funding of the Bollea case, but described claims that he funded other lawsuits against Gawker as speculation based on press reports—not as established fact in its opinion.

What did the jury award, and how much did Hogan ultimately receive?

In March 2016, a Florida jury found Gawker liable and awarded Hogan $115 million in compensatory damages and $15 million in punitive damages—a total of $130 million. Those are the jury’s original award amounts, as recounted in a 2017 opinion from the U.S. Bankruptcy Court for the Southern District of New York. They are not the amount Gawker ultimately paid.

In November 2016, Gawker agreed to pay Hogan $31 million in cash, abandon its appeal and settle the litigation. Bloomberg Law reported that the agreement also included a share of creditor proceeds. Two related lawsuits settled for $500,000 and $750,000, respectively; those were separate settlements, not components of the jury’s award to Hogan.

Why did Gawker go bankrupt?

After the verdict, Gawker failed to obtain relief from the judgment and a stay of enforcement. Gawker Media LLC filed for Chapter 11 bankruptcy on June 10, 2016. The bankruptcy court later said the Bollea litigation “ultimately drove the Debtors into bankruptcy.” That makes the case a direct cause of the filing, even though the company also faced other lawsuits and made strategic choices under the pressure of bankruptcy.

In November, Gawker Media’s assets were sold out of bankruptcy to a Univision unit for $135 million, and Gawker.com closed. The asset sale was a bankruptcy transaction; it was distinct from the $31 million settlement with Hogan.

What the case says about privacy and press freedom

The central tension was between a person’s interest in keeping intimate details private and a publisher’s freedom to publish material it considers newsworthy. In this case, the jury found Gawker liable over its publication of the video excerpt. That verdict should not be mistaken for a rule that privacy claims automatically defeat the First Amendment.

AP quoted University of Iowa law professor Samantha Barbas saying the case helped start a trend of libel and privacy lawsuits being weaponized to take down media organizations. That is Barbas’s assessment, not a court finding or a measured statistic about the case’s effect on journalism.

Brooklyn Law School professor Amy Gajda told AP that more people, including judges, now understand that someone can sue over the publication of truthful material when it is deeply personal and its publication highly offensive. She also stressed that media retain broad protections when material has news value. The practical lesson is not that every intimate story is unlawful: context and newsworthiness still matter.

Why “Thiel broke Gawker” is shorthand

Thiel’s financing enabled Hogan’s lawsuit to proceed, and the verdict created a severe liability and enforcement risk. The bankruptcy court’s account supports the narrower, consequential claim that the Bollea litigation drove Gawker into bankruptcy. But “Thiel broke Gawker” compresses that sequence into a personal-causation story: it leaves out the jury’s decision, the company’s other legal exposure, and the choices made under bankruptcy pressure. Nick Denton, Gawker’s founder, said of the settlement, “The saga is over.” He also explained: “All-out legal war with Thiel would have cost too much, and hurt too many people, and there was no end in sight.”
