Start by obtaining permission from the property owner or an authorized representative, then record that permission in a signed location agreement or release. The document should identify the premises, production, filming and access dates, intended use of the footage, and practical arrangements such as preparation, parking, cleanup, restoration, fees and insurance.

Permission from the owner and a government film permit are separate questions. Ask the owner what is required for access, then contact the relevant city film office, permitting authority or property-owning agency. A shoot that is entirely on private land may be exempt from a municipal film permit in one jurisdiction but require a permit when vehicles, crew or equipment affect a sidewalk, street or other public space.

Permission and a permit are not the same thing

A location agreement is the property-side authorization to enter and film. A permit is approval from a government or institutional authority for regulated filming activity. You may need one, both or neither, depending on ownership, the physical footprint of the production and local rules.

The Texas Film Commission gives a useful illustration: when filming is entirely on private property, a film permit is not needed, but permission from the owner in the form of a valid location agreement is required. If vehicles, crew, equipment or other production activity impedes access to public space, a municipal permit is also required. Do not treat the Texas rule as universal; it is an example of how the two approvals interact.

Find the person who can actually authorize the shoot

Begin with the exact address and the entity that controls access. That may be an individual owner, a company, a property manager, a location representative, a public agency or an institution. A tenant, caretaker or manager who offers access is not automatically entitled to grant the filming and footage-use rights you need.

Ask the proposed signer to confirm their authority. Documentary release guidance from Into Film addresses the owner or the person entitled to enter the agreement for the owner. Institutional guidance similarly refers to an owner or authorized representative. If ownership is shared, leased, managed by a corporation or subject to an institutional license, identify who must sign and whether another approval is required.

Give the owner enough information to make an informed decision

Before negotiating, provide a short production brief:

Put the deal in a written location agreement

A handshake or email saying “that should be fine” is difficult to interpret when the schedule changes or a finished film is distributed years later. Use a location agreement or release signed before access. A sample documentary form is a drafting aid, not a universal legal template; have counsel adapt it when the location, rights or risk warrants legal advice.

Core terms to address

  • Grantor and authority: Name the owner or authorized entity and identify the person signing on its behalf.
  • Premises: Describe the address, buildings, rooms, grounds and any excluded areas. Attach a plan or photographs if boundaries could be disputed.
  • Production: Identify the documentary or production company and the nature of the project.
  • Access window: State preparation, filming, reshoots, strike and cleanup dates and hours, not just the principal photography day.
  • Permitted activities: List interviews, scene work, lighting, sound recording, equipment placement, vehicles, parking and temporary staging.
  • Footage and appearance: State how the location’s image, name or appearance may be used in the film and related distribution. Ensure the signer has authority for the rights being granted.
  • Payment: Record any location fee, deposit, reimbursement or in-kind arrangement, along with when it is due.
  • Changes and cancellation: Set a process for rescheduling, weather delays, cancellation and additional days.
  • Damage and restoration: Define inspection, responsibility for damage, cleanup standards and the deadline for returning the premises.
  • Insurance: Specify required policies, limits, certificates and additional-insured wording, and when documents must be delivered.
  • Owner access and restrictions: Record areas the owner may enter, privacy or noise limits, prohibited activities and any supervision requirement.

These clauses are matters to negotiate, not a claim that every jurisdiction makes each one mandatory. The important point is to convert the agreed practical terms into a document both sides can consult.

Ask about insurance before anyone arrives

Insurance requirements come from the owner, a permitting authority or both. Ask specifically whether the owner wants a certificate of insurance, additional-insured status, workers’ compensation evidence, a particular endorsement or other documentation. Deliver the documents before access if that is the condition of entry.

The City of Kamloops advises property owners to negotiate directly with the production and recommends receiving insurance documentation before granting filming access. Its guidance also says an owner may request to be named as an additional insured and receive the certificate before production starts.

Government-property requirements can be more prescriptive. California Film Commission guidance for state-property still photography, film, digital or new-media work without automobiles describes general liability of at least $1,000,000 per occurrence, a separate additional-insured endorsement naming the State of California and related parties, and workers’ compensation proof or a statement of exemption where applicable. That is a California state-property example in the described category, not a universal limit for documentaries on private land. The page is older than the current date, so verify the current wording and applicable policy with the authority and your insurer.

Check the rules for the exact jurisdiction and property

After the owner agrees in principle, contact the local film office, city permitting desk or property-owning agency. Explain where the camera and crew will stand, not merely where the building is located. Ask about film permits, street or sidewalk use, traffic control, parking, noise, fire safety, drones, generators and insurance filings.

Example What the published guidance says Practical implication
Texas private property Filming entirely on private property does not need a film permit, but an owner location agreement is required. A municipal permit is required when production impedes public space. Keep the crew, vehicles and equipment within the approved footprint or obtain the additional municipal approval.
Miami-Dade County The county says private-property shoots generally do not require a permit except for specified activities; Miami Beach has different requirements. Confirm whether the address is in Miami-Dade County or Miami Beach and review the activity-specific exceptions.
Hawaiʻi The Film Office describes exemptions for video on private property while maintaining separate processes for certain state sites. Do not assume a private-site exemption applies to a state-controlled location.
California state property An issued state permit replaces a location agreement in most instances, with listed exceptions. State-property applications can require specific insurance documents. Use the state application and insurance checklist rather than a private-location form alone.
Texas state property State property uses an application, feasibility review, insurance documentation and an agency-issued location agreement. Allow time for agency review; owner permission is part of a formal process, not a substitute for the application.
NYCHA developments and grounds NYCHA describes its developments and grounds as private property and requires prior approval and a license agreement. Obtain NYCHA approval even where the site appears publicly accessible.
Exterior views in London Film London distinguishes permission to photograph an exterior from permission from the authority or owner controlling the place where the camera is positioned. Private locations and interiors require permission. Secure approval for the camera position and access point, not only for the building visible in frame.

These examples demonstrate variation rather than a single national rule. Re-check the requirements if the dates, location, crew footprint or activities change.

A practical permission workflow

  1. Map ownership and control. Record the address, owner, tenant or manager, public agency and every area the crew may use. Identify the person authorized to sign.
  2. Describe the production. Send the documentary brief, crew and equipment list, schedule, access needs, parking plan and any requested alterations.
  3. Negotiate the location terms. Agree on fees, hours, preparation and wrap access, permitted activities, owner restrictions, cancellation, restoration and the intended use of images and footage.
  4. Draft and sign the agreement. Put the premises, production, purpose, dates, rights and responsibilities in a location agreement or release. Keep a fully signed copy with production records.
  5. Confirm insurance. Ask for required limits, certificates, endorsements, additional-insured language and workers’ compensation evidence. Send the documents before access when required.
  6. Apply for government or institutional approvals. Contact the local film office and any property-owning authority. Ask specifically about public-space obstruction, traffic, parking, noise and property-specific licenses.
  7. Run a pre-shoot confirmation. Reconfirm arrival time, access route, keys, parking, owner contact, protected areas, cleanup standard and emergency procedures.
  8. Document completion. Note the condition of the premises, complete cleanup and restoration, and obtain written acknowledgment of any agreed repairs or deductions.

Special cases that often cause mistakes

The camera is on public space

Ownership of the building does not control the place where your camera, tripod, van or lighting stand sits. A private owner may authorize access to the building while the city controls the sidewalk or road. If the setup affects public passage, traffic or parking, ask the municipal authority about a permit even when the scene depicts a private residence.

The site looks public but is government-owned

Public access is not the same as permission to film. Texas state property, NYCHA developments and certain Hawaiʻi state sites have their own approval systems. Start with the agency that controls the land, not only the city film office.

A manager agrees but the owner is absent

Request written evidence of the manager’s authority or have the owner countersign. The agreement should grant the specific access and footage-use rights your documentary requires; casual access may not cover those rights.

The schedule expands

Preparation, strike and cleanup can occupy more time than the interview itself. If a reshoot, additional room or extra vehicle is added, amend the agreement and re-check permits and insurance before proceeding.

Common failure points and fixes

  • Relying on verbal permission: Stop and obtain a signed agreement that states dates, areas and intended use.
  • Assuming private land means no permit: Ask whether any crew, vehicle or equipment affects public space or a regulated property.
  • Accepting permission from the wrong person: Verify ownership or agency and signing authority.
  • Leaving insurance until call time: Obtain the certificate and endorsements early enough for corrections.
  • Ignoring prep and restoration: Include load-in, strike, cleanup, damage inspection and return condition in the written terms.
  • Using a generic form unchanged: Tailor the document to the property, jurisdiction, rights and negotiated restrictions; seek legal advice for unusual risk or broad distribution.
  • Failing to update paperwork: Re-check approvals whenever the footprint, dates, locations or activities change.

Keep a complete location file

Store the signed agreement, amendments, owner contact details, permit or license, insurance certificate and endorsements, site plan, payment record and condition photographs together. Give the on-set producer a copy of the operative restrictions and emergency contacts. This makes it possible to show, quickly and accurately, what was authorized if a question arises during production or distribution.

No single form or permit replaces checking the actual location’s ownership and local rules. The reliable sequence is owner authorization in writing, insurance confirmation, separate jurisdictional checks and disciplined documentation of any change.
